Elle a connu une nette acc\u00e9l\u00e9ration ces deux derni\u00e8res ann\u00e9es dans le contexte de la pand\u00e9mie de Covid-19. Cette transformation digitale n\u2019est pas sans cons\u00e9quences sur l\u2019acc\u00e8s aux services essentiels et sur les droits des personnes les plus fragiles, incapables de suivre le rythme impos\u00e9. Certaines situations peuvent \u00eatre discriminatoires. <!--more--><\/p>\n<p>Unia a analys\u00e9 les bouleversements en cours au regard de la l\u00e9gislation anti-discrimination et publi\u00e9 un avis sur ce ph\u00e9nom\u00e8ne en collaboration avec le Service de lutte contre la pauvret\u00e9, la pr\u00e9carit\u00e9 et l\u2019exclusion sociale. Le cadre l\u00e9gal doit \u00eatre am\u00e9lior\u00e9.<\/p>\n<p>Faire ses op\u00e9rations bancaires ou prendre rendez-vous chez le m\u00e9decin par internet, acheter un billet de train sur une borne digitale, demander un document \u00e0 la commune, reconna\u00eetre un enfant, poser sa candidature en ligne, payer dans un magasin avec son t\u00e9l\u00e9phone, une application bancaire ou m\u00eame avec une simple carte de banque&#8230; Pour beaucoup de personnes en situation de vuln\u00e9rabilit\u00e9, ces gestes de tous les jours qui peuvent paraitre anodins repr\u00e9sentent souvent un v\u00e9ritable parcours du combattant ou sont impossibles car elles ne disposent pas d\u2019un acc\u00e8s \u00e0 internet ou du mat\u00e9riel num\u00e9rique n\u00e9cessaire.<\/p>\n<p><strong><em>Les publics fragilis\u00e9s en plus grande difficult\u00e9<\/em><\/strong><\/p>\n<p>L\u2019analyse faite par Unia et le Service de lutte contre la pauvret\u00e9, la pr\u00e9carit\u00e9 et l\u2019exclusion sociale r\u00e9v\u00e8le que les premi\u00e8res victimes de ces bouleversements sont les personnes d\u00e9favoris\u00e9es sur le plan socio-\u00e9conomique (niveau de revenus) et culturel (niveau du dipl\u00f4me), notamment les personnes en difficult\u00e9 avec la lecture et l\u2019\u00e9criture, mais aussi les personnes \u00e2g\u00e9es ou en situation de handicap.<\/p>\n<p>Depuis 2019, Unia n\u2019a re\u00e7u qu\u2019une centaine de signalements en lien avec la \u00ab\u00a0fracture num\u00e9rique\u00a0\u00bb. Les victimes n\u2019identifient sans doute pas la situation comme discriminatoire car elles ne connaissent pas (ou peu) cette notion, ou ne savent peut-\u00eatre pas qu\u2019Unia peut les aider.<\/p>\n<p>Conscient de ces difficult\u00e9s et du faible taux de rapportage, Unia a formul\u00e9 plusieurs recommandations pour alerter sur la discrimination potentielle de certains groupes parmi les plus fragilis\u00e9s.<\/p>\n<p><em>\u201cA une \u00e9poque o\u00f9 acteurs publics et priv\u00e9s semblent avancer librement dans la conception de leurs outils et proc\u00e9dures num\u00e9riques, Unia plaide pour une am\u00e9lioration du cadre l\u00e9gal en proc\u00e9dant \u00e0 l\u2019uniformisation des l\u00e9gislations anti-discrimination belges. Nous demandons notamment l\u2019insertion du crit\u00e8re de la \u00ab\u00a0condition sociale\u00a0\u00bb dans ces l\u00e9gislations, afin de prot\u00e9ger des personnes particuli\u00e8rement vuln\u00e9rables.\u00a0\u00bb<\/em> explique Patrick Charlier, directeur d\u2019Unia. <em>\u201cLa digitalisation de notre soci\u00e9t\u00e9 est un processus irr\u00e9m\u00e9diable qui peut \u00eatre b\u00e9n\u00e9fique pour autant qu\u2019il soit clairement balis\u00e9 et que des correctifs soient pr\u00e9vus pour compenser ses \u00e9ventuels effets n\u00e9gatifs sur certains publics moins arm\u00e9s\u201d.<\/em><\/p>\n<p>Unia et le Service de lutte contre la pauvret\u00e9, la pr\u00e9carit\u00e9 et l\u2019exclusion sociale demandent notamment de garantir l\u00e9galement, sans surco\u00fbt, les diff\u00e9rentes modalit\u00e9s d\u2019acc\u00e8s aux services publics et priv\u00e9s et, de mani\u00e8re plus large, \u00e0 l\u2019ensemble des services d\u2019int\u00e9r\u00eat g\u00e9n\u00e9ral pour qu\u2019aucune d\u00e9marche ne soit exclusivement num\u00e9rique. Il est aussi important de faciliter la mise \u00e0 disposition d\u2019outils num\u00e9riques, l\u2019acc\u00e8s \u00e0 internet et le soutien \u00e0 l\u2019acquisition des comp\u00e9tences digitales pour les publics les plus pr\u00e9caires.
