Le conseil des ministres a approuv\u00e9 un projet int\u00e9grant l&rsquo;organisation du service externe pour la pr\u00e9vention et la protection au travail dans la loi du 4 ao\u00fbt 1996 relative au bien-\u00eatre des travailleurs lors de l&rsquo;ex\u00e9cution de leur travail.<!--more--><\/h1>\n<p>L&rsquo;avant-projet stipule que les prestations fournies par les services externes pour la pr\u00e9vention et la protection au travail aux entreprises ainsi que leur co\u00fbt sont fix\u00e9s par arr\u00eat\u00e9 royal.<br \/>\nCela concerne toutes les entreprises affili\u00e9es \u00e0 un service externe pour la pr\u00e9vention et la protection au travail, qui ne disposent pas de leur propre d\u00e9partement m\u00e9dical. Les micro-entreprises de maximum cinq travailleurs en font \u00e9galement partie.<\/p>\n<p>Les services externes pour la pr\u00e9vention et la protection au travail accomplissent des prestations dans le cadre du bien-\u00eatre au travail pour les employeurs et les travailleurs, en vue du maintien de la s\u00e9curit\u00e9 et de la sant\u00e9 des travailleurs lors l\u2019ex\u00e9cution de leur travail tout au long de leur carri\u00e8re, et en vue de pr\u00e9venir les accidents du travail et les maladies professionnelles, et de limiter leur effet n\u00e9gatif.<\/p>\n<p>Cet avant-projet pourrait \u00eatre mis en rapport avec la conclusion de l\u2019avis n\u00b0\u00a0184\u00a0bis du Conseil sup\u00e9rieur pour la Pr\u00e9vention et la Protection au Travail, intervenue r\u00e9cemment.<\/p>\n<p>Comme l&rsquo;indiquait la CSC particuli\u00e8rement attentive \u00e0 ce dossier englu\u00e9 depuis plus de 2 ans,<i> \u00ab\u00a0d\u00e9sormais, une entreprise paiera pour tous ses travailleurs, ouvriers comme employ\u00e9s, un montant identique pour la m\u00e9decine du travail et la pr\u00e9vention. Cinq groupes tarifaires diff\u00e9rents vont \u00eatre mis en place, en fonction du secteur. La suppression du lien entre le financement et le fait d\u2019\u00eatre ou non assujetti \u00e0 l\u2019examen m\u00e9dical permettra beaucoup plus de m\u00e9decine du travail sur mesure. Cela favorisera la transparence et canalisera les possibilit\u00e9s de n\u00e9gociation et de marchandage. Cette nouvelle r\u00e9glementation va \u00e9galement favoriser la solidarit\u00e9 financi\u00e8re entre les secteurs qui compte beaucoup d\u2019ouvriers et les secteurs avec beaucoup d\u2019employ\u00e9s. En outre, cette op\u00e9ration sera budg\u00e9tairement neutre pour les services de pr\u00e9vention.\u00a0\u00bb<\/i><\/p>\n<p>Le syndicat chr\u00e9tien, se r\u00e9jouissant des progr\u00e8s qui seront r\u00e9alis\u00e9s en mati\u00e8re d&rsquo;\u00e9quit\u00e9 gr\u00e2ce \u00e0 la mise en oeuvre de ces conclusions, pr\u00e9cisait encore : <i>\u00ab\u00a0L\u2019instauration d\u2019un tarif unique au sein d\u2019un secteur pour tous les travailleurs, que ceux-ci doivent ou non subir un examen m\u00e9dical obligatoire, va permettre aux employeurs et aux travailleurs de d\u00e9velopper une politique du bien-\u00eatre sur mesure dans le cadre du Comit\u00e9 pour la Pr\u00e9vention et la Protection au Travail (CPPT) de leur entreprise. Dans l\u2019ancien syst\u00e8me, le syst\u00e8me tarifaire \u00e9tait uniquement bas\u00e9 sur des examens m\u00e9dicaux obligatoires. Cette dissociation va favoriser le recours \u00e0 d\u2019autres experts en pr\u00e9vention, en plus des m\u00e9decins du travail, comme des psychologues, des ergonomes, des ing\u00e9nieurs en s\u00e9curit\u00e9. Parfois, l\u2019assistance d\u2019un ing\u00e9nieur, d\u2019un ergonome ou d\u2019un psychologue est nettement plus utile que l\u2019examen m\u00e9dical annuel. Un syst\u00e8me tarifaire bas\u00e9 uniquement sur des examens m\u00e9dicaux obligatoires n\u00e9glige trop souvent la pr\u00e9vention du stress, du burnout ou du harc\u00e8lement. Cette r\u00e9forme constitue une \u00e9tape importante dans le sens d\u2019une approche multidisciplinaire et individualis\u00e9e de la pr\u00e9vention sur le lieu de travail.<br \/>\nAutre \u00e9l\u00e9ment important: cet accord garantit que l\u2019op\u00e9ration sera budg\u00e9tairement neutre pour l\u2019ensemble des services externes de pr\u00e9vention\u00a0: il n\u2019est plus question d\u2019une perte de 24 millions sur le produit des tarifs minimums, de dispositions contraignantes sur un blocage des prix\u00a0; une indexation est m\u00eame pr\u00e9vue. Une nouvelle concertation se d\u00e9roulera dans le secteur \u00e0 partir de septembre sur la mani\u00e8re d\u2019organiser le suivi de la mise en \u0153uvre de l\u2019accord et de ses effets en pratique, sur les t\u00e2ches des m\u00e9decins du travail, ainsi que sur une convention relative aux prix maximums.\u00a0\u00bb<\/i><\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Et un nouvel avant-projet de loi, un !
