Son employeur a justifi\u00e9 ce licenciement en affirmant qu&rsquo;elle \u00e9tait ill\u00e9galement absente car elle n&rsquo;avait inform\u00e9 son employeur de son incapacit\u00e9 de travail que par un message WhatsApp, alors que le r\u00e8glement de travail pr\u00e9voit que le manager doit \u00eatre averti par t\u00e9l\u00e9phone. Le licenciement pour faute grave est-il recevable dans ce cas de figure?<!--more--><\/p>\n<p>Le Tribunal du Travail n&rsquo;a pas suivi l&rsquo;argumentation de l&#8217;employeur consid\u00e9rant que ce dernier a \u00e9t\u00e9 inform\u00e9 valablement quant \u00e0 l&rsquo;incapacit\u00e9 de sa collaboratrice, m\u00eame si cela a \u00e9t\u00e9 &lsquo;g\u00e9r\u00e9&rsquo; via une messagerie telle que WhatsApp.<\/p>\n<p>La r\u00e9glementation stipule que l&#8217;employeur doit \u00eatre inform\u00e9 sans d\u00e9lai quant \u00e0 l&rsquo;incapacit\u00e9 du travailleur mais ne d\u00e9termine pas par quel moyen ceci doit se produire. Le travailleur est d\u00e8s lors libre d&rsquo;y proc\u00e9der par t\u00e9l\u00e9phone ou par sms, fax, voire quelque autre outil&#8230;<\/p>\n<p>La mention au r\u00e9glement de travail de l&#8217;employeur de la n\u00e9cessit\u00e9 de notifier l&rsquo;absence via un appel t\u00e9l\u00e9phonique est consid\u00e9r\u00e9e comme contraire \u00e0 la l\u00e9gislation dans la mesure o\u00f9 elle accro\u00eet les obligations incombant au travailleur, ce qui reste impossible dans la r\u00e9glementation du travail en Belgique.<\/p>\n<p>Le Tribunal a conclu que l&#8217;employ\u00e9e a justifi\u00e9 son absence dans les d\u00e9lais l\u00e9gaux et que la situation d&rsquo;absence injustifi\u00e9e n&rsquo;est pas fond\u00e9e. L&rsquo;avertissement via une application telle que WhatsApp n&rsquo;est pas consid\u00e9r\u00e9 comme une faute groupe rendant toute collaboration ult\u00e9rieure impossible. Le licenciement pour faute grave a \u00e9t\u00e9 rejet\u00e9 par le Tribunal du Travail.<\/p>\n<p><strong><em>Licenciement manifestement d\u00e9raisonnable ?<\/em><\/strong><\/p>\n<p>Bien que le motif de faute grave n&rsquo;ait pas \u00e9t\u00e9 retenu, la qualification de licenciement manifestement d\u00e9raisonnable n&rsquo;a pas davantage \u00e9t\u00e9 prise en compte.<\/p>\n<p>Apparemment, l&#8217;employ\u00e9e a post\u00e9 plusieurs messages sur les r\u00e9seaux sociaux pendant son incapacit\u00e9, affichant un \u00e9tat de sant\u00e9 visiblement peu conforme \u00e0 la justification de son absence. Bien qu&rsquo;autoris\u00e9e \u00e0 sortir de son domicile pendant son absence, le Tribunal a reconnu que tout employeur aurait pu contester l&rsquo;absence suite \u00e0 ces messages. Il a donc rejet\u00e9 la demande de qualification de licenciement manifestement d\u00e9raisonnable.<\/p>\n<p>En conclusion, il semble \u00e9vident que les m\u00e9dia sociaux ne peuvent plus \u00eatre ignor\u00e9s dans notre fonctionnement quotidien.
