Comme ils s\u2019y \u00e9taient engag\u00e9s, ils ont formul\u00e9 deux propositions relatives \u00e0 un projet de centralisation des textes r\u00e9glementaires, d\u2019une part, et \u00e0 un projet de guichet unique et de plateforme d\u2019information unique, d\u2019autre part.<!--more--><\/p>\n<p>Cet avis n\u00b02.184 a \u00e9t\u00e9 adopt\u00e9 par le CNT ce 27 octobre 2020, dans la suite attendue de la Recommandation n\u00b028 du 17 d\u00e9cembre 2019 au CNT et de l\u2019avis \u00ab cadre \u00bb n\u00b02.149 du m\u00eame jour (cfr. FEB Direct du 17 d\u00e9cembre 2019) et ce en concertation avec le SPF Emploi, Travail et Concertation sociale (ETCS) et la Banque carrefour de s\u00e9curit\u00e9 sociale.\u00a0Les partenaires sociaux se sont entendus pour r\u00e9am\u00e9nager le site internet <a href=\"http:\/\/www.restructurations.be\">www.restructurations.be<\/a>. Il est propos\u00e9 de pr\u00e9voir, en page d\u2019accueil, les quatre blocs suivants donnant acc\u00e8s au contenu :<\/p>\n<p><strong><em>1. Centraliser les textes<\/em><\/strong><br \/>\nL\u2019objectif consiste \u00e0 centraliser, de mani\u00e8re coh\u00e9rente, les diff\u00e9rents textes en vigueur ayant trait \u00e0 la mati\u00e8re des restructurations, et r\u00e9partis selon les th\u00e8mes qui la composent, en accordant une attention aux hypoth\u00e8ses de chevauchements entre ces th\u00e8mes.<\/p>\n<p><em><strong>2. Simplifier et am\u00e9liorer les flux d&rsquo;infos entre employeurs et autorit\u00e9s<\/strong><\/em><br \/>\nL\u2019objectif du guichet unique consiste \u00e0 all\u00e9ger les obligations des entreprises en restructuration et \u00e0 renforcer la s\u00e9curit\u00e9 juridique en offrant un \u00ab single point of contact \u00bb en termes de notifications.<\/p>\n<p>Par application du principe \u00ab Only Once \u00bb et des efforts continus en mati\u00e8re de simplification administrative, le d\u00e9veloppement d\u2019un nouveau mode de communication, plus efficace, s\u2019impose pour les entreprises en restructuration (caract\u00e8re imm\u00e9diat de l\u2019information d\u2019intention et de la notification, s\u00e9curit\u00e9 juridique, accessibilit\u00e9, r\u00e9duction de l\u2019usage du papier)<\/p>\n<p>Dans le cas, par exemple, de la proc\u00e9dure de licenciement collectif o\u00f9 l\u2019entreprise a l\u2019obligation d\u2019informer \u00e0 la fois le directeur du service r\u00e9gional de l\u2019emploi du lieu o\u00f9 est situ\u00e9e l\u2019entreprise (ACTIRIS\/VDAB\/FOREM\/ADG) ainsi que le pr\u00e9sident du comit\u00e9 de direction du SPF ETCS, on vise une application web au travers de laquelle les entreprises peuvent notifier, en une seule op\u00e9ration, l\u2019intention de proc\u00e9der \u00e0 un licenciement collectif.<\/p>\n<p>Par ailleurs, la plateforme d\u2019information unique est appel\u00e9e \u00e0 rassembler de mani\u00e8re coordonn\u00e9e et anonymis\u00e9e les dispositions prises en mati\u00e8re de restructurations pour am\u00e9liorer la s\u00e9curit\u00e9 juridique et informer toutes les parties concern\u00e9es.<\/p>\n<p>Parmi ces dispositions, figureront les pratiques qui mettent en \u0153uvre les deux recommandations du 17 d\u00e9cembre 2019 sur le plan de la qualit\u00e9 de la proc\u00e9dure d\u2019information-consultation et d\u2019information aux co-contractants.<\/p>\n<p>Les partenaires sociaux sollicitent par ailleurs le SPF ETCS pour recevoir un aper\u00e7u annuel des pratiques conclues dans les plans de restructurations sur la base de 4 crit\u00e8res : maintien de l\u2019emploi, mesures d\u2019accompagnement, r\u00e9gimes de fin de carri\u00e8re et, enfin, mention du paiement ou de l\u2019absence de paiement d\u2019indemnit\u00e9s extra-l\u00e9gales, sans indication de donn\u00e9es chiffr\u00e9es ou de m\u00e9thodes de calcul.<\/p>\n<p>Apr\u00e8s approbation par le Conseil, ces pratiques pourront \u00eatre publi\u00e9es sur la plateforme.<\/p>\n<p>&nbsp;<\/p>\n<p><em>Source: CNT &#8211; FEB<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Les partenaires sociaux ont cl\u00f4tur\u00e9 leur travail concernant les restructurations au sein du Conseil National du Travail.
