Cette r\u00e9union intervient alors que l\u2019Organisation internationale du travail (OIT) vient de donner raison aux trois organisations syndicales belges qui demandent de modifier la loi sur la norme salariale (dite loi de \u201996). Cela conforte les travailleurs et travailleuses dans l\u2019id\u00e9e qu\u2019il faut poursuivre la r\u00e9sistance sociale qu\u2019ils m\u00e8nent depuis plus d\u2019un an contre le blocage salarial.<!--more--><\/p>\n<p>Apr\u00e8s le succ\u00e8s proclam\u00e9 de de la gr\u00e8ve du 9 novembre, la FGTB demande au gouvernement d\u2019ouvrir un dialogue au plus vite pour changer cette loi. Car elle est d\u00e9finitivement injuste et obsol\u00e8te.<\/p>\n<p><em>\u00ab\u00a0Le gouvernement doit de toute urgence engager des consultations avec les interlocuteurs sociaux pour r\u00e9former la loi sur la norme salariale (loi de &rsquo;96). C&rsquo;est la conclusion de l&rsquo;Organisation internationale du travail (OIT) suite \u00e0 une plainte des trois syndicats belges aupr\u00e8s du comit\u00e9 de l&rsquo;OIT charg\u00e9 des libert\u00e9s syndicales.<br \/>\nDepuis 2017, la loi sur la norme salariale \u2013 r\u00e9vis\u00e9e par le Gouvernement Michel \u2013 impose un carcan via une norme salariale maximale imp\u00e9rative, qui ne laisse aucune libert\u00e9 de n\u00e9gociation aux interlocuteurs sociaux. Que ce soit au niveau interprofessionnel, sectoriel ou de l&rsquo;entreprise. Cette norme maximale est mal calcul\u00e9e car les subventions salariales (pr\u00e8s de 9 milliards en 2020) et les mesures de tax shift (7, 5 milliards) ne sont pas prises en compte dans la comparaison. Pourtant, elles r\u00e9duisent consid\u00e9rablement les \u00ab co\u00fbts salariaux \u00bb pour les employeurs.<br \/>\nL&rsquo;OIT donne raison aux syndicats belges sur toute la ligne. La loi constitue une violation de l&rsquo;importante convention n\u00b0 98 de l&rsquo;OIT sur le droit d&rsquo;organisation et de n\u00e9gociation collective. Ou plus pr\u00e9cis\u00e9ment, la loi porte atteinte \u00e0 l&rsquo;autonomie des interlocuteurs sociaux pour n\u00e9gocier collectivement les salaires. L&rsquo;OIT fait valoir qu&rsquo;il n&rsquo;appartient pas au gouvernement, par le biais d&rsquo;une loi, de d\u00e9terminer les crit\u00e8res dans lesquels les n\u00e9gociations salariales doivent avoir lieu. La loi n&rsquo;est pas temporaire et ne peut donc pas \u00eatre d\u00e9fendue par le gouvernement comme une mesure d&rsquo;urgence.<br \/>\nLa recommandation de l&rsquo;OIT est tripartite : elle est soutenue par les syndicats, les gouvernements ainsi que les employeurs. Il est donc surprenant de la voir aujourd\u2019hui instrumentalis\u00e9e par la FEB, pour attaquer l&rsquo;indexation automatique des salaires. L&rsquo;indexation automatique est un fait conventionnel (coul\u00e9 dans les conventions collectives sectorielles par le biais de la consultation sociale) et non un fait l\u00e9gal, comme la loi sur la norme salariale. Lier les deux, c\u2019est comparer des pommes et des poires.<br \/>\nNous attendons une r\u00e9ponse positive du gouvernement, \u00e0 court terme, afin d\u2019entamer un dialogue sur la r\u00e9forme de la loi. Conform\u00e9ment \u00e0 la recommandation de l&rsquo;OIT, les interlocuteurs sociaux devraient d\u00e9terminer eux-m\u00eames les contours des n\u00e9gociations salariales.
