S\u2019agissant d\u2019un pr\u00e9c\u00e9dent important, l\u2019ex-travailleuse et l\u2019Institut pour l\u2019\u00e9galit\u00e9 des femmes et des hommes avaient saisi ensemble le tribunal du travail. L\u2019Institut, qui a re\u00e7u 1 euro de dommages et int\u00e9r\u00eats symboliques, est satisfait du jugement. L\u2019employeur a d\u00e9cid\u00e9 de ne pas faire appel.<!--more--><\/p>\n<p>Michel Pasteel, directeur de l\u2019Institut pour l\u2019\u00e9galit\u00e9 des femmes et des hommes, explique la d\u00e9cision du tribunal. \u00ab\u00a0<em>Il s\u2019agit d\u2019un pr\u00e9c\u00e9dent tr\u00e8s important parce que c\u2019est le premier jugement qui confirme explicitement qu\u2019un licenciement pour cause d\u2019avortement constitue une discrimination fond\u00e9e sur le sexe. Le juge envoie un message clair : les femmes ne peuvent pas \u00eatre licenci\u00e9es parce qu\u2019elles risquent de tomber enceintes sans le vouloir et de d\u00e9cider d\u2019interrompre leur grossesse.\u00a0\u00bb<\/em><\/p>\n<p>En 2021, une femme a contact\u00e9 l\u2019Institut \u00e0 la suite d\u2019un licenciement abusif. Elle avait \u00e9t\u00e9 remerci\u00e9e apr\u00e8s avoir inform\u00e9 son employeur de sa grossesse et de son intention d\u2019y mettre fin.<\/p>\n<p>Le contrat de travail de la travailleuse avait en effet \u00e9t\u00e9 r\u00e9sili\u00e9 unilat\u00e9ralement le deuxi\u00e8me jour ouvrable apr\u00e8s l\u2019avortement pour \u00ab\u00a0performances en baisse et rupture de confiance\u00a0\u00bb. L\u2019employeur avait fait r\u00e9f\u00e9rence \u00e0 un pr\u00e9tendu entretien de fonctionnement ayant eu lieu quelques jours avant l\u2019avortement et au fait qu\u2019il n\u2019y avait pas eu d\u2019am\u00e9lioration de ses performances depuis lors. Au cours de la proc\u00e9dure judiciaire, il a \u00e9galement cit\u00e9 de fa\u00e7on soudaine des t\u00e9moignages \u00e9manant de plusieurs sup\u00e9rieur-e-s pour d\u00e9montrer que la travailleuse n\u2019\u00e9tait pas performante.<\/p>\n<p>Tant le moment auquel le licenciement a eu lieu que l\u2019absence d\u2019autre \u00e9valuation s\u00e9rieuse de la travailleuse pointent un lien entre le licenciement et l\u2019interruption de grossesse. L\u2019ancien employeur n\u2019a fourni aucune preuve objective pour appuyer les motifs de licenciement invoqu\u00e9s et le tribunal a jug\u00e9 les t\u00e9moignages trop vagues et m\u00eame peu fiables. Le tribunal du travail a statu\u00e9 en f\u00e9vrier 2023 que ce licenciement \u00e9tait motiv\u00e9 par l\u2019avortement et constitue donc une discrimination fond\u00e9e sur le sexe.<\/p>\n<p>Les discriminations li\u00e9es \u00e0 la grossesse et \u00e0 la maternit\u00e9 restent un probl\u00e8me soci\u00e9tal majeur en Belgique. Trois femmes actives sur quatre subissent au moins une forme de discrimination, de traitement d\u00e9favorable, d\u2019in\u00e9galit\u00e9 de traitement ou des tensions au travail en raison de leur grossesse ou de leur maternit\u00e9. Ce type de plainte constitue \u00e9galement la majorit\u00e9 des signalements relatifs au domaine du travail introduits par des femmes \u00e0 l\u2019Institut.
