Et que dit le cadre juridique?<!--more--><\/p>\n<p>Selon le prestataire de services RH Group S, le cadre juridique est clair : \u00ab\u00a0<em>Un employeur n\u2019est pas l\u00e9galement tenu de prendre en compte le ramadan ou le car\u00eame\u00a0\u00bb<\/em>, explique Frank Verbruggen, legal manager. \u00ab\u00a0<em>Les travailleurs doivent donc continuer \u00e0 fournir les prestations convenues, telles que pr\u00e9vues dans leur contrat. Le je\u00fbne est un choix individuel et n\u2019entra\u00eene pas automatiquement des modifications structurelles de l\u2019organisation du travail.\u00a0\u00bb<\/em><\/p>\n<p>Cela n\u2019emp\u00eache pas que des questions se posent chez les employeurs et les coll\u00e8gues :<\/p>\n<ul>\n<li>A-t-on droit \u00e0 un horaire adapt\u00e9 ?<\/li>\n<li>Puis-je rentrer plus t\u00f4t si je saute ma pause d\u00e9jeuner ?<\/li>\n<li>Que peut-on ou doit-on faire si l\u2019on est invit\u00e9 \u00e0 un d\u00e9jeuner d\u2019affaires pendant la p\u00e9riode de je\u00fbne ?<\/li>\n<li>Que faire si j\u2019estime que le je\u00fbne d\u2019un coll\u00e8gue a un impact sur mon travail ?<\/li>\n<\/ul>\n<p><em>\u00ab\u00a0Le dialogue peut aider \u00e0 trouver des solutions temporaires et pratiques\u00a0\u00bb,<\/em> pr\u00e9cise toutefois Verbruggen. <em>\u00ab\u00a0Mais aucune des deux parties n\u2019y est oblig\u00e9e. Dans les secteurs o\u00f9 la vigilance est cruciale \u2014 par exemple la production, le transport ou les m\u00e9tiers techniques \u2014 une attention accrue est recommand\u00e9e.
