









{"id":16105,"date":"2024-05-06T07:47:26","date_gmt":"2024-05-06T05:47:26","guid":{"rendered":"https:\/\/peoplesphere.be\/fr\/?p=16105"},"modified":"2024-05-06T07:47:26","modified_gmt":"2024-05-06T05:47:26","slug":"reconnaissance-en-tant-quentreprise-en-difficulte-vers-un-allegement-des-conditions-relatives-aux-emplois-de-fin-de-carriere","status":"publish","type":"post","link":"https:\/\/peoplesphere.be\/fr\/reconnaissance-en-tant-quentreprise-en-difficulte-vers-un-allegement-des-conditions-relatives-aux-emplois-de-fin-de-carriere\/","title":{"rendered":"Reconnaissance en tant qu&rsquo;entreprise en difficult\u00e9: vers un all\u00e8gement des conditions relatives aux emplois de fin de carri\u00e8re."},"content":{"rendered":"<p>Sur proposition du ministre du Travail Pierre-Yves Dermagne, le Conseil des ministres a approuv\u00e9 un projet d&rsquo;arr\u00eat\u00e9 royal adaptant, \u00e0 la demande des partenaires sociaux, les conditions de reconnaissance pour la demande de reconnaissance en tant qu&rsquo;entreprise en difficult\u00e9 ou en restructuration en vue de l&rsquo;introduction des emplois de fin de carri\u00e8re.<!--more--><\/p>\n<p>L\u2019avis du CNT du 30 mai 2023 concerne l\u2019article 6 de l\u2019arr\u00eat\u00e9 royal du 12 d\u00e9cembre 2001 pris en ex\u00e9cution du chapitre IV de la loi du 10 ao\u00fbt 2001 relative \u00e0 la conciliation entre l&#8217;emploi et la qualit\u00e9 de vie concernant le syst\u00e8me du cr\u00e9dit-temps, la diminution de carri\u00e8re et la r\u00e9duction des prestations de travail \u00e0 mi-temps.<\/p>\n<p>Il y est pr\u00e9cis\u00e9 que l&rsquo;\u00e2ge est port\u00e9 \u00e0 55 ans pour les travailleurs qui r\u00e9duisent leurs prestations de travail \u00e0 mi-temps ou d&rsquo;un cinqui\u00e8me en application de la CCT n\u00b0 103, si la date de prise de cours de la r\u00e9duction des prestations de travail est situ\u00e9e pendant une p\u00e9riode de reconnaissance de l&rsquo;entreprise, par le ministre comp\u00e9tent pour l&rsquo;Emploi, comme entreprise en restructuration ou entreprise en difficult\u00e9s en application de la r\u00e9glementation relative au ch\u00f4mage avec compl\u00e9ment d&rsquo;entreprise, pour autant qu&rsquo;il soit satisfait, de mani\u00e8re cumulative, aux conditions suivantes :<\/p>\n<ul>\n<li>l&rsquo;entreprise d\u00e9montre que sa demande de reconnaissance se situe dans le cadre d&rsquo;un plan de restructuration et permet d&rsquo;\u00e9viter des licenciements<\/li>\n<li>l&rsquo;entreprise d\u00e9montre que sa demande de reconnaissance permet de r\u00e9duire le nombre de travailleurs qui passent sous le r\u00e9gime du ch\u00f4mage avec compl\u00e9ment d&rsquo;entreprise<\/li>\n<li>le ministre a explicitement pr\u00e9cis\u00e9, dans la d\u00e9cision de reconnaissance, que ces conditions sont remplies<\/li>\n<\/ul>\n<p>En ce qui concerne la deuxi\u00e8me condition, il existe un d\u00e9calage entre la condition d\u2019\u00e2ge qui s\u2019applique, d\u2019une part, aux emplois de fin de carri\u00e8re (55 ans) et, d\u2019autre part, au r\u00e9gime de ch\u00f4mage avec compl\u00e9ment d\u2019entreprise (60 ans), ce qui aboutit dans la pratique \u00e0 des probl\u00e8mes dans le cadre des demandes de reconnaissance comme entreprise en difficult\u00e9s ou en restructuration. En effet, les entreprises ne peuvent souvent pas (plus) d\u00e9montrer que l\u2019introduction des emplois de fin de carri\u00e8re a permis de r\u00e9duire le nombre de personnes passant sous le r\u00e9gime du ch\u00f4mage avec compl\u00e9ment d\u2019entreprise.<\/p>\n<p>Le CNT a donc demand\u00e9 aux partenaires sociaux de la Commission consultative RCC d\u2019\u00e9tudier la possibilit\u00e9 de supprimer cette condition.
