La Su\u00e8de, internationalement reconnue comme un pays pionnier en mati\u00e8re d\u2019\u00e9galit\u00e9 entre les femmes et les hommes, a annonc\u00e9 qu\u2019elle ne transposera pas la directive europ\u00e9enne sur la transparence des r\u00e9mun\u00e9rations dans sa l\u00e9gislation nationale. Elle entend d\u2019abord ren\u00e9gocier la directive. Pour ce faire, le d\u00e9lai de transposition fix\u00e9 au 7 juin 2026 doit \u00eatre report\u00e9. Le gouvernement su\u00e9dois souligne que l\u2019objectif \u2013 s\u2019attaquer aux \u00e9carts de r\u00e9mun\u00e9ration injustifi\u00e9s entre femmes et hommes \u2013 est l\u00e9gitime, mais il estime que la version actuelle est trop complexe et lourde sur le plan administratif et qu\u2019elle passera totalement \u00e0 c\u00f4t\u00e9 de son objectif.<!--more--><\/p>\n<p>Cet appel n\u2019est pas neuf. BusinessEurope, l\u2019organisation fa\u00eeti\u00e8re europ\u00e9enne qui repr\u00e9sente les organisations patronales nationales de toute l\u2019Europe, plaide de longue date en faveur d\u2019un \u00ab\u00a0stop the clock\u00a0\u00bb et d\u2019un ajustement de la directive sur la transparence des r\u00e9mun\u00e9rations, afin qu\u2019elle soit applicable et praticable, qu\u2019elle s\u2019articule mieux avec les syst\u00e8mes nationaux et qu\u2019elle laisse une marge suffisante au dialogue social. Dans sa forme actuelle, la directive est disproportionn\u00e9e, s\u2019accompagne de charges administratives \u00e9lev\u00e9es et de risques financiers r\u00e9els pour les entreprises, et menace de saper la comp\u00e9titivit\u00e9. En outre, elle met sous pression le syst\u00e8me existant de n\u00e9gociations salariales et risque d\u2019affaiblir la r\u00e9mun\u00e9ration li\u00e9e aux performances, car les exigences qu\u2019elle impose en mati\u00e8re de preuve sont, dans la pratique, \u00e0 peine r\u00e9alisables.<\/p>\n<h3><strong><em>Conseil europ\u00e9en<\/em><\/strong><\/h3>\n<p>Lors du Conseil europ\u00e9en du 19 mars, il a \u00e9t\u00e9 explicitement demand\u00e9 de poursuivre la simplification de la r\u00e9glementation europ\u00e9enne. La Commission est invit\u00e9e \u00e0 proposer davantage de mesures omnibus et \u00e0 passer en revue en profondeur le cadre r\u00e9glementaire de l\u2019UE pour supprimer les dispositions obsol\u00e8tes, redondantes ou inefficaces. Le retrait de propositions l\u00e9gislatives fait \u00e9galement partie des options. La r\u00e9vision de la directive sur la transparence des r\u00e9mun\u00e9rations s\u2019inscrit parfaitement dans cette vision du Conseil europ\u00e9en.<\/p>\n<p>Pieter Timmermans, administrateur d\u00e9l\u00e9gu\u00e9 de la FEB\u202f: <em>\u00ab\u00a0Le fait que la Su\u00e8de prenne pr\u00e9cis\u00e9ment l\u2019initiative aujourd\u2019hui montre qu\u2019une approche \u2018stop the clock\u2019 est non seulement toujours d\u2019actualit\u00e9, mais qu\u2019elle s\u2019inscrit pleinement dans l\u2019accent actuellement mis au niveau europ\u00e9en sur la comp\u00e9titivit\u00e9 et la r\u00e9duction de la charge r\u00e9glementaire. La Belgique ne peut ignorer ces signaux et doit se rallier explicitement \u00e0 cette orientation. En Belgique, nous affichons, apr\u00e8s le Luxembourg, le plus faible \u00e9cart de r\u00e9mun\u00e9ration de toute l\u2019Union europ\u00e9enne. Nous ne faisons donc certainement pas moins bien que la Su\u00e8de, au contraire\u202f! Qui veut r\u00e9ellement renforcer l\u2019\u00e9galit\u00e9 entre les femmes et les hommes et faire de la directive sur la transparence des r\u00e9mun\u00e9rations un instrument efficace au service de la poursuite du d\u00e9veloppement des droits sociaux ne saurait s\u2019accrocher \u00e0 la directive dans sa forme actuelle.
