Un p\u00e8re licenci\u00e9 alors qu\u2019il \u00e9tait en cong\u00e9 parental et qui venait de prendre un cong\u00e9 d\u2019adoption a obtenu gain de cause devant le Tribunal du travail de Bruxelles. Le tribunal reconna\u00eet \u00e0 la fois le non-respect de la protection li\u00e9e au cong\u00e9 parental et une discrimination fond\u00e9e sur la paternit\u00e9 et l\u2019adoption.\u200b L\u2019Institut pour l\u2019\u00e9galit\u00e9 des femmes et des hommes \u00e9tait partie \u00e0 cette affaire.<\/p>\n

Le Tribunal estime que l\u2019employeur ne prouve pas que le motif du licenciement est \u00e9tranger au cong\u00e9 parental. Selon le juge, la protection contre le licenciement des personnes b\u00e9n\u00e9ficiant d\u2019un cong\u00e9 parental n\u2019a donc pas \u00e9t\u00e9 respect\u00e9e.<\/p>\n

Cette d\u00e9cision souligne l\u2019importance pour les employeurs de pouvoir justifier de mani\u00e8re pr\u00e9cise et objective toute d\u00e9cision de licenciement prise \u00e0 proximit\u00e9 d\u2019un cong\u00e9 parental.<\/p>\n

Discrimination fond\u00e9e sur la paternit\u00e9 et l\u2019adoption<\/em><\/strong><\/h3>\n

Le Tribunal reconna\u00eet \u00e9galement l\u2019existence d\u2019une discrimination multiple sur la base des crit\u00e8res de la paternit\u00e9 et de l\u2019adoption, tels que pr\u00e9vus par la Loi Genre au moment de l\u2019introduction de ce dossier*. Le juge estime que la situation du p\u00e8re qui prend un cong\u00e9 parental ou d\u2019adoption est bien couverte par le crit\u00e8re de la paternit\u00e9.<\/p>\n

Le Tribunal consid\u00e8re que le motif r\u00e9el du licenciement d\u00e9coule des responsabilit\u00e9s familiales li\u00e9es \u00e0 l\u2019accueil d\u2019un deuxi\u00e8me enfant dans le cadre d\u2019une proc\u00e9dure d\u2019adoption et rel\u00e8ve que les reproches adress\u00e9s au travailleur sont directement et simultan\u00e9ment li\u00e9s \u00e0 sa paternit\u00e9 et \u00e0 la proc\u00e9dure d\u2019adoption.<\/p>\n

Il conclut ainsi \u00e0 l\u2019existence d\u2019une discrimination multiple fond\u00e9e sur la paternit\u00e9 et l\u2019adoption.<\/p>\n

Cumul des indemnit\u00e9s<\/em><\/strong><\/h3>\n

Le Tribunal pr\u00e9voit un cumul de l\u2019indemnit\u00e9 pour discrimination multiple sur la base des crit\u00e8res de la paternit\u00e9 et de l\u2019adoption, avec l\u2019indemnit\u00e9 pour violation de la protection li\u00e9e au cong\u00e9 parental. Il consid\u00e8re que ces indemnit\u00e9s poursuivent des finalit\u00e9s distinctes et r\u00e9parent des dommages diff\u00e9rents, ce qui justifie leur cumul.<\/p>\n

Pour Michel Pasteel, directeur de l\u2019Institut pour l’\u00e9galit\u00e9 des femmes et des hommes, \u00ab\u00a0Ce jugement envoie un signal clair : les responsabilit\u00e9s familiales et les choix de parentalit\u00e9, y compris via l\u2019adoption, ne peuvent justifier un traitement d\u00e9favorable au travail. Elle confirme que les protections contre la discrimination s\u2019appliquent pleinement aux p\u00e8res et permet de promouvoir une r\u00e9elle \u00e9galit\u00e9 entre les femmes et les hommes devant les responsabilit\u00e9s familiales.\u00a0\u00bb<\/em><\/p>\n
