Force est de constater que la majorit\u00e9 des questions portent sur la mani\u00e8re dont les employeurs peuvent aider financi\u00e8rement leurs collaborateurs en cette p\u00e9riode difficile. Groupe S r\u00e9pertorie les questions les plus fr\u00e9quentes.<!--more--><\/p>\n<p>Les crises \u00e9conomique et \u00e9nerg\u00e9tique qui s\u00e9vissent actuellement suscitent des inqui\u00e9tudes. Cela vaut certainement aussi pour les entrepreneurs et les chefs d\u2019entreprise qui expriment leurs pr\u00e9occupations aupr\u00e8s de l\u2019instance qui est leur premier interlocuteur en mati\u00e8re de RH : leur secr\u00e9tariat social. Group S a dress\u00e9 la liste des questions les plus souvent pos\u00e9es par les employeurs.<\/p>\n<p>Voici les six questions les plus fr\u00e9quentes et leurs r\u00e9ponses.<br \/>\n<strong><em>Les employeurs peuvent-ils verser une prime pour aider leurs collaborateurs \u00e0 faire face aux co\u00fbts \u00e9lev\u00e9s li\u00e9s \u00e0 la hausse des prix de l\u2019\u00e9nergie ?\u00a0<\/em><\/strong>Oui, c\u2019est possible. Tout employeur est libre d\u2019accorder une prime \u00e0 un collaborateur \u00e0 tout moment. Aucun r\u00e9gime socialement avantageux n\u2019est toutefois pr\u00e9vu pour une telle prime. Elle est donc int\u00e9gralement soumise \u00e0 l\u2019ONSS et au pr\u00e9compte professionnel.<\/p>\n<p><strong><em>Les employeurs peuvent-ils, de leur propre initiative, indexer les salaires des collaborateurs avant le moment o\u00f9 le secteur pr\u00e9voit une indexation automatique des salaires ?\u00a0<\/em><\/strong>Une indexation automatique des salaires ne s\u2019applique qu\u2019au moment o\u00f9 elle est pr\u00e9vue, selon le secteur ou la commission paritaire. Vous souhaitez cependant \u00ab aider \u00bb vos collaborateurs \u00e0 supporter l\u2019augmentation du co\u00fbt de la vie ou des prix de l\u2019\u00e9nergie en attendant cette indexation ? Vous pouvez opter pour une prime temporaire, vers\u00e9e mensuellement ou trimestriellement, mais qui s\u2019arr\u00eate lorsque l\u2019indexation doit \u00eatre appliqu\u00e9e. Nous revenons alors au m\u00e9canisme de prime d\u00e9crit \u00e0 la question 1.<\/p>\n<p><strong><em>Quelle est la meilleure piste face aux prix \u00e9lev\u00e9s du carburant ? Accorder une carte carburant \u00e0 un collaborateur ne disposant pas de voiture de soci\u00e9t\u00e9 ? Ou justement limiter le montant pour les collaborateurs qui ont une carte carburant ?\u00a0<\/em><\/strong>Les deux options sont r\u00e9alistes. Si vous proposez une carte carburant (temporaire) sans voiture de soci\u00e9t\u00e9, elle doit \u00eatre d\u00e9clar\u00e9e comme un avantage de toute nature selon la valeur r\u00e9elle, c\u2019est-\u00e0-dire sur base du co\u00fbt r\u00e9el du carburant, pour les d\u00e9placements priv\u00e9s. Les trajets domicile-travail rel\u00e8vent d\u2019ailleurs des d\u00e9placements priv\u00e9s.<\/p>\n<p>Vous pouvez \u00e9galement limiter l\u2019utilisation des cartes carburant en restreignant l\u2019usage priv\u00e9 ou en demandant une participation au collaborateur. De plus, vous pouvez \u00e9galement imposer une limite de kilom\u00e9trage ou limiter l\u2019utilisation de la carte carburant \u00e0 l\u2019\u00e9tranger. Toutefois, si l\u2019attribution \u00e9tait jusqu\u2019\u00e0 pr\u00e9sent illimit\u00e9e, l\u2019employeur ne peut la modifier unilat\u00e9ralement. Cela risquerait d\u2019\u00eatre consid\u00e9r\u00e9 comme une r\u00e9vocation implicite de la part de l\u2019employeur. Il faut donc l\u2019accord du collaborateur, par exemple en lui faisant signer une modification de la car policy.<\/p>\n<p><strong><em>Pouvez-vous, en tant qu\u2019employeur, imposer le t\u00e9l\u00e9travail ?\u00a0<\/em><\/strong>Les bons accords font les bons amis. Le mieux est d\u2019examiner la convention de t\u00e9l\u00e9travail structurel avec le collaborateur. Si le t\u00e9l\u00e9travail y est formul\u00e9 de mani\u00e8re volontaire, vous ne pouvez pas l\u2019imposer. Si la convention est formul\u00e9e de sorte que le collaborateur doit effectivement t\u00e9l\u00e9travailler les jours convenus, ce dernier ne peut se soustraire \u00e0 la convention. En contrepartie, l\u2019employeur peut verser une indemnit\u00e9 qui couvre les frais d\u2019\u00e9quipements d\u2019utilit\u00e9 publique, d\u2019\u00e9lectricit\u00e9, etc. Aujourd\u2019hui, l\u2019\u00e9ventuelle indemnit\u00e9 de t\u00e9l\u00e9travail est limit\u00e9e \u00e0 maximum 142,95 euros par mois.<\/p>\n<p><strong><em>Pouvons-nous octroyer un pr\u00eat aux collaborateurs qui rencontrent des difficult\u00e9s financi\u00e8res ?\u00a0<\/em><\/strong>Un employeur ou une entreprise peut accorder un pr\u00eat \u00e0 des conditions avantageuses. Concr\u00e8tement, il s\u2019agit d\u2019un pr\u00eat sans int\u00e9r\u00eat ou d\u2019un pr\u00eat \u00e0 un taux inf\u00e9rieur \u00e0 celui pratiqu\u00e9 par les (autres) organismes de cr\u00e9dit. Ce pr\u00eat est alors consid\u00e9r\u00e9 comme un avantage de toute nature imposable. Cet avantage de toute nature imposable est \u00e9gal \u00e0 la diff\u00e9rence entre:<\/p>\n<ul>\n<li>le tarif du taux d\u2019int\u00e9r\u00eat de r\u00e9f\u00e9rence qui varie en fonction du type de pr\u00eat; et<\/li>\n<li>le taux d\u2019int\u00e9r\u00eat que l\u2019emprunteur doit payer.<\/li>\n<\/ul>\n<p><strong><em>Comment pouvons-nous, de la mani\u00e8re la moins ch\u00e8re possible, pr\u00e9voir une intervention pour nos collaborateurs afin de les aider \u00e0 supporter la hausse des prix du carburant et de l\u2019\u00e9nergie ?<\/em><\/strong><\/p>\n<p>En tant qu\u2019employeur, vous pouvez:<\/p>\n<ul>\n<li>accorder une prime brute temporaire. Bien que co\u00fbteuse pour l\u2019employeur, cette solution a un impact direct sur le salaire net;<\/li>\n<li>augmenter le montant de l\u2019abonnement social, jusqu\u2019\u00e0 maximum 0,4170 euros;<\/li>\n<li>introduire d\u2019autres formes de r\u00e9mun\u00e9ration alternative. Bien que celles-ci soient indirectement li\u00e9es aux prix de l\u2019\u00e9nergie, elles sont plus int\u00e9ressantes pour l\u2019employeur en termes de co\u00fbt salarial.
