









{"id":18319,"date":"2025-10-14T14:51:56","date_gmt":"2025-10-14T12:51:56","guid":{"rendered":"https:\/\/peoplesphere.be\/fr\/?p=18319"},"modified":"2025-10-14T15:00:53","modified_gmt":"2025-10-14T13:00:53","slug":"pour-une-culture-de-la-mediation-un-choix-economique-et-perenne","status":"publish","type":"post","link":"https:\/\/peoplesphere.be\/fr\/pour-une-culture-de-la-mediation-un-choix-economique-et-perenne\/","title":{"rendered":"Pour une culture de la m\u00e9diation, un choix \u00e9conomique et p\u00e9renne."},"content":{"rendered":"<p>La Commission f\u00e9d\u00e9rale de M\u00e9diation (CFM), qui f\u00eate ses vingt ans cette ann\u00e9e, profite de l\u2019occasion pour lancer une nouvelle initiative : la charte MARC (modes alternatifs de r\u00e8glement des conflits) \u00e0 l\u2019intention des entreprises. \u00ab\u00a0<em>Cette charte permet aux entreprises, aux organisations sectorielles et aux associations de s\u2019engager publiquement \u00e0 r\u00e9gler les conflits \u00e0 l\u2019amiable, par la n\u00e9gociation ou la m\u00e9diation, plut\u00f4t que de saisir imm\u00e9diatement les tribunaux\u2009\u00a0\u00bb<\/em>\u00a0explique Marco Schoups, initiateur du projet et membre du conseil d\u2019administration de la CFM.<!--more--><\/p>\n<p>La nouvelle charte vise \u00e0 consacrer la m\u00e9diation comme la m\u00e9thode de r\u00e9f\u00e9rence pour la r\u00e9solution des conflits en entreprise. La CFM se calque ainsi sur l\u2019exemple des \u00c9tats-Unis et du Royaume-Uni, o\u00f9 des \u00ab\u00a0Mediation Pledges\u00a0\u00bb similaires sont bien \u00e9tablis depuis longtemps. L\u2019objectif est clair : donner aux entreprises les moyens de g\u00e9rer les litiges plus rapidement, avec plus d\u2019efficacit\u00e9 et de mani\u00e8re constructive, tout en ancrant une v\u00e9ritable culture de la m\u00e9diation dans les entreprises belges.<\/p>\n<p><em>\u00ab\u00a0Un accord bien n\u00e9goci\u00e9 repr\u00e9sente un gain de temps, de ressources et de capacit\u00e9s pour tout le monde\u00a0\u00bb<\/em>, souligne la ministre de la Justice, Annelies Verlinden, qui assistait au lancement. <em>\u00ab\u00a0Le mod\u00e8le consensuel a d\u00e9j\u00e0 prouv\u00e9 son efficacit\u00e9 \u00e0 plusieurs reprises, surtout dans les entreprises, o\u00f9 les conflits ont un impact consid\u00e9rable. La charte MARC offre la possibilit\u00e9 d\u2019ancrer la r\u00e9solution amiable des conflits dans davantage d\u2019entreprises.\u00a0\u00bb<\/em><\/p>\n<h3><strong><em>Une approche efficace et \u00e9conomique<\/em><\/strong><\/h3>\n<p>La charte demande aux entreprises d\u2019inclure dans leurs contrats des clauses qui stipulent qu\u2019en cas de conflit, elles doivent privil\u00e9gier des solutions \u00e0 l\u2019amiable telles que la m\u00e9diation, plut\u00f4t que d\u2019entamer imm\u00e9diatement des proc\u00e9dures judiciaires. Les entreprises d\u00e9signent, en outre, un responsable interne charg\u00e9 de coordonner l\u2019application de la charte et de promouvoir activement la m\u00e9diation au sein et \u00e0 l\u2019ext\u00e9rieur de l\u2019organisation. En plus d\u2019\u00eatre un accord juridique, la m\u00e9diation devient donc aussi, et surtout, un r\u00e9flexe int\u00e9gr\u00e9 dans la culture d\u2019entreprise.<\/p>\n<p>Les avantages sont nombreux. La m\u00e9diation \u00e9vite aux entreprises les co\u00fbts et les incertitudes li\u00e9s aux proc\u00e9dures qui s\u2019\u00e9ternisent. De quoi maintenir de bonnes relations avec leurs travailleurs, leurs partenaires et leurs fournisseurs tout en instaurant une dynamique positive au sein de leurs \u00e9quipes. Il s\u2019agit, en r\u00e9sum\u00e9, d\u2019une m\u00e9thode de gestion des litiges davantage tourn\u00e9e vers l\u2019avenir.<\/p>\n<h3><strong><em>Vers une culture de la m\u00e9diation<\/em><\/strong><\/h3>\n<p>L\u2019organisation patronale FEB soutient \u00e9galement le projet. Pieter Timmermans, CEO : \u00ab\u00a0<em>La charte MARC est un levier qui permet aux entreprises de p\u00e9renniser leurs relations avec leurs travailleurs, leurs fournisseurs et leurs partenaires. Dans une \u00e9conomie o\u00f9 l\u2019efficacit\u00e9 de la collaboration n\u2019est plus \u00e0 prouver, cet engagement est plus judicieux que jamais.\u00a0\u00bb<\/em><\/p>\n<p>Si l\u2019initiative s\u2019adresse \u00e0 l\u2019ensemble des entreprises de Belgique, elle vise particuli\u00e8rement le secteur de la construction. Les organisations sectorielles Embuild et l\u2019ADEB-VBA ont d\u2019ailleurs sign\u00e9 le projet.<\/p>\n<p>L\u2019Institut des juristes d\u2019entreprise (IJE) applaudit aussi l\u2019initiative. Julie Dutordoir, directrice g\u00e9n\u00e9rale : <em>\u00ab\u00a0L\u2019Institut des juristes d\u2019entreprise partage l\u2019esprit de cette charte MARC. Comme ils sont au c\u0153ur de l\u2019entreprise, les juristes d\u2019entreprise sont on ne peut mieux plac\u00e9s pour r\u00e9soudre les conflits, mais aussi les pr\u00e9venir. Cela cadre parfaitement avec nos valeurs d\u00e9ontologiques et notre conviction selon laquelle un dialogue constructif et des solutions amiables constituent la base de relations durables et d\u2019une gestion efficace des conflits.\u00a0\u00bb<\/em><\/p>\n<h3><strong><em>Deuxi\u00e8me variante<\/em><\/strong><\/h3>\n<p>La CFM va d\u2019embl\u00e9e lancer une deuxi\u00e8me variante de la charte, \u00e0 l\u2019intention des organisations sectorielles : en signant la charte, elles se donnent pour objectif de recourir d\u2019abord \u00e0 la m\u00e9diation avant de saisir les tribunaux au sein de leur secteur.<\/p>\n<p>Si la charte o\u00f9 figure la clause de m\u00e9diation peut \u00eatre utilis\u00e9e pour r\u00e9soudre les conflits internes aux entreprises, que ce soit entre les employeurs et les travailleurs ou entre les travailleurs, la clause de m\u00e9diation peut \u00e9galement \u00eatre ajout\u00e9e aux contrats aux fins de la gestion des conflits entre les entreprises et leurs fournisseurs ou sous-traitants.<em> \u00ab\u00a0L\u2019effet boule de neige de la m\u00e9diation doit se faire sentir dans tous les aspects de l\u2019entreprise\u00a0\u00bb<\/em>, souligne Marco Schoups. <em>\u00ab\u00a0On d\u00e9pense encore beaucoup trop d\u2019\u00e9nergie, de temps et d\u2019argent dans des proc\u00e8s alors qu\u2019une m\u00e9diation aurait permis de r\u00e9soudre les conflits plus rapidement, plus efficacement, \u00e0 moindre co\u00fbt et avec un impact plus positif sur la relation entre les parties.\u00a0\u00bb<\/em><\/p>\n<p>Pour la CFM, cette charte constitue la prochaine \u00e9tape d\u2019un processus entam\u00e9 depuis plusieurs ann\u00e9es dans l\u2019optique de faire conna\u00eetre la m\u00e9diation et d\u2019en faciliter l\u2019acc\u00e8s pour les entreprises. La Commission coordonne tout ce qui touche \u00e0 la m\u00e9diation en Belgique depuis 2005.
