Extraits.<!--more--><\/h1>\n<p>Olivier Valentin est secr\u00e9taire national au sein de la CGSLB, syndicat lib\u00e9ral. A ses yeux, il ne fait aucun doute que le licenciement est \u00e0 \u00e9viter \u00e0 tout prix.<br \/>\nPar d\u00e9finition, un tel \u00e9v\u00e9nement demeure p\u00e9nible et il est difficile d\u2019imaginer qu\u2019il soit possible de \u201cbien licencier\u201d un collaborateur. Certes, l\u2019entreprise peut faire tout ce qui est en son pouvoir pour am\u00e9liorer les conditions lors de cette \u00e9tape, mais cette \u00e9preuve reste douloureuse quoi qu\u2019il arrive. (&#8230;)<\/p>\n<p>Cela dit, il arrive que l\u2019entreprise n\u2019ait pas d\u2019autre recours que de licencier un collaborateur. Dans ce cas, que peut-elle faire pour encadrer au mieux cette \u00e9tape, qui parfois, devient malheureusement in\u00e9vitable?<br \/>\nDepuis le 1er avril 2014 et suite \u00e0 l\u2019instauration de nouvelles r\u00e8gles relatives \u00e0 la motivation du licenciement, on a pu constater des changements dans l\u2019attitude des entreprises. En effet, jusqu\u2019\u00e0 cette date, l\u2019employeur n\u2019\u00e9tait pas tenu de motiver ou de justifier sa d\u00e9cision de mettre un terme \u00e0 une collaboration.(&#8230;)<\/p>\n<p>La CGSLB a particuli\u00e8rement soutenu cette (r\u00e9)volution et on devine le r\u00f4le capital jou\u00e9 par les partenaires sociaux dans un tel contexte. Il \u00e9tait temps de r\u00e9agir et d\u2019en finir avec ce droit de licencier sans devoir de justification. Et tr\u00e8s rapidement, les effets de ces nouvelles mesures se sont fait sentir!<br \/>\nOlivier Valentin reste persuad\u00e9 que cela a eu un impact sur l\u2019attitude des entreprises, ou du moins sur leur conscientisation avant de prendre la d\u00e9cision de rompre une collaboration. <em>\u00ab\u00a0L\u2019employeur, qui se voit alors oblig\u00e9 \u00e0 motiver son licenciement sera, il est clair, amen\u00e9 \u00e0 r\u00e9fl\u00e9chir davantage quant aux causes et cons\u00e9quences de son action. Alors qu\u2019auparavant, les entreprises avaient parfois tendance \u00e0 se cacher derri\u00e8re des solutions de facilit\u00e9, qui finalement, \u00e9taient totalement arbitraires pour le salari\u00e9 qui pouvait perdre son emploi sans la moindre explication. Il ne suffit plus de \u201cmon\u00e9tiser\u201d ou \u201cbudgetiser\u201d le sort accord\u00e9 aux travailleurs, il faut \u00e0 pr\u00e9sent que l\u2019entreprise se justifie, et cela change tout le contexte \u00e9videmment!\u00a0\u00bb<\/em><\/p>\n<p>Par ailleurs, l\u2019impact de cette nouvelle mesure ne se limitera pas aux relations entretenues entre l&rsquo;entreprise et l\u2019employ\u00e9 ! <em>\u00ab\u00a0Au-del\u00e0 de ce devoir de justification, l\u2019entreprise va finalement \u00eatre amen\u00e9e \u00e0 subir le regard des autres collaborateurs. On imagine ais\u00e9ment les diff\u00e9rences majeures introduites par ces nouvelles mesures et l\u2019impact sur les mentalit\u00e9s. L\u2019entreprise s\u2019expose, et s\u2019ouvre davantage \u00e0 la critique dans le cas de licenciements abusifs ou injustifi\u00e9s, par exemple.\u00a0\u00bb<\/em><\/p>\n<p><em><strong>Plus de coh\u00e9rence pour l&#8217;employ\u00e9<\/strong><\/em><\/p>\n<p>Face \u00e0 l&rsquo;\u00e9preuve de la rupture, souvent douloureuse, cette obligation de motivation par l\u2019entreprise apportera davantage de coh\u00e9rence \u00e0 l\u2019\u00e9gard de l\u2019employ\u00e9.<em> \u00ab\u00a0En effet, gr\u00e2ce \u00e0 ce dialogue, on prendra davantage en compte la dimension psychologique de ce dernier qui aura la possibilit\u00e9 de comprendre les raisons pour lesquelles l\u2019entreprise a d\u00fb en arriver l\u00e0. Par la motivation du licenciement, on per\u00e7oit par ailleurs dans le chef de l\u2019entreprise une volont\u00e9 d\u2019essayer de trouver des solutions, \u00e0 la fois \u00e0 travers un dialogue individuel mais \u00e9galement avec l\u2019appui et le soutien des permanents syndicaux. Le r\u00f4le d\u2019interm\u00e9diaire jou\u00e9 par ces derniers sera essentiel dans un tel contexte pour trouver des solutions et soutenir la personne victime d\u2019un licenciement.\u00a0\u00bb<\/em><\/p>\n<p><strong><em>Comment accompagner au mieux un licenciement individuel?\u00a0<\/em><\/strong><\/p>\n<p>C\u2019est ici\u00a0que le r\u00f4le et l\u2019int\u00e9r\u00eat de l\u2019outplacement prend tout son sens.<em> \u00ab\u00a0A ce propos, le nouveau syst\u00e8me d\u2019application \u00e0 partir de 2016 pose probl\u00e8me selon les syndicats : en effet, et pour r\u00e9sumer, c\u2019est finalement l\u2019employ\u00e9 licenci\u00e9 qui devra prendre \u00e0 sa charge les frais li\u00e9s \u00e0 son reclassement professionnel.
