Cette nouvelle obligation a un impact sur le calcul de l&rsquo;indemnit\u00e9. Mais comment nos entreprises vont-elles l&rsquo;appliquer?<!--more--><\/h1>\n<p>Quelle est la r\u00e8gle en vigueur pendant quelques jours encore (jusqu&rsquo;au 31\/12\/2015)? Si le travailleur licenci\u00e9 est amen\u00e9 \u00e0 prester un pr\u00e9avis, les heures d\u2019outplacement sont \u00e0 imputer sur les jours de cong\u00e9 r\u00e9mun\u00e9r\u00e9 pour sollicitation. Si le travailleur se voit offrir une indemnit\u00e9 compensatoire de pr\u00e9avis, il\u00a0a le choix d\u2019accepter ou pas l\u2019offre d\u2019outplacement. S\u2019il l\u2019accepte, l\u2019indemnit\u00e9 compensatoire de pr\u00e9avis est diminu\u00e9e de 4 semaines de r\u00e9mun\u00e9ration. S\u2019il refuse l\u2019offre d\u2019outplacement, il n\u2019est pas sanctionn\u00e9 et garde droit \u00e0 son indemnit\u00e9 compensatoire de pr\u00e9avis compl\u00e8te.<\/p>\n<p>La r\u00e8gle change donc \u00e0 partir du 1 janvier 2016\u00a0lorsque le travailleur refuse l&rsquo;offre d&rsquo;outplacement. Il s&rsquo;agit bien entendu pour le gouvernement de d\u00e9velopper un maximum d&rsquo;incentives \u00e0 maintenir voire d\u00e9velopper l&#8217;employabilit\u00e9 de chaque travailleur.\u00a0En cas de refus de l&rsquo;outplacement, l\u2019indemnit\u00e9 compensatoire de pr\u00e9avis sera d\u00e9sormais\u00a0diminu\u00e9e de 4 semaines de r\u00e9mun\u00e9ration. A priori, le calcul financier court terme s&rsquo;av\u00e8re d\u00e9sormais inint\u00e9ressant. Le travailleur licenci\u00e9 a int\u00e9r\u00eat \u00e0 accepter l\u2019offre d\u2019outplacement <em>(NB : cette nouvelle disposition effective au 1er janvier 2016\u00a0ne vaut pas en cas de licenciement pour motif grave.)<\/em><\/p>\n<p>Reste \u00e0 voir cependant si, dans la pratique, la recherche d&rsquo;une solution n\u00e9goci\u00e9e convenant \u00e0 toutes les parties ne va pas prendre le pas sur l&rsquo;application stricte de la r\u00e9glementation. La direction de l&rsquo;entreprise pourrait en effet d\u00e9cider de ne mas r\u00e9duire l&rsquo;indemnit\u00e9 compensatoire en cas de refus, dans une pure logique de conciliation&#8230; Dites-nous, comment envisagez-vous l&rsquo;application de ces nouvelles dispositions?
