Plus concr\u00e8tement, le tribunal du travail de Bruxelles a condamn\u00e9 l\u2019employeur parce que l\u2019entreprise ne disposait pas d\u2019une politique de pr\u00e9vention efficace, que les victimes n\u2019\u00e9taient pas correctement prot\u00e9g\u00e9es et qu\u2019il n\u2019existait pas non plus de politique approri\u00e9e en mati\u00e8re de suivi des plaintes.<!--more--><\/p>\n<p>Pour la premi\u00e8re fois, un tribunal belge reconna\u00eet que l\u2019absence de politique en mati\u00e8re de comportements sexuels transgressifs constitue une discrimination indirecte \u00e0 l\u2019encontre des travailleuses. En effet, ce sont principalement les femmes qui sont victimes de harc\u00e8lement sexuel au travail, avec pour cons\u00e9quence un environnement de travail non s\u00fbr et repr\u00e9sentant des risques pour leur bien-\u00eatre. Cette condamnation constitue un signal clair de la n\u00e9cessit\u00e9 d\u2019une meilleure protection pour toutes les victimes de harc\u00e8lement (sexuel) au travail.<\/p>\n<p>A l\u2019heure actuelle, il existe des mesures pour prot\u00e9ger les travailleurs et les travailleuses. Par exemple, les employeurs sont l\u00e9galement tenus de proc\u00e9der \u00e0 une analyse des risques psychosociaux et de communiquer les coordonn\u00e9es d\u2019un\u00b7e conseiller\u00b7\u00e8re en pr\u00e9vention externe. Dans le cadre de l\u2019analyse des risques, les facteurs de risque doivent \u00eatre abord\u00e9s tant du point de vue des des femmes que des hommes.<\/p>\n<p><em>\u00ab\u00a0Ce jugement est historique et constitue donc un pr\u00e9c\u00e9dent important. Les entreprises qui n\u2019ont pas de politique en mati\u00e8re de comportements sexuels transgressifs, qui ne communiquent pas de mani\u00e8re transparente \u00e0 ce propos ou qui ne la mettent pas en \u0153uvre correctement enfreignent le droit relatif \u00e0 la discrimination. L\u2019employeur ne cr\u00e9e alors pas un contexte dans lequel les femmes peuvent compter sur un environnement de travail s\u00fbr, ce qui les emp\u00eache d\u2019acc\u00e9der au travail de la m\u00eame mani\u00e8re que les hommes, ce qui est consid\u00e9r\u00e9 comme une discrimination de genre du point de vue juridique.\u00a0\u00bb<\/em> d\u00e9clare Michel Pasteel, directeur de l&rsquo;Institut.<\/p>\n<p>Cette affaire fait suite au signalement introduit par une stagiaire de l\u2019entreprise. Celle-ci avait \u00e9t\u00e9 victime de harc\u00e8lement sexuel de la part de l\u2019un des managers. Apr\u00e8s l\u2019avoir signal\u00e9 aupr\u00e8s de l\u2019entreprise, elle a elle-m\u00eame \u00e9t\u00e9 accus\u00e9e de diffamation et d\u2019atteinte \u00e0 l\u2019honneur pour avoir soi-disant menti. Une enqu\u00eate men\u00e9e par un service de pr\u00e9vention externe avait r\u00e9v\u00e9l\u00e9 que l\u2019entreprise ne disposait pas de politique de pr\u00e9vention en mati\u00e8re de harc\u00e8lement sexuel au travail. Il s\u2019est \u00e9galement av\u00e9r\u00e9 que la stagiaire n\u2019\u00e9tait pas la premi\u00e8re victime de ce manager, ce qui montre que l\u2019entreprise n\u2019avait pas donn\u00e9 suite aux plaintes internes ant\u00e9rieures. L\u2019Institut a poursuivi l\u2019employeur en justice pour discrimination indirecte \u00e0 l\u2019encontre des travailleuses.
