El\u00e9ment d\u00e9cisif dans le dossier, l\u2019enregistrement de conversations par la victime, \u00e0 l\u2019insu de l\u2019employeur, a \u00e9t\u00e9 consid\u00e9r\u00e9 comme une preuve recevable.<!--more--><\/p>\n<p>Assistante v\u00e9t\u00e9rinaire occup\u00e9e dans le cadre d\u2019un contrat \u00e0 dur\u00e9e d\u00e9termin\u00e9e, la victime a vu son contrat de travail renouvel\u00e9 trois fois. Celui-ci devait d\u00e9boucher sur un contrat \u00e0 dur\u00e9e ind\u00e9termin\u00e9e \u00e0 temps plein. Toutefois, apr\u00e8s l\u2019annonce de la grossesse de la travailleuse, l\u2019employeur ne lui a propos\u00e9 qu\u2019un contrat \u00e0 mi-temps. Le tribunal du travail a reconnu une discrimination directe li\u00e9e \u00e0 la maternit\u00e9.<\/p>\n<p>Il a \u00e9galement estim\u00e9 qu\u2019un enregistrement r\u00e9alis\u00e9 par une victime \u00e0 l\u2019insu de l\u2019employeur pouvait \u00eatre consid\u00e9r\u00e9 comme un mode de preuve recevable. Et ce, au motif que sans enregistrement, la salari\u00e9e n\u2019aurait pas pu d\u00e9noncer la situation. L\u2019enregistrement audio montre que l\u2019employeur justifie le fait de ne pas engager la salari\u00e9e \u00e0 temps plein par le fait qu&rsquo;elle va bient\u00f4t devenir maman d&rsquo;un jeune enfant. L\u2019employeur a \u00e9t\u00e9 condamn\u00e9 au paiement d\u2019une indemnit\u00e9 de 6 mois de r\u00e9mun\u00e9ration brute.<\/p>\n<p><em><strong>Une avanc\u00e9e pour les droits des victimes qui fait jurisprudence<\/strong><\/em><\/p>\n<p>Cette d\u00e9cision renforce la jurisprudence en mati\u00e8re de discrimination fond\u00e9e sur le sexe. En 2020, pour la premi\u00e8re fois, un tribunal du travail avait reconnu la recevabilit\u00e9 des enregistrements audios comme preuve dans une affaire similaire. Dans ces deux dossiers, il a donc pu \u00eatre d\u00e9montr\u00e9 que les employeurs \u00e9taient satisfaits de leur collaboration avec les travailleuses et ce, jusqu&rsquo;\u00e0 l&rsquo;annonce de leur grossesse, et que la maternit\u00e9 avait pu jouer un r\u00f4le dans la d\u00e9cision des employeurs, pour l\u2019un, de ne pas renouveler le contrat de travail et, dans le cas le plus r\u00e9cent, de ne proposer qu&rsquo;un contrat \u00e0 temps partiel.<\/p>\n<p>Pour Michel Pasteel, le directeur de l\u2019Institut, <em>\u00ab ces affaires illustrent \u00e0 quel point les discriminations li\u00e9es \u00e0 la grossesse sont encore pr\u00e9sentes dans notre soci\u00e9t\u00e9. Il faut faire \u00e9voluer les mentalit\u00e9s afin que la maternit\u00e9 ne soit plus un obstacle pour les femmes sur le march\u00e9 de l\u2019emploi.<\/em><em>\u00a0La question de la preuve constitue une difficult\u00e9 majeure pour les victimes de discrimination car les auteurs n\u2019agissent en g\u00e9n\u00e9ral pas ouvertement.
