Sans compter que ces recours ne seraient que la partie \u00e9merg\u00e9e de l\u2019iceberg. La CSC rel\u00e8ve que nombreux.euses sont celles et ceux qui ne vont pas jusqu\u2019au tribunal, malgr\u00e9 des discriminations subies, par manque de preuve (les patrons discriminants sont tr\u00e8s prudents) ou par m\u00e9connaissance des proc\u00e9dures, lois.<!--more--><\/p>\n<p>Et 80% des recours en justice pour discriminations se font devant les tribunaux du travail. Surtout pour des licenciements.<\/p>\n<p>La CSC souligne qu&rsquo;il faut absolument :<\/p>\n<ul>\n<li>Mieux former les magistrats et qu\u2019ils appliquent davantage la pr\u00e9somption de discrimination afin de renverser la preuve sur l\u2019employeur.<\/li>\n<li>Clarifier la loi anti-discrimination (fixer des lignes directrices pour la pr\u00e9somption).<\/li>\n<li>Renforcer le r\u00f4le des associations sp\u00e9cialis\u00e9es et instituts f\u00e9d\u00e9raux<br \/>\n(Unia, IEFH&#8230;) car \u00e7a fait grimper de 36,6% (recours seuls) \u00e0 70% les chances d\u2019obtenir une sanction (recours avec Unia).<\/li>\n<\/ul>\n<p><em>\u00ab\u00a0La Belgique est le moins bon \u00e9l\u00e8ve de l\u2019Union europ\u00e9enne pour le taux d\u2019emploi de ce public et \u00e7a nous a valut quelques rappels \u00e0 l\u2019ordre. 26% d\u2019\u00e9cart entre les femmes d\u2019origine belge et les femmes d\u2019origine non europ\u00e9enne, ce n\u2019est pas anodin. Surtout lorsqu\u2019on sait que pour seulement une femme sur 3, \u00e7a peut s\u2019expliquer par des variables socio-d\u00e9mographiques (nonreconnaissance ou absence de dipl\u00f4me, grandes familles et pas de place en cr\u00e8che,&#8230;). Sans compter qu\u2019elles sont, pour plus d\u2019un tiers d\u2019entre elles, surqualifi\u00e9es pour leur boulot.\u00a0\u00bb<\/em><\/p>\n<p><strong><em>Quelles autres explications ?<\/em><\/strong><\/p>\n<ul>\n<li>La barri\u00e8re de la langue. Mais en Flandre, les cours de langue sont devenus payants, limit\u00e9s en places et se font en journ\u00e9e.<\/li>\n<li>Le racisme, les discriminations et les pr\u00e9jug\u00e9s sur leur origine.<\/li>\n<\/ul>\n<p><strong><em>Quelques pistes de solutions :<\/em><\/strong><\/p>\n<ul>\n<li>Des places en cr\u00e8ches (flexibles et abordables).<\/li>\n<li>Des formations de \u201cprogramme passerelle\u201d permettant une remise \u00e0 niveau des personnes d\u00e9j\u00e0 dipl\u00f4m\u00e9es \u00e0 l\u2019\u00e9tranger (et non devoir recommencer toute la formation).<\/li>\n<li>Des cours de langue abordables.<\/li>\n<\/ul>\n<h3><strong><em>Et la racisme au travail&#8230;<\/em><\/strong><\/h3>\n<p>Une \u00e9tude de la Fondation Roi Baudouin sur l\u2019insertion en Belgique des personnes d\u2019origine subsaharienne montre que 70% des participants \u00e0 l\u2019\u00e9tude ont d\u00e9j\u00e0 subi du racisme mais seuls 3% ont port\u00e9 plainte, 4% ont contact\u00e9 une association et 2% ont contact\u00e9 un syndicat. C\u2019est tr\u00e8s peu. Beaucoup trop peu !<\/p>\n<p>61% de ces exp\u00e9riences sont li\u00e9es \u00e0 l\u2019emploi, sans compter les formations qualifiantes qui se retrouvent dans la partie \u201cA l\u2019\u00e9cole, ou l\u2019Universit\u00e9 ou lors d\u2019une formation\u201d (qualifiante). En comparaison, sur 10 dossiers ouverts en 2024 par Unia, 3 concernent le racisme. Et c\u2019est effectivement dans l\u2019emploi que ce ph\u00e9nom\u00e8ne se produit le plus souvent. L\u2019emploi concerne, \u00e0 lui seul, 29% des dossiers pour racisme.
