L\u2019analyse de Kristel Bogaerts (Mercer Workforce &amp; Careers).<!--more--><\/p>\n<p><strong><em>1. \u00ab\u00a0Mon salaire reste une information priv\u00e9e, mais je peux savoir si je suis pay\u00e9 en dessous de la moyenne pour mon poste.\u00a0\u00bb<\/em><\/strong><\/p>\n<p>VRAI &#8211; Les salaires individuels restent confidentiels et l\u2019employeur n\u2019est pas tenu de communiquer le salaire exact d\u2019un coll\u00e8gue. En revanche, les travailleurs peuvent acc\u00e9der \u00e0 des donn\u00e9es anonymis\u00e9es et comparables (moyennes, \u00e9carts, crit\u00e8res utilis\u00e9s) pour comprendre comment leur salaire est d\u00e9termin\u00e9, se situer par rapport \u00e0 des fonctions \u00e9quivalentes (\u00ab le m\u00eame travail ou un travail de valeur \u00e9gale \u00bb) et identifier d\u2019\u00e9ventuelles in\u00e9galit\u00e9s.<\/p>\n<p><strong><em>2. \u00ab\u00a0Un \u00e9cart salarial de plus de 5 % est automatiquement ill\u00e9gal et entra\u00eene une augmentation imm\u00e9diate du salaire.\u00a0\u00bb<\/em><\/strong><\/p>\n<p>FAUX &#8211; Un \u00e9cart salarial de plus de 5 % n\u2019est pas automatiquement ill\u00e9gal s\u2019il est objectivement justifi\u00e9 (exp\u00e9rience, responsabilit\u00e9s, comp\u00e9tences, performance, anciennet\u00e9, etc.). En l\u2019absence de justification, l\u2019employeur devra corriger la situation selon les r\u00e8gles de transposition nationales, mais cela ne signifie pas n\u00e9cessairement une augmentation individuelle imm\u00e9diate.<\/p>\n<p><strong><em>3. \u00ab\u00a0Si deux personnes font le m\u00eame job avec le m\u00eame titre, elles doivent gagner la m\u00eame chose.\u00a0\u00bb<\/em><\/strong><\/p>\n<p>FAUX &#8211; Pas automatiquement. M\u00eame intitul\u00e9 et m\u00eame fonction n\u2019exigent pas un salaire identique si des crit\u00e8res objectifs et tra\u00e7ables expliquent la diff\u00e9rence (par exemple anciennet\u00e9, niveau de responsabilit\u00e9 effectif, performance ou qualifications). En l\u2019absence de justification, l\u2019\u00e9galit\u00e9 de traitement doit \u00eatre r\u00e9tablie.<\/p>\n<p><strong><em>4. \u00ab\u00a0La transparence salariale peut avoir un impact positif sur le bien\u2011\u00eatre des travailleurs.\u00a0\u00bb<\/em><\/strong><\/p>\n<p>VRAI &#8211; Le bien\u2011\u00eatre et la transparence salariale sont encore rarement li\u00e9s, mais les organisations constatent que le manque de clart\u00e9 autour de la r\u00e9mun\u00e9ration peut g\u00e9n\u00e9rer stress et frustration.<\/p>\n<p>L\u2019opacit\u00e9 concernant les promotions, l\u2019\u00e9volution salariale ou les \u00e9carts internes peut nuire \u00e0 l\u2019engagement et \u00e0 la confiance.<\/p>\n<p>\u00c0 l\u2019inverse, une plus grande transparence renforce la s\u00e9curit\u00e9 psychologique, lorsque les travailleurs per\u00e7oivent les d\u00e9cisions comme justes et expliqu\u00e9es.<\/p>\n<p><strong><em>5. \u00ab\u00a0Cela concerne uniquement le salaire de base, et non la r\u00e9mun\u00e9ration variable (primes, etc.) ni les avantages (voiture de fonction, etc.)\u00a0\u00bb<\/em><\/strong><\/p>\n<p>FAUX &#8211; Cela concerne tous les \u00e9l\u00e9ments de la r\u00e9mun\u00e9ration globale, y compris la r\u00e9mun\u00e9ration variable et les avantages : primes, participation aux b\u00e9n\u00e9fices, commissions, options sur actions, ch\u00e8ques-repas, voiture de fonction, indemnit\u00e9s d&rsquo;heures suppl\u00e9mentaires, indemnit\u00e9s de formation, ainsi que d&rsquo;autres \u00e9l\u00e9ments de r\u00e9mun\u00e9ration et avantages non mon\u00e9taires.<\/p>\n<p><strong><em>6. \u00ab\u00a0L&#8217;employeur doit indiquer les \u00e9chelles salariales dans les offres d&#8217;emploi et peut d\u00e9terminer lui-m\u00eame les fourchettes \u00e0 appliquer\u00a0\u00bb<\/em><\/strong><\/p>\n<p>FAUX &#8211; Le salaire doit \u00eatre communiqu\u00e9 au d\u00e9but du processus de recrutement et les candidats doivent recevoir des informations sur la r\u00e9mun\u00e9ration d\u00e8s le d\u00e9but (par exemple, une indication, une classe ou une fourchette salariale), mais ces informations ne doivent pas n\u00e9cessairement figurer dans le texte de l&rsquo;offre d&#8217;emploi.<\/p>\n<p>Les informations salariales communiqu\u00e9es doivent toutefois d\u00e9couler de mani\u00e8re d\u00e9montrable de la politique de r\u00e9mun\u00e9ration de l&#8217;employeur et \u00eatre fond\u00e9es sur des crit\u00e8res objectifs et neutres du point de vue du genre ; les mentions arbitraires ou trompeuses ne satisfont pas \u00e0 l&rsquo;obligation de transparence.<\/p>\n<p><strong><em>7. \u00ab\u00a0D\u00e9sormais, seuls quatre crit\u00e8res s&rsquo;appliquent pour la fixation des salaires : les comp\u00e9tences, l&rsquo;effort, la responsabilit\u00e9 et les conditions de travail. Des crit\u00e8res tels que l&rsquo;anciennet\u00e9 ne comptent plus.\u00a0\u00bb<\/em><\/strong><\/p>\n<p>FAUX &#8211; L&rsquo;anciennet\u00e9 est autoris\u00e9e en tant que facteur objectif, tant qu&rsquo;elle n&rsquo;entra\u00eene pas indirectement de discrimination.<\/p>\n<p>Les crit\u00e8res mentionn\u00e9s d\u00e9terminent si un travail est \u00e9quivalent \u2014 ils visent \u00e0 \u00e9tablir un travail \u00e9gal ou de valeur \u00e9gale, et non \u00e0 fixer directement les salaires.
