Et si cela doit prendre 541 jours \u00e0 nouveau, ce n\u2019est pas un souci\u2026 Pendant ce temps, le march\u00e9 du travail peut poursuivre son chemin sans nouveau texte de loi. Et les entreprises, via leurs dirigeants et leurs d\u00e9partements RH, peuvent se concentrer sur des priorit\u00e9s autres que d\u2019essayer de comprendre et d\u2019int\u00e9grer de nouvelles r\u00e9glementations qui alourdissent notre quotidien.<!--more--><\/p>\n<p>Ce n\u2019est pas notre r\u00f4le de commenter l\u2019actualit\u00e9 politique ni l\u2019urgence \u00e9ventuelle de voir un gouvernement lancer de nouvelles r\u00e9formes. Toutefois, la vraie question \u00e0 se poser est peut-\u00eatre la suivante: y-a-t-il aujourd\u2019hui un sujet relatif au march\u00e9 du travail qui exige une refonte imm\u00e9diate de notre cadre r\u00e9glementaire? Revoir la loi de 1996 sur la mod\u00e9ration salariale comme les syndicats l\u2019implorent ? Repenser \u00e0 nouveau notre syst\u00e8me de pensions afin d\u2019assurer sa durabilit\u00e9 ? Eliminer des calendriers scolaires asym\u00e9triques \u00e0 l\u2019\u00e9chelle de notre micro-territoire et qui nuisent \u00e0 la productivit\u00e9 des travailleurs ? Nous restons persuad\u00e9s que le temps de la concertation sur ces sujets (comme sur d\u2019autres) sera en d\u00e9calage avec la r\u00e9alit\u00e9 du travail. La preuve par trois exemples r\u00e9cents.<\/p>\n<h3><strong><em>Exemple#1 &#8211; La semaine de 4 jours, une garantie d\u2019\u00e9puisement \u00e0 court, moyen et long terme.<\/em><\/strong><\/h3>\n<p>Une des mesures les plus r\u00e9centes et parmi les plus contestables en mati\u00e8re de r\u00e9glementation du travail. Vouloir organiser des horaires \u00e0 temps plein sur un rythme de 4 jours par semaine, ce n\u2019est pas raisonnable. L\u2019issue quasi certaine de cette approche ? Des \u00e9quipes de plus en plus difficiles \u00e0 planifier et des collaborateurs ext\u00e9nu\u00e9s qui profiteront de leur vendredi (ou quelque autre jour de la semaine) allong\u00e9s sur leurs sofas pour r\u00e9cup\u00e9rer d\u2019un volume de boulot condens\u00e9 sur une semaine raccourcie. Dans la pratique, cette mesure n\u2019am\u00e8ne pas d\u2019outil suppl\u00e9mentaire en mati\u00e8re de gestion. Elle veut r\u00e9guler \u00e0 posteriori une flexibilit\u00e9 qui existe d\u00e9j\u00e0 dans la pratique notamment pour les travailleurs qui ont acc\u00e8s au t\u00e9l\u00e9travail.<\/p>\n<h3><strong><em>Exemple#2 \u2013 Le droit \u00e0 la d\u00e9connexion, la mauvaise r\u00e9ponse \u00e0 une bonne question<\/em><\/strong><\/h3>\n<p>A-t-on jamais vu un collaborateur licenci\u00e9 pour ne pas avoir r\u00e9pondu \u00e0 une sollicitation en dehors de son temps de travail ? Evidemment non. Pourtant, sous la pression du gouvernement pr\u00e9c\u00e9dent, les partenaires sociaux ont jug\u00e9 utile d\u2019inscrire le droit \u00e0 la d\u00e9connexion dans la r\u00e9glementation. Nous devrions nous interroger lorsque la loi semble nous contraindre \u00e0 entrer en absurdie. Installer le droit \u00e0 la d\u00e9connexion dans nos r\u00e8glements de travail et dans la concertation sociale, cela consiste \u00e0 infantiliser les travailleurs et nier de facto tous les efforts (et tous les progr\u00e8s) r\u00e9alis\u00e9s en mati\u00e8re de bien-\u00eatre dans nos entreprises. Nous savons que la question n\u2019appartient pas \u00e0 la sph\u00e8re juridique. C\u2019est de bon sens manag\u00e9rial dont il s\u2019agit. Rien d\u2019autre.<\/p>\n<h3><strong><em>Exemple#3 \u2013 Le Federal Learning Account: impracticable et inutile.<\/em><\/strong><\/h3>\n<p>Au d\u00e9but du mois de mai dernier, l\u2019introduction d\u2019un compte formation individuel assorti d\u2019une obligation de formation se heurtait \u00e0 l\u2019incompr\u00e9hension des partenaires sociaux. Plusieurs f\u00e9d\u00e9rations professionnelles ont depuis lors invit\u00e9 leurs membre \u00e0 boycotter un dispositif que personne ne pourra ni mesurer ni contr\u00f4ler d\u2019ailleurs. A quoi bon ?<br \/>\nLe training on the job est-il comptabilis\u00e9 ? L\u2019am\u00e9nagement du temps de travail et la participation de l\u2019employeur \u00e0 la formation continue sont-ils pris en consid\u00e9ration ? Le coaching en d\u00e9veloppement personnel intervient-il dans le dispositif ? Nous pouvons poursuivre l\u2019\u00e9num\u00e9ration et montrer \u00e0 quel point nos politiques de formation sont plus abouties que les id\u00e9es tardives du l\u00e9gislateur.<\/p>\n<p>Le droit social, dans son ensemble, court derri\u00e8re la cr\u00e9ativit\u00e9 des employeurs et de leurs collaborateurs. Ce que la r\u00e9glementation et les esprits brillants qui la con\u00e7oivent tendent \u00e0 oublier, c\u2019est justement que les dirigeants, managers et travailleurs sont engag\u00e9s ensemble dans la d\u00e9marche qui consiste \u00e0 organiser le travail. C\u2019est un projet commun, une histoire partag\u00e9e, une soci\u00e9t\u00e9 dynamique qui bouge et se r\u00e9invente d\u00e9finitivement beaucoup plus vite que la r\u00e9glementation.
