Les partenaires sociaux s\u2019engagent \u00e9galement \u00e0 poursuivre ces travaux en vue de renforcer l\u2019efficacit\u00e9 des r\u00e8gles applicables en cas de restructuration et \u00e0 consolider le dialogue en cas de transfert conventionnel d\u2019entreprise.<!--more--><\/p>\n<p>Dans le contexte particulier de cette ann\u00e9e 2023, les membres du CNT sont parvenus ce 19 d\u00e9cembre 2023 (avis n\u00b02.395) \u00e0 d\u00e9finir trois actions en vue d\u2019offrir un cadre plus serein aux employeurs et aux travailleurs qui font face \u00e0 une restructuration.<\/p>\n<p>En premier lieu, ils entendent promouvoir davantage leur recommandation 28 dans le double but d\u2019am\u00e9liorer sa notori\u00e9t\u00e9 et de disposer de donn\u00e9es statistiques relatives \u00e0 sa mise en \u0153uvre. Pour ce faire, ils sollicitent son r\u00e9f\u00e9rencement sur le site internet <a href=\"http:\/\/www.restructurations.be\">www.restructurations.be<\/a> et demandent d\u2019ins\u00e9rer, dans les formulaires-types \u00ab\u00a0Annonce du licenciement collectif\u00a0\u00bb et \u00ab\u00a0Notification du licenciement collectif\u00a0\u00bb du SPF Emploi, deux questions li\u00e9es \u00e0 la connaissance et \u00e0 l\u2019application de la recommandation 28.<\/p>\n<p>Ils confirment par ailleurs que la p\u00e9riode de r\u00e9f\u00e9rence, telle que fix\u00e9e dans la loi Renault, se d\u00e9finit comme toute p\u00e9riode de 60 jours successifs dans laquelle se produisent des licenciements pour un ou plusieurs motifs non inh\u00e9rents \u00e0 la personne des travailleurs, et ce, conform\u00e9ment \u00e0 l\u2019interpr\u00e9tation de la CJUE (arr\u00eat C-300\/19 du 11 novembre 2020).<\/p>\n<p>Les partenaires sociaux s\u2019engagent enfin \u00e0 proposer un ou plusieurs m\u00e9canismes efficaces et dissuasifs d\u00e9courageant l\u2019\u00e9lusion de cette p\u00e9riode de r\u00e9f\u00e9rence et demandent de porter \u00e0 un niveau 3 les sanctions applicables en cas de non-respect de la proc\u00e9dure du licenciement collectif (articles 193 et 197 du Code p\u00e9nal social).<\/p>\n<p>S\u2019agissant des transferts conventionnels d\u2019entreprise, ils conviennent que, \u00e0 la condition que les travailleurs ou leurs repr\u00e9sentants en fassent la demande, le c\u00e9dant communiquera au cessionnaire identifi\u00e9 le contenu de l\u2019information\/consultation relative \u00e0 la cession et il l\u2019invitera \u00e0 se pr\u00e9senter aupr\u00e8s des travailleurs ou de leurs repr\u00e9sentants au cours de cette information\/consultation.<\/p>\n<p>Ces nouvelles initiatives feront l\u2019objet d\u2019une \u00e9valuation au terme d\u2019une p\u00e9riode de 3 ans, \u00e0 l\u2019instar de la suite donn\u00e9e aux travaux qui ont fait l\u2019objet des avis 2.149 et 2.184 du CNT.<\/p>\n<p>La FEB veut souligner \u00e0 cette occasion que les partenaires sociaux du CNT d\u00e9montrent \u00e0 nouveau leur capacit\u00e9 \u00e0 d\u00e9gager les points d\u2019int\u00e9r\u00eat commun et conclure des accords en mati\u00e8re de licenciement collectif et de transfert conventionnel d\u2019entreprises, malgr\u00e9 un climat social tendu et des \u00e9lections politiques et sociales imminentes (printemps 2024).<\/p>\n<p>&nbsp;<\/p>\n<p><em>Source : CNT &#8211; FEB, Centre de comp\u00e9tence Emploi &amp; S\u00e9curit\u00e9 Sociale<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Le Conseil National du Travail vient de formuler un certain nombre de nouvelles propositions concernant le licenciement collectif et le transfert conventionnel d\u2019entreprises.
