Cette r\u00e8gle a \u00e9t\u00e9 confirm\u00e9e dans l&rsquo;arr\u00eat\u00e9 royal de 19 novembre 2021 modifiant l&rsquo;arr\u00eat\u00e9 royal du 28 octobre 2021 portant les mesures de police administrative n\u00e9cessaires en vue de pr\u00e9venir ou de limiter les cons\u00e9quences pour la sant\u00e9 publique de la situation d&rsquo;urgence \u00e9pid\u00e9mique d\u00e9clar\u00e9e concernant la pand\u00e9mie de coronavirus.<!--more--><\/p>\n<p>Les nouvelles r\u00e8gles sont entr\u00e9es en vigueur le 20 novembre 2021 et sont provisoirement applicables jusqu&rsquo;au 28 janvier 2022. Que doivent faire les employeurs ?<\/p>\n<ul>\n<li>fournir aux travailleurs qui ne sont pas en mesure de faire du t\u00e9l\u00e9travail \u00e0 domicile une attestation ou toute autre preuve confirmant la n\u00e9cessit\u00e9 de leur pr\u00e9sence sur le lieu de travail;<\/li>\n<li>effectuer une inscription mensuelle via l&rsquo;Office National de S\u00e9curit\u00e9 Sociale du:\n<ul>\n<li>nombre de personnes occup\u00e9es au sein de l&rsquo;entreprise par unit\u00e9 d&rsquo;\u00e9tablissement; et<\/li>\n<li>nombre de personnes occup\u00e9es au sein de l&rsquo;entreprise qui exercent une fonction qui est incompatible avec le t\u00e9l\u00e9travail.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li>Cette d\u00e9claration porte sur la situation au premier jour ouvrable du mois et doit \u00eatre effectu\u00e9e au plus tard le 6e jour civil du mois. La d\u00e9claration pour la p\u00e9riode jusqu&rsquo;au 31 d\u00e9cembre inclus porte sur la situation au mercredi 24 novembre 2021. Elle doit \u00eatre introduite le mardi 30 novembre 2021 au plus tard. S\u2019il n\u2019y a pas de modification par la suite, il n&rsquo;est pas n\u00e9cessaire d&rsquo;introduire une nouvelle d\u00e9claration.<\/li>\n<\/ul>\n<p>C\u2019est important car les services d&rsquo;inspection sociale utiliseront ces dates comme point de r\u00e9f\u00e9rence pour v\u00e9rifier le respect du t\u00e9l\u00e9travail \u00e0 domicile. Toute personne qui occupe un poste de t\u00e9l\u00e9travail \u00e0 domicile, mais qui est pr\u00e9sente dans les locaux de l&rsquo;entreprise, devra \u00eatre en mesure de justifier sa pr\u00e9sence.<\/p>\n<p><strong><em>Moments de retour limit\u00e9s possibles<\/em><\/strong><\/p>\n<p>Les employeurs peuvent organiser des moments de retour, mais ils ne peuvent pas les rendre obligatoires (un accord avec chaque travailleur sera n\u00e9cessaire).<\/p>\n<ul>\n<li>jusqu&rsquo;au 12 d\u00e9cembre: 1 jour de travail maximum dans la semaine, avec max. 20% de t\u00e9l\u00e9travailleurs pr\u00e9sents en m\u00eame temps (PME &lt;10 travailleurs: max. 5 pr\u00e9sents en m\u00eame temps). Pour le d\u00e9compte, les personnes pour lesquelles le t\u00e9l\u00e9travail est impossible, ne sont pas comptabilis\u00e9es;<\/li>\n<li>\u00e0 partir du 13 d\u00e9cembre: maximum 2 jours par semaine, avec max. 40% des t\u00e9l\u00e9travailleurs pr\u00e9sents en m\u00eame temps (PME &lt; 10 travailleurs: max. 5 pr\u00e9sents en m\u00eame temps). Pour le d\u00e9compte, les personnes pour lesquelles le t\u00e9l\u00e9travail est impossible, ne sont pas comptabilis\u00e9es.<\/li>\n<li>Les moments de retour sont assortis d\u2019un certain nombre de conditions, \u00e0 savoir:\n<ul>\n<li>objectif du retour: promouvoir le bien-\u00eatre psychosocial et l&rsquo;esprit d&rsquo;\u00e9quipe;<\/li>\n<li>les instructions n\u00e9cessaires sur les mesures \u00e0 prendre pour un retour en toute s\u00e9curit\u00e9 doivent \u00eatre donn\u00e9es au personnel \u00e0 l&rsquo;avance;<\/li>\n<li>le personnel doit \u00eatre inform\u00e9 de l&rsquo;interdiction de venir s&rsquo;il se sent malade ou s\u2019il est en quarantaine;<\/li>\n<li>il ne doit pas y avoir de cons\u00e9quences n\u00e9gatives pour les employ\u00e9s lors des moments de retour;<\/li>\n<li>les d\u00e9placements en transports publics aux heures de pointe et le covoiturage doivent \u00eatre \u00e9vit\u00e9s autant que possible; et<\/li>\n<li>la d\u00e9cision doit \u00eatre prise dans le respect de la concertation sociale au sein l&rsquo;entreprise, il est donc conseill\u00e9 de consulter le comit\u00e9 pour la pr\u00e9vention et la protection au travail, les repr\u00e9sentants syndicaux ou, \u00e0 d\u00e9faut, les travailleurs eux-m\u00eames.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><em>Source: Lydian<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Le t\u00e9l\u00e9travail \u00e0 domicile est \u00e0 nouveau obligatoire pour toutes les personnes, ind\u00e9pendamment de la nature de la relation de travail, donc \u00e9galement applicable aux ind\u00e9pendants, sauf si cela est impossible en raison de la nature de la fonction, de [&hellip;]<\/p>\n","protected":false},"author":2,"featured_media":0,"comment_status":"closed","ping_status":"open","sticky":false,"template":"","format":"standard","meta":[],"categories":[65,10],"tags":[2947,282,219],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v21.0 - https:\/\/yoast.com\/wordpress\/plugins\/seo\/ -->\n<title>Quelles mesures les employeurs doivent-ils prendre pour respecter l&#039;obligation de t\u00e9l\u00e9travail?
