









{"id":14255,"date":"2023-04-02T04:13:00","date_gmt":"2023-04-02T02:13:00","guid":{"rendered":"https:\/\/peoplesphere.be\/fr\/?p=14255"},"modified":"2023-04-03T04:13:39","modified_gmt":"2023-04-03T02:13:39","slug":"preavis-cas-de-demission-statut-unique-loi-limite-desormais-a-13-semaines-delai-maximal","status":"publish","type":"post","link":"https:\/\/peoplesphere.be\/fr\/preavis-cas-de-demission-statut-unique-loi-limite-desormais-a-13-semaines-delai-maximal\/","title":{"rendered":"Pr\u00e9avis en cas de d\u00e9mission et statut unique: la loi limite d\u00e9sormais \u00e0 13 semaines le d\u00e9lai maximal."},"content":{"rendered":"<p>Le projet de loi modifiant la loi du 26 d\u00e9cembre 2013 concernant l&rsquo;introduction d&rsquo;un statut unique entre ouvriers et employ\u00e9s en ce qui concerne les d\u00e9lais de pr\u00e9avis et le jour de carence ainsi que de mesures d&rsquo;accompagnement en ce qui concerne l&rsquo;adaptation des d\u00e9lais de pr\u00e9avis l\u00e9gaux maximums en cas de cong\u00e9 donn\u00e9 par le travailleur a \u00e9t\u00e9 adopt\u00e9 par la Chambre le 16 mars 2023.<!--more--><\/p>\n<p>Ce projet de loi (a) met fin aux discussions relatives au d\u00e9lai de pr\u00e9avis maximum \u00e0 respecter en cas de cong\u00e9s donn\u00e9s par les ouvriers d\u00e9j\u00e0 occup\u00e9s par leur employeur au 1er janvier 2014 et (b) tient compte des arr\u00eats de la Cour constitutionnelle consid\u00e9rant qu\u2019op\u00e9rer une distinction, en ce qui concerne le d\u00e9lai de pr\u00e9avis \u00e0 respecter, entre les employ\u00e9s d\u00e9j\u00e0 occup\u00e9s au 1er janvier 2014 sur la base de leur salaire viole le principe constitutionnel de l&rsquo;\u00e9galit\u00e9.<\/p>\n<p><strong><em>a) D\u00e9lai de pr\u00e9avis maximal de 13 semaines en cas de cong\u00e9 donn\u00e9 par l\u2019ouvrier<\/em><\/strong><\/p>\n<p>La loi sur le statut unique pr\u00e9voit que le d\u00e9lai de pr\u00e9avis pour les ouvriers d\u00e9j\u00e0 occup\u00e9s par leur employeur avant le 1er janvier 2014 est la somme, d&rsquo;une part, du d\u00e9lai de pr\u00e9avis bas\u00e9 sur leur anciennet\u00e9 jusqu&rsquo;au 31 d\u00e9cembre 2013 (partie 1) et, d&rsquo;autre part, des nouveaux d\u00e9lais de pr\u00e9avis \u00e0 partir du 1er janvier 2014 (partie 2).<\/p>\n<p>En cas de cong\u00e9 donn\u00e9 par le travailleur, la loi sur le statut unique pr\u00e9voit des d\u00e9lais de pr\u00e9avis fix\u00e9s sur la base de l&rsquo;anciennet\u00e9 du travailleur, avec un maximum de 13 semaines de pr\u00e9avis pour 8 ans d&rsquo;anciennet\u00e9. D\u00e8s lors, la somme des deux p\u00e9riodes de pr\u00e9avis (avant et apr\u00e8s le 1er janvier 2014) ne peut pas d\u00e9passer 13 semaines.<\/p>\n<p>Toutefois, dans la pratique, il semble y avoir beaucoup d\u2019incertitudes \u00e0 ce sujet, en particulier en ce qui concerne les ouvriers. Certains consid\u00e9raient, par exemple, que le maximum de 13 semaines pouvait encore \u00eatre d\u00e9pass\u00e9 dans certains cas. Cela n&rsquo;a jamais \u00e9t\u00e9 l&rsquo;intention du l\u00e9gislateur. La nouvelle r\u00e8gle pr\u00e9cise d\u00e8s lors que le d\u00e9lai de pr\u00e9avis en cas de cong\u00e9 notifi\u00e9 par un travailleur ne peut jamais d\u00e9passer 13 semaines.<\/p>\n<p><strong><em>b) Suppression de la distinction entre les employ\u00e9s sup\u00e9rieurs et inf\u00e9rieurs<\/em><\/strong><\/p>\n<p>Pour les employ\u00e9s, les d\u00e9lais de pr\u00e9avis avant le 1er janvier 2014 d\u00e9passaient souvent les 13 semaines. Une exception au d\u00e9lai de pr\u00e9avis maximal de 13 semaines avait donc \u00e9t\u00e9 pr\u00e9vue \u00e0 titre de mesure transitoire.<\/p>\n<p>Une distinction est op\u00e9r\u00e9e entre les employ\u00e9s sup\u00e9rieurs et les employ\u00e9s inf\u00e9rieurs dans le cadre de cette mesure transitoire. En effet, un d\u00e9lai maximal diff\u00e9rent s&rsquo;applique aux employ\u00e9s sup\u00e9rieurs : pour les employ\u00e9s dont le salaire annuel est sup\u00e9rieur \u00e0 32.254 euros au 31 d\u00e9cembre 2013, le d\u00e9lai de pr\u00e9avis maximal est de 4,5 mois, et pour les employ\u00e9s dont le salaire annuel est sup\u00e9rieur \u00e0 64.508 euros au 31 d\u00e9cembre 2013, le d\u00e9lai de pr\u00e9avis maximal est de 6 mois. La Cour constitutionnelle a toutefois jug\u00e9 qu&rsquo;une distinction op\u00e9r\u00e9e entre les employ\u00e9s sur la base de leur salaire violait le principe constitutionnel d&rsquo;\u00e9galit\u00e9.<\/p>\n<p>D\u00e8s lors, ce projet de loi vise \u00e0 mettre la l\u00e9gislation en conformit\u00e9 avec le principe constitutionnel d&rsquo;\u00e9galit\u00e9 en supprimant les dispositions transitoires pour les employ\u00e9s sup\u00e9rieurs.<\/p>\n<p><strong><em>c) Entr\u00e9e en vigueur<\/em><\/strong><\/p>\n<p>Les r\u00e8gles entrent en vigueur six mois apr\u00e8s leur publication au Moniteur belge, mais ne s&rsquo;appliquent qu&rsquo;aux cong\u00e9s notifi\u00e9s apr\u00e8s leur entr\u00e9e en vigueur. Un cong\u00e9 notifi\u00e9 avant cette date conserve donc tous ses effets.<\/p>\n<p>Pour un cong\u00e9 donn\u00e9 par l&#8217;employeur donc, rien ne change. Lorsqu&rsquo;un travailleur notifie un pr\u00e9avis, il est pr\u00e9f\u00e9rable de v\u00e9rifier si le bon d\u00e9lai de pr\u00e9avis a \u00e9t\u00e9 respect\u00e9.
