Cette mesure conduit \u00e0 une augmentation de l\u2019absent\u00e9isme et n\u2019apporte pas de solution \u00e0 la surcharge des m\u00e9decins. La FEB plaide pour le maintien de l\u2019obligation de remise d\u2019un certificat m\u00e9dical d\u00e8s le premier jour d\u2019incapacit\u00e9 tant que des r\u00e9formes structurelles ne sont pas mises en place pour r\u00e9soudre la question de la charge des m\u00e9decins et pour stopper la croissance de l\u2019absent\u00e9isme.<!--more--><\/p>\n<p>Depuis la fin de l\u2019ann\u00e9e 2022, un travailleur ne doit plus fournir de certificat m\u00e9dical si son incapacit\u00e9 ne d\u00e9passe pas un jour (ou ne doit plus fournir de certificat pour le premier jour d\u2019une p\u00e9riode de maladie plus longue). Cette possibilit\u00e9 est limit\u00e9e \u00e0 un maximum de trois jours par an.<\/p>\n<p>Dans les entreprises de moins de 50 travailleurs, un employeur conserve le droit de demander un certificat pour ces \u00ab courtes \u00bb p\u00e9riodes de maladie. La loi sur les contrats de travail instaure un \u00e9quilibre (pr\u00e9caire pour l\u2019employeur) entre les droits et obligations des uns et des autres : le travailleur doit avertir imm\u00e9diatement de son incapacit\u00e9, il doit remettre un certificat et, le cas \u00e9ch\u00e9ant, se soumettre au contr\u00f4le m\u00e9dical. A ces conditions, il b\u00e9n\u00e9ficie du droit au salaire garanti. La modification pr\u00e9cit\u00e9e a \u00e9t\u00e9 port\u00e9e, pendant la p\u00e9riode du COVID, par le ministre Vandenbroucke, qui souhaitait ainsi diminuer la charge administrative des m\u00e9decins. Elle rompt malheureusement l\u2019\u00e9quilibre de la loi.<\/p>\n<h3><strong><em>Augmentation de l\u2019absent\u00e9isme<\/em><\/strong><\/h3>\n<p>L\u2019objectif de simplification administrative pour les m\u00e9decins est louable et la FEB d\u00e9fend ce principe, dans tous les domaines de la vie des entrepreneurs. Toutefois, sur le plan des relations de travail, la suppression de ce certificat pour les courtes maladies a bien entra\u00een\u00e9 une augmentation de l\u2019absent\u00e9isme. Plusieurs \u00e9tudes r\u00e9centes1 le confirment et la corr\u00e9lation est d\u00e9sormais chiffr\u00e9e pour l\u2019ensemble des travailleurs du secteur public f\u00e9d\u00e9ral2. Cette suppression emp\u00eache \u00e9galement les entreprises d\u2019actionner le contr\u00f4le m\u00e9dical d\u00e8s le premier jour d\u2019incapacit\u00e9 (<em>\u00ab\u00a0pourquoi dois-je aller chez le m\u00e9decin contr\u00f4leur si je ne dois plus rendre de certificat m\u00e9dical pour ce jour?\u00a0\u00bb).<\/em><\/p>\n<p>En outre, l\u2019objectif d\u2019all\u00e8gement de la charge administrative pour les m\u00e9decins n\u2019est pas atteint par cette \u00ab\u00a0mesurette\u00a0\u00bb. Parce que leur surcharge est la cons\u00e9quence d\u2019une combinaison de facteurs : nombre insuffisant de m\u00e9decins (num\u00e9rus clausus), absence de m\u00e9decins dans certaines zones (notamment rurales), nouvelles pratiques m\u00e9dicales qui supposent des formations plus fr\u00e9quentes qu\u2019auparavant, services de garde pas encore organis\u00e9s de fa\u00e7on optimale, h\u00e9sitation \u00e0 recourir \u00e0 un secr\u00e9tariat qui \u00a0\u00ab\u00a0filtre\u00a0\u00bb les appels, hypersollicitation par les patients et part croissante d\u2019une \u00ab\u00a0paperasserie administrative\u00a0\u00bb li\u00e9e ici \u00e0 une assurance, l\u00e0 \u00e0 une \u00e9cole ou encore \u00e0 une pratique sportive.<\/p>\n<h3><strong><em>Pas de suppression du certificat m\u00e9dical en l\u2019\u00e9tat des choses<\/em><\/strong><\/h3>\n<p>La FEB soutient donc deux axes essentiels de r\u00e9forme : il faut prendre des mesures structurelles afin d\u2019all\u00e9ger la charge administrative des m\u00e9decins, comme pour tous les entrepreneurs, et il faut r\u00e9fl\u00e9chir \u00e0 une approche globale et syst\u00e9mique de la \u00ab maladie \u00bb dans la relation de travail afin de r\u00e9soudre le nombre croissant d\u2019incapacit\u00e9s, qu\u2019elles soient de longue, moyenne ou de courte dur\u00e9e.<\/p>\n<p>Tant que ces r\u00e9formes ne seront pas mises en place, il faut faire pr\u00e9valoir le bon sens et revenir \u00e0 la situation ant\u00e9rieure donc pr\u00e9voir l\u2019obligation de remise d\u2019un certificat m\u00e9dical d\u00e8s le premier jour de maladie.<\/p>\n<p>&nbsp;<\/p>\n<p><em>Source : FEB<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Depuis 2022, le travailleur ne doit plus remettre de certificat m\u00e9dical pour des absences de courte dur\u00e9e.
