Rudy Van Den Bossche, expert aupr\u00e8s de Partena HR, partage son analyse.<!--more--><\/div>\n<h2>L\u2019employeur a l\u2019obligation de fournir du travail<\/h2>\n<p>En principe, l\u2019employeur est tenu de prendre les mesures n\u00e9cessaires pour procurer du travail \u00e0 son travailleur et est oblig\u00e9 de lui payer un salaire pour le travail accompli. Outre des mesures techniques (p.ex. un g\u00e9n\u00e9rateur d\u2019\u00e9lectricit\u00e9, un remaniement de la ligne de production,\u2026) l\u2019employeur sera donc attentif \u00e0 anticiper les cons\u00e9quences d\u2019une coupure d\u2019\u00e9lectricit\u00e9 sur l\u2019organisation du travail.<\/p>\n<p>Les plans d\u2019urgence et de d\u00e9lestage de certains territoires lors d\u2019une p\u00e9nurie d\u2019\u00e9lectricit\u00e9 restent \u00e0 ce jour encore fort peu connus pour les entreprises. Il s\u2019agit toutefois d\u2019une information importante, car l\u2019entrepreneur qui est inform\u00e9 au pr\u00e9alable d\u2019une coupure d\u2019\u00e9lectricit\u00e9 possible dans son entreprise, est mieux pr\u00e9par\u00e9 pour prendre des mesures qui en limitent l\u2019impact sur le bon fonctionnement de ses activit\u00e9s.<\/p>\n<h2>Coupures d\u2019\u00e9lectricit\u00e9 annonc\u00e9es<\/h2>\n<p>Dans le cas de risques annonc\u00e9s, comme une coupure d\u2019\u00e9lectricit\u00e9 de plusieurs heures, l\u2019employeur prendra, en bon p\u00e8re de famille, les mesures n\u00e9cessaires pour pouvoir faire la transition : quelles t\u00e2ches restent possibles (entretien, archivage, classement,\u2026) ? Comment r\u00e9duire la consommation d\u2019\u00e9nergie ? Est-ce le moment pour  organiser une formation ou un brainstorming ? Ou une activit\u00e9 de teambuilding? Le travail \u00e0 domicile occasionnel est-il possible ? Ou y a-t-il moyen d\u2019organiser le transport pour poursuivre le travail dans une autre localisation ?&#8230;De la cr\u00e9ativit\u00e9, du bon sens et de la compr\u00e9hension r\u00e9ciproque sont les mots cl\u00e9s. Le travailleur peut lui aussi \u00eatre confront\u00e9 \u00e0 des situations de crise similaires \u00e0 la maison (s\u00e9curit\u00e9, chauffage, appareils \u00e9lectriques indispensables,\u2026). D\u2019un commun accord, le travailleur pourra \u00e9ventuellement prendre un jour de r\u00e9cup\u00e9ration ou un jour de cong\u00e9, r\u00e9mun\u00e9r\u00e9 ou non.<\/p>\n<p>Si l\u2019employeur ne trouve pas d\u2019alternative et ne peut fournir un autre travail au travailleur, il devra en principe continuer \u00e0 lui payer son salaire. En revanche, l\u2019employeur ne devra pas payer de salaire si le travailleur refuse le travail de remplacement, \u00e0 condition que le travail propos\u00e9 corresponde aux aptitudes physiques et intellectuelles du travailleur et soit compatible avec ses qualifications professionnelles sans entra\u00eener de pr\u00e9judice mat\u00e9riel ou moral.<\/p>\n<h2>Coupure d\u2019\u00e9lectricit\u00e9 inattendue: cas de force majeure?<\/h2>\n<p>Il se peut aussi que la coupure d\u2019\u00e9lectricit\u00e9 n\u2019ait pas \u00e9t\u00e9 annonc\u00e9e. Dans ce cas, l\u2019employeur dispose de peu ou pas de moyens pour l\u2019anticiper. Si l\u2019employeur ne peut pas proposer d\u2018alternatives au travailleur, il peut introduire une demande de ch\u00f4mage pour cause de force majeure aupr\u00e8s de l\u2019Onem. Dans ce cas, il devra suivre une proc\u00e9dure stricte et l\u2019Onem devra accepter la demande. Si le travailleur doit rentrer \u00e0 la maison en cours de journ\u00e9e, le salaire sera d\u00fb pour la journ\u00e9e enti\u00e8re.<\/p>\n<h2>P\u00e9nurie d\u2019\u00e9lectricit\u00e9 annonc\u00e9e dans les transports en commun: l\u2019employeur doit-il payer les heures &lsquo;non-travaill\u00e9es\u2019?<\/h2>\n<p>Les travailleurs, qui arrivent en retard ou qui ne peuvent pas se rendre  au travail suite \u00e0 une coupure de courant  annonc\u00e9e dans les transports en commun, ne peuvent, en principe, pas r\u00e9clamer de salaire pour les heures de travail non prest\u00e9es. En effet, la cause du retard ou de l\u2019absence au travail n\u2019est pas inattendue et elle est connue avant le d\u00e9part du travailleur. Par cons\u00e9quent, celui-ci aurait d\u00fb prendre les mesures n\u00e9cessaires pour arriver \u00e0 temps au travail.<\/p>\n<p>Mais ici aussi, il faut agir en termes de \u2018bon sens\u2019 et de compr\u00e9hension. M\u00eame si le travailleur prend toutes les mesures n\u00e9cessaires (p.ex.: partir plus t\u00f4t), il n\u2019est  pas toujours certain qu\u2019il arrive \u00e0 l\u2019heure au travail. Il se peut \u00e9galement que le travailleur soit dans l\u2019impossibilit\u00e9 d\u2019utiliser sa propre voiture, de venir avec un coll\u00e8gue ou de faire le trajet \u00e0 pied.<\/p>\n<p>Afin d\u2019\u00e9viter des discussions ult\u00e9rieures, il vaut mieux que l\u2019employeur informe au pr\u00e9alable tous les travailleurs qu\u2019en principe, il n\u2019y aura pas de salaire pour les heures \u2018non-travaill\u00e9es\u2019, suite \u00e0 une coupure d\u2019\u00e9lectricit\u00e9 annonc\u00e9e dans les transports publics.
