Cette d\u00e9cision judiciaire est l\u2019occasion pour l\u2019Institut de rappeler que les discriminations fond\u00e9es sur la maternit\u00e9 sont encore trop pr\u00e9sentes dans le monde du travail. <!--more--><\/p>\n<p>Madame H. travaille comme responsable des ressources humaines lorsqu\u2019elle tombe enceinte. Comme toutes les femmes enceintes, Madame H. est prot\u00e9g\u00e9e contre le licenciement \u00e0 partir du moment o\u00f9 elle informe son employeur de sa grossesse et jusqu\u2019\u00e0 un mois apr\u00e8s la fin de son repos d\u2019accouchement. Or, Madame H. a \u00e9t\u00e9 licenci\u00e9e d\u00e8s le lendemain de la fin de la p\u00e9riode de protection contre le licenciement. L\u2019employeur invoque une \u00ab r\u00e9organisation \u00bb. Madame H. a d\u00e9cid\u00e9 de contester son licenciement. L\u2019Institut s\u2019est joint \u00e0 la proc\u00e9dure.<\/p>\n<p>Dans son jugement le Tribunal du travail de Bruxelles a estim\u00e9 que la protection contre le licenciement devait s\u2019appliquer car, bien que le licenciement ait \u00e9t\u00e9 notifi\u00e9 apr\u00e8s la p\u00e9riode de protection, il fallait prendre en consid\u00e9ration les actes pr\u00e9paratoires effectu\u00e9s pendant cette p\u00e9riode. Le tribunal a estim\u00e9 qu\u2019il n\u2019\u00e9tait raisonnablement pas concevable que l\u2019employeur ait organis\u00e9 le licenciement en \u00e0 peine un jour. L\u2019employeur a \u00e9t\u00e9 condamn\u00e9 au paiement de l\u2019indemnit\u00e9 de protection \u00e9quivalent \u00e0 6 mois de r\u00e9mun\u00e9ration brute pour la victime.<\/p>\n<p><strong><em>Sommet de l\u2019iceberg<\/em><\/strong><\/p>\n<p>En 2022, l\u2019Institut a obtenu gain de cause dans plusieurs affaires de discriminations fond\u00e9es sur la maternit\u00e9. Pour Michel Pasteel, directeur de l\u2019Institut pour l\u2019\u00e9galit\u00e9 des femmes et des hommes : \u00ab\u00a0<em>il est \u00e9vident que le regard de la soci\u00e9t\u00e9 sur la maternit\u00e9 ainsi que la jurisprudence sont en pleine \u00e9volution\u00a0\u00bb.<\/em><\/p>\n<p>La grossesse et la maternit\u00e9 restent n\u00e9anmoins des crit\u00e8res de discrimination ou de harc\u00e8lement au travail fr\u00e9quemment signal\u00e9s \u00e0 l\u2019Institut : pr\u00e8s d\u2019un signalement sur trois dans le domaine de l\u2019emploi (29%) concerne en effet la grossesse ou la maternit\u00e9. <em>\u00ab\u00a0Et ce chiffre ne constitue que la partie \u00e9merg\u00e9e de l\u2019iceberg\u00a0\u00bb<\/em>, ajoute Michel Pasteel. <em>\u00ab\u00a0La l\u00e9gislation qui prot\u00e8ge les travailleuses enceintes et celles de retour de leur cong\u00e9 de maternit\u00e9 contre le licenciement est bien connue, tant des travailleuses que des employeurs. Mais les travailleuses enceintes ou de retour de cong\u00e9 de maternit\u00e9 ne sont pas toujours conscientes de la port\u00e9e de cette protection. Comme dans ce cas-ci, lorsque l\u2019employeur tente de contourner la loi. Ou lorsqu\u2019il fait pression sur la travailleuse pour qu\u2019elle d\u00e9missionne ou encore qu\u2019il d\u00e9cide de ne pas prolonger son contrat une fois que la grossesse a \u00e9t\u00e9 annonc\u00e9e et alors que cela avait \u00e9t\u00e9 convenu.
