La victime avait, avant son licenciement, pr\u00e9venu sa hi\u00e9rarchie qu\u2019elle \u00e9tait enceinte. Apr\u00e8s avoir vainement essay\u00e9 de trouver une solution \u00e0 l\u2019amiable avec l\u2019employeur, l\u2019Institut pour l\u2019\u00e9galit\u00e9 des femmes des hommes avait introduit l\u2019affaire en justice.<!--more--><\/p>\n<p>La plaignante a dans un premier temps inform\u00e9 sa hi\u00e9rarchie de sa grossesse. Cette grossesse a ensuite impos\u00e9 une absence pour cause de maladie, ce qui a \u00e9t\u00e9 attest\u00e9 par un certificat m\u00e9dical. Elle a \u00e9t\u00e9 licenci\u00e9e durant sa grossesse au motif d\u2019une r\u00e9organisation en interne. La victime est la seule personne licenci\u00e9e \u00e0 la suite de cette r\u00e9organisation.<\/p>\n<p>Comme le rappelle Michel Pasteel, directeur de l\u2019Institut : <em>\u00ab\u00a0Toutes les femmes ont le droit d\u2019\u00eatre enceintes sans craindre de perdre leur emploi. Les comportements discriminatoires envers les travailleuses notamment envers les travailleuses enceintes doivent encore et toujours \u00eatre combattus dans notre soci\u00e9t\u00e9. Cette affaire d\u00e9montre qu\u2019il ne suffit pas pour un employeur d\u2019all\u00e9guer une r\u00e9organisation interne pour prouver un motif \u00e9conomique permettant de justifier le licenciement d\u2019une femme enceinte.\u00a0\u00bb<\/em><\/p>\n<p>La Cour a ainsi rappel\u00e9 dans son jugement la r\u00e8gle pr\u00e9vue \u00e0 l\u2019article 40 de la loi 16 mars 1971 sur le travail. Selon cette r\u00e8gle, pendant une certaine p\u00e9riode qui d\u00e9bute au moment o\u00f9 l\u2019employeur a \u00e9t\u00e9 inform\u00e9 de la grossesse et qui se termine un mois apr\u00e8s la fin du cong\u00e9 de maternit\u00e9 postnatal, l\u2019employeur ne peut licencier la travailleuse sauf pour des motifs \u00e9trangers \u00e0 l\u2019\u00e9tat physique r\u00e9sultant de la grossesse ou de l\u2019accouchement. En l\u2019esp\u00e8ce, les explications invoqu\u00e9es par l\u2019employeur concernant une r\u00e9organisation interne n\u2019ont pas convaincu le tribunal.\u00a0L\u2019ex-employeur a \u00e9t\u00e9 condamn\u00e9 \u00e0 payer une indemnit\u00e9 \u00e9quivalente \u00e0 6 mois de r\u00e9mun\u00e9ration brute \u00e0 la plaignante et 500 \u20ac \u00e0 l\u2019Institut.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>La Cour du travail de Li\u00e8ge a condamn\u00e9 le 26 mars 2020 dernier un employeur pour un licenciement discriminatoire.
