La plupart des r\u00e8gles entrent en vigueur le 1er octobre 2022 et s&rsquo;appliquent au trajet de r\u00e9int\u00e9gration en cours. Il s\u2019agit de la premi\u00e8re partie des nouvelles r\u00e8gles dont vous devez tenir compte dans votre politique concernant les travailleurs en incapacit\u00e9 de travail.<!--more--><\/p>\n<p>La loi portant des dispositions diverses relatives \u00e0 l\u2019incapacit\u00e9 de travail ayant pour th\u00e8mes principaux la force majeure m\u00e9dicale et la suppression du certificat m\u00e9dical, n\u2019a pas encore \u00e9t\u00e9 adopt\u00e9e.<\/p>\n<p>Ci-dessous, vous trouverez un bref r\u00e9sum\u00e9 des modifications principales du trajet de r\u00e9int\u00e9gration 2.0 (TR), compil\u00e9es par le cabinet d&rsquo;avocats Lydian.<\/p>\n<p>L\u2019objectif de ce nouveau trajet est la r\u00e9int\u00e9gration effective du travailleur aupr\u00e8s de son propre employeur. Les nouveaut\u00e9s du TR 2.0 se pr\u00e9sentent comme suit:<\/p>\n<p>Le TR peut d\u00e9buter:<\/p>\n<ul>\n<li>\u00e0 la demande du travailleur (ou de son m\u00e9decin traitant) \u00e0 partir du 1er jour d\u2019incapacit\u00e9 de travail ; ou<\/li>\n<li>\u00e0 la demande de l\u2019employeur apr\u00e8s 3 mois d\u2019incapacit\u00e9 de travail ininterrompue (ou sur pr\u00e9sentation d\u2019un certificat d\u2019incapacit\u00e9 d\u00e9finitive).<\/li>\n<\/ul>\n<p>Si le travailleur n\u2019accepte pas \u00e0 3 reprises l\u2019invitation (avec un intervalle d\u2019au moins 14 jours calendrier entre chaque invitation) du conseiller en pr\u00e9vention-m\u00e9decin du travail (CP-MT) en vue de l\u2019\u00e9valuation de r\u00e9int\u00e9gration, le TR prend fin et le m\u00e9decin-conseil ainsi que l\u2019employeur en sont inform\u00e9s.<\/p>\n<p>L\u2019\u00e9valuation de r\u00e9int\u00e9gration doit \u00eatre transmise par le CP-MT au plus tard 49 jours calendrier suivant la r\u00e9ception de la demande.<\/p>\n<p>Le CP-MT peut prendre 3 d\u00e9cisions:<\/p>\n<ul>\n<li>D\u00e9cision A: le travailleur est temporairement inapte au travail convenu et un travail adapt\u00e9 ou un autre travail est possible ;<\/li>\n<li>D\u00e9cision B: le travailleur est d\u00e9finitivement inapte au travail convenu et un travail adapt\u00e9 ou un autre travail est possible ;<\/li>\n<li>D\u00e9cision C: il n\u2019est (pour le moment) pas possible, pour des raisons m\u00e9dicales, de r\u00e9aliser une \u00e9valuation de r\u00e9int\u00e9gration. Dans ce cas, le TR prend fin et pourra, en principe, \u00eatre relanc\u00e9 au plus t\u00f4t 3 mois apr\u00e8s cette d\u00e9cision.<\/li>\n<\/ul>\n<p>L\u2019employeur communique le plan de r\u00e9int\u00e9gration au travailleur dans un d\u00e9lai maximum de 63 jours calendrier ou de 6 mois apr\u00e8s avoir re\u00e7u l\u2019\u00e9valuation de r\u00e9int\u00e9gration, selon qu\u2019il s\u2019agisse respectivement d\u2019une d\u00e9cision A ou d\u2019une d\u00e9cision B.<br \/>\nLe rapport dans lequel l\u2019employeur motive sa d\u00e9cision de ne pas \u00e9tablir de plan tient compte, le cas \u00e9ch\u00e9ant, du droit \u00e0 un am\u00e9nagement raisonnable pour les personnes handicap\u00e9es.<\/p>\n<p>Le travailleur dispose d\u2019un d\u00e9lai de 14 jours calendrier (\u00e0 compter du lendemain du jour o\u00f9 il re\u00e7oit le plan) pour accepter ou refuser le plan de r\u00e9int\u00e9gration propos\u00e9.<\/p>\n<p>Le d\u00e9lai de recours est de 21 jours, sans possibilit\u00e9 de prolongation.<\/p>\n<p>Le recours doit \u00eatre trait\u00e9 end\u00e9ans les 42 jours calendrier.<\/p>\n<p>L\u2019employeur communique annuellement au comit\u00e9 les \u00e9l\u00e9ments globaux et anonymis\u00e9s des trajets de r\u00e9int\u00e9gration et des rapports motiv\u00e9s. Il veille \u00e0 ce les travailleurs individuels ne puissent pas \u00eatre identifi\u00e9s sur la base de ces \u00e9l\u00e9ments.
