Ce dernier avait refus\u00e9 d\u2019engager une candidate pour des raisons li\u00e9es \u00e0 sa maternit\u00e9.<!--more--><\/p>\n<p>En mai 2015, Madame B. s\u2019\u00e9tait port\u00e9e candidate \u00e0 un emploi de secr\u00e9taire aupr\u00e8s d\u2019un centre m\u00e9dical. Apr\u00e8s un entretien d\u2019embauche, elle n\u2019avait finalement pas \u00e9t\u00e9 retenue. L\u2019employeur avait r\u00e9pondu par e-mail : <em>\u00ab\u00a0nous n\u2019avons pas retenu votre candidature, en effet votre r\u00f4le de maman doit primer sur votre carri\u00e8re et nous cherchons une personne libre de tout engagement familial et flexible dans les horaires (\u2026) \u00ab\u00a0.<\/em><\/p>\n<p>Dans son arr\u00eat du 30 juin 2021, la Cour du travail de Bruxelles a reconnu l\u2019existence d\u2019une discrimination directe fond\u00e9e sur la maternit\u00e9. En effet, l\u2019employeur a fait express\u00e9ment r\u00e9f\u00e9rence au r\u00f4le de maman de la candidate pour justifier son refus.<\/p>\n<p>Madame B a obtenu une indemnit\u00e9 \u00e9quivalente \u00e0 3 mois de r\u00e9mun\u00e9ration brute soit la moiti\u00e9 de ce qui est pr\u00e9vu normalement par la loi. En effet, la Cour a estim\u00e9 que le refus d\u2019engagement reposait \u00e9galement sur d\u2019autres crit\u00e8res que la maternit\u00e9.<\/p>\n<p>Par cet arr\u00eat la Cour r\u00e9affirme qu\u2019un suppos\u00e9 manque de disponibilit\u00e9 et\/ou de flexibilit\u00e9 d\u2019une femme en raison du nombre d\u2019enfants dont elle a la charge ne peut en aucuns cas justifier une discrimination directe.<\/p>\n<p>L\u2019Institut se r\u00e9jouit de cette d\u00e9cision qui rappelle que les employeurs doivent effectuer leurs s\u00e9lections et recrutements sur base de crit\u00e8res objectifs plut\u00f4t que sur la base du sexe, de la maternit\u00e9 et des st\u00e9r\u00e9otypes qui y sont associ\u00e9s.<\/p>\n<p>Selon Michel Pasteel, Directeur de l\u2019Institut, cette affaire montre que <em>\u00ab les st\u00e9r\u00e9otypes de genre qui gravitent autour de la grossesse et de la maternit\u00e9 ont un impact sur les femmes dans la sph\u00e8re professionnelle et ce, d\u00e8s la recherche d\u2019un emploi \u00bb.<\/em><\/p>\n<p>En 2020, 36% des signalements re\u00e7us par l\u2019Institut relatifs au domaine de l\u2019emploi concernaient la grossesse et la maternit\u00e9.<\/p>\n<p>&nbsp;<\/p>\n<p><em>Source: Institut pour l&rsquo;\u00e9galit\u00e9 des femmes et des hommes<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Les st\u00e9r\u00e9otypes ont la peau dure et la jurisprudence devrait contribuer \u00e0 faire \u00e9voluer les mentalit\u00e9s, Ainsi, la Cour du Travail de Bruxelles a condamn\u00e9 en appel, le 30 juin 2021, un employeur pour discrimination fond\u00e9e sur le sexe.
