Elle instaure une meilleure protection des t\u00e9moins et des victimes de discrimination contre les repr\u00e9sailles*. Cette loi fait suite \u00e0 l\u2019arr\u00eat Hakelbracht, rendu par la Cour de justice de l\u2019Union europ\u00e9enne en 2019. L\u2019Institut pour l\u2019\u00e9galit\u00e9 des femmes et des hommes s\u2019\u00e9tait constitu\u00e9 partie civile dans ce dossier.<!--more--><\/p>\n<p>Rappel des faits : en 2015, Mme H. avait postul\u00e9 dans un magasin. La g\u00e9rante, Mme V., lui a fait passer un entretien, au cours duquel la candidate a indiqu\u00e9 \u00eatre enceinte. La g\u00e9rante a inform\u00e9 sa direction du fait que Mme H. \u00e9tait la candidate ad\u00e9quate pour le poste. La direction a r\u00e9torqu\u00e9 ne pas vouloir engager la candidate en raison de sa grossesse, ce dont la g\u00e9rante a fait part \u00e0 la candidate. Celle-ci a donc introduit un signalement \u00e0 l\u2019Institut. Quelques mois plus tard, l\u2019employeur a licenci\u00e9 la g\u00e9rante pour avoir soutenu la candidate. Elle a, \u00e0 son tour, introduit un signalement \u00e0 l\u2019Institut.<\/p>\n<p>Cependant, Mme V. n\u2019\u00e9tait pas prot\u00e9g\u00e9e contre les repr\u00e9sailles dont elle a fait l\u2019objet. En effet, la loi belge offrait une protection seulement aux travailleurs intervenus comme t\u00e9moins en justice ou dans le cadre de l\u2019instruction de la plainte de la victime, et pour autant que le t\u00e9moignage r\u00e9ponde \u00e0 des exigences formelles pr\u00e9vues par la r\u00e9glementation.<\/p>\n<p>L\u2019affaire a abouti devant la Cour de justice de l\u2019Union europ\u00e9enne. Dans son jugement, la Cour a consid\u00e9r\u00e9 que la protection des t\u00e9moins doit s\u2019appliquer au sens large et ne peut pas \u00eatre limit\u00e9e par des crit\u00e8res formels. L\u2019objectif est de permettre aux personnes discrimin\u00e9es et aux t\u00e9moins des faits d\u2019entamer des d\u00e9marches pour que les cas de discrimination soient d\u00e9tect\u00e9s et r\u00e9solus. Pour Michel Pasteel, directeur de l\u2019Institut pour l\u2019\u00e9galit\u00e9 des femmes et des hommes, \u00ab les conditions strictes fix\u00e9es par la loi belge portaient atteinte \u00e0 l\u2019effectivit\u00e9 de la protection. Les travailleur-euse-s risquaient d\u2019\u00eatre d\u00e9courag\u00e9-e-s de soutenir la personne discrimin\u00e9e par crainte de repr\u00e9sailles.<\/p>\n<p>Suite \u00e0 l\u2019arr\u00eat de la Cour de justice de l\u2019Union europ\u00e9enne, la loi Repr\u00e9sailles a \u00e9t\u00e9 \u00e9labor\u00e9e afin de r\u00e9viser les lois anti-discrimination et assurer une plus grande protection des t\u00e9moins et des victimes de discrimination.<\/p>\n<p>Michel Pasteel souligne l\u2019importance de cette affaire : \u00ab\u00a0<em>celle-ci d\u00e9montre la n\u00e9cessit\u00e9 de continuer \u00e0 signaler les discriminations de genre. Le signalement de Mme H. et Mme V. et l\u2019action en justice soutenue par l\u2019Institut se sont traduits par un changement effectif de la l\u00e9gislation belge.
