Et c&rsquo;est dans la sph\u00e8re professionnelle que se manifeste la majorit\u00e9 des in\u00e9galit\u00e9s.<!--more--><\/h1>\n<p>L&rsquo;Institut d\u00e9nonce, au vu des plaintes re\u00e7ues au sein de son service juridique, les nombreuses et permanentes discriminations fond\u00e9es sur le sexe dont sont principalement victimes les femmes, tout particuli\u00e8rement dans le domaine du travail.<\/p>\n<p><em><strong>Etat des lieux alarmant en 2014 encore!<\/strong><\/em><\/p>\n<p>La cellule juridique de l\u2019Institut a enregistr\u00e9 366 notifications, dont 157 demandes d\u2019informations et 209 plaintes via le num\u00e9ro gratuit 0800\/12.800. Bien que le nombre total de notifications en 2014 soit en augmentation de 13 % par rapport \u00e0 2013, le nombre de plaintes est lui en l\u00e9g\u00e8re diminution (-6 %). Par contre, le nombre de demandes d\u2019informations juridiques a augment\u00e9 de plus de la moiti\u00e9 par rapport \u00e0 2013 (+55 %). Par ailleurs, l\u2019Institut a re\u00e7u 188 demandes d\u2019informations non juridiques en 2014.<\/p>\n<p>De plus, 62 % des notifications provenaient de femmes ; 37 % \u00e9manaient d\u2019hommes. Les femmes sont plus souvent victimes de discrimination fond\u00e9e sur le sexe que les hommes. En 2014, le nombre de notifications \u00e9manant de femmes a augment\u00e9 de pr\u00e8s d\u2019un cinqui\u00e8me par rapport \u00e0 2013. Le nombre de notifications provenant d\u2019hommes a baiss\u00e9 d\u2019environ 4%.<\/p>\n<p><em>\u00ab\u00a0La l\u00e9g\u00e8re diminution des plaintes observ\u00e9e \u00e0 l\u2019Institut mise en parall\u00e8le avec une augmentation des demandes d\u2019informations refl\u00e8tent un ph\u00e9nom\u00e8ne d\u00e9j\u00e0 relev\u00e9 dans diverses \u00e9tudes \u00e0 savoir que peu de victimes de discrimination fond\u00e9e sur le sexe osent d\u00e9poser plainte. Les femmes, qui en sont majoritairement victimes et des formes les plus graves, sont peu nombreuses \u00e0 faire respecter leurs droits, contrairement aux hommes qui d\u00e9posent plainte plus facilement pour des discriminations plus souvent symboliques que graves. Preuves que dans une soci\u00e9t\u00e9 d\u00e9mocratique qui d\u00e9fend plus que jamais ses valeurs et les droits humains, l\u2019\u00e9galit\u00e9 des femmes et des hommes n\u2019est, contrairement aux id\u00e9es re\u00e7ues, pas encore acquise.\u00a0\u00bb<\/em> constate Michel Pasteel, Directeur de l\u2019Institut pour l\u2019\u00e9galit\u00e9 des femmes et des hommes.<\/p>\n<p><em><strong>Le monde du travail, premier &lsquo;pourvoyeur&rsquo; de discriminations<\/strong><\/em><\/p>\n<p>La discrimination directe reste le comportement qui g\u00e9n\u00e8re le plus grand nombre de notifications. Mais par rapport \u00e0 2013, le nombre de notifications relatives aux discriminations indirectes a doubl\u00e9. La plupart des plaintes introduites en 2014 concernaient le domaine du \u00ab travail \u00bb. Plus de 7 notifications sur 10 relatives au travail ont \u00e9t\u00e9 introduites par des femmes.<\/p>\n<p>Parmi ces notifications, l\u2019Institut constate des discriminations \u00e0 l\u2019\u00e9gard des femmes enceintes: les plus fr\u00e9quentes concernent l\u2019embauche (13 %), les conditions d\u2019emploi (26 %) et la fin de la relation de travail (48 %). L\u2019Institut constate par ailleurs une augmentation du nombre de notifications ayant trait \u00e0 la discrimination relative \u00e0 la f\u00e9condation in vitro. <em>\u00ab\u00a0Les discriminations fond\u00e9es sur le sexe \u00e0 l\u2019encontre des femmes enceintes ou \u00e0 leur retour de cong\u00e9 de maternit\u00e9 rel\u00e8vent d\u2019une probl\u00e9matique soci\u00e9tale majeure. En effet, peu de femmes connaissent leurs droits \u00e0 ce sujet, osent d\u00e9poser plainte de peur, par exemple, de perdre leur emploi, et beaucoup pensent encore que ces discriminations sont normales.\u00a0\u00bb<\/em> explique Michel Pasteel.<\/p>\n<p><strong><em>Impact des l\u00e9gislations sur les discriminations<\/em><\/strong><\/p>\n<p>Trois modifications importantes, faisant suite \u00e0 des avis et recommandations de l\u2019Institut pour l\u2019\u00e9galit\u00e9 des femmes et des hommes, ont \u00e9t\u00e9 apport\u00e9es \u00e0 la l\u00e9gislation en 2014 :<\/p>\n<p>\u2022 la loi du 22 mai 2014 modifiant la loi du 10 mai 2007 tendant \u00e0 lutter contre la discrimination entre les femmes et les hommes en vue de l\u2019\u00e9tendre \u00e0 l\u2019identit\u00e9 de genre et \u00e0 l\u2019expression de genre,<br \/>\n\u2022 la loi du 8 mai 2014 modifiant le Code civil en vue d\u2019instaurer l\u2019\u00e9galit\u00e9 de l\u2019homme et de la femme dans le mode de transmission du nom \u00e0 l\u2019enfant et \u00e0 l\u2019adopt\u00e9 ;<br \/>\n\u2022 la loi du 22 mai 2014 tendant \u00e0 lutter contre le sexisme dans l\u2019espace public et modifiant la loi du 10 mai 2007 tendant \u00e0 lutter contre la discrimination afin de p\u00e9naliser l\u2019acte de discrimination.<\/p>\n<p>Ces \u00e9volutions l\u00e9gislatives donnent des outils suppl\u00e9mentaires \u00e0 l\u2019Institut pour lutter contre des discriminations structurelles. Depuis l\u2019entr\u00e9e en vigueur de la loi tendant \u00e0 lutter contre le sexisme, l\u2019Institut a remarqu\u00e9 une importante augmentation du nombre de notifications ayant trait au sexisme, qui ont tripl\u00e9 en 2014 par rapport \u00e0 2013.<br \/>\nDe m\u00eame, pr\u00e8s de 10 % de l\u2019ensemble des notifications relatives \u00e0 une discrimination \u00e9manaient de personnes transgenres.
