Cette r\u00e9flexion prend tout son sens \u00e0 l\u2019heure o\u00f9 les partenaires sociaux discutent \u00ab\u00a0des crit\u00e8res objectifs pouvant servir \u00e0 l\u2019\u00e9tablissement d\u2019une liste r\u00e9visable reprenant les m\u00e9tiers lourds tant dans le secteur priv\u00e9 que le secteur public\u00a0\u00bb.<!--more--><\/h1>\n<p>Dans son avis n\u00b0149 relatif au genre des travaux p\u00e9nibles dans le cadre de la r\u00e9forme des pensions, le Conseil de l&rsquo;Egalit\u00e9 des Chances souhaite sensibiliser l&rsquo;ensemble des partenaires sociaux \u00e0 la dimension du genre.<\/p>\n<p><em>\u00ab\u00a0Les facteurs de p\u00e9nibilit\u00e9 sont encore aujourd\u2019hui peu ou mal analys\u00e9s, en tout cas ils font encore peu de cas des travaux exerc\u00e9es majoritairement par des femmes. L\u2019avis du Conseil pr\u00e9cise que ce n\u2019est pas le m\u00e9tier qui en lui-m\u00eame est \u00ab lourd \u00bb mais les conditions de son exercice qui peuvent le rendre p\u00e9nible voire difficile \u00e0 ex\u00e9cuter durant de longues p\u00e9riodes de la vie active.<\/em><br \/>\n<em> Ainsi les m\u00e9tiers d\u2019enseignante, d\u2019infirmi\u00e8re, de caissi\u00e8re, par exemple, deviennent difficiles \u00e0 exercer dans des circonstances particuli\u00e8res d\u00e8s qu\u2019ils se doublent de maux chroniques, de surcharge, de tension extr\u00eame, de harc\u00e8lement.\u00a0\u00bb<\/em><\/p>\n<p><em><strong>Quelles recommandations ?<\/strong><\/em><br \/>\nLe Conseil souhaite \u00e9mettre quatre recommandations destin\u00e9es au l\u00e9gislateur et aux partenaires sociaux. Lesquelles?<\/p>\n<p><em>1. Le Conseil de l\u2018\u00e9galit\u00e9 des chances demande au gouvernement de proc\u00e9der \u00e0 une enqu\u00eate aupr\u00e8s des secteurs f\u00e9minis\u00e9s (ceux qui occupent plus de 40 % de femmes) afin d\u2019examiner les conditions de travail, les facteurs de p\u00e9nibilit\u00e9, g\u00e9n\u00e9raux et sp\u00e9cifiques y compris les facteurs psycho-sociaux, et d\u2019en \u00e9valuer les risques en termes de temps de travail (rythmes, gestion, d\u00e9lais, horaires,etc.), d\u2019impact sur le physique et sur la sant\u00e9 mentale, sur la p\u00e9nurie d\u2019emploi, etc. Se r\u00e9f\u00e9rant \u00e0 une \u00e9tude de l\u2019HIVA de 2013 qui cat\u00e9gorise les travaux en 7 clusters, il constate qu\u2019il s\u2019agit principalement des travaux aux perspectives de carri\u00e8res limit\u00e9es, exigeant \u00e9motionnellement et ne pr\u00e9sentant pas les crit\u00e8res d\u2019un travail d\u00e9cent.<\/em><\/p>\n<p><em>2. Une liste de param\u00e8tres\/facteurs pourrait ensuite \u00eatre \u00e9tablie de mani\u00e8re objective et suffisamment pragmatique pour \u00eatre r\u00e9utilisable dans les \u00e9valuations de la p\u00e9nibilit\u00e9 des activit\u00e9s professionnelles (contenu, conditions, environnement, relation) et des t\u00e2ches int\u00e9grant la dimension de genre. Selon le Conseil de l\u2019\u00e9galit\u00e9, ce serait la seule mani\u00e8re d\u2019\u00e9viter un accroissement des discriminations indirectes qui touchent les femmes, dans un futur syst\u00e8me de pension \u00e0 points.<\/em><\/p>\n<p><em>3. Le Conseil estime, en outre, que la prise en consid\u00e9ration de la p\u00e9nibilit\u00e9 des travaux doit aller de pair avec une politique d\u2019am\u00e9lioration des conditions de travail et de pr\u00e9vention des situations de p\u00e9nibilit\u00e9 \u00e9vitables, durant toutes les p\u00e9riodes de travail qualifi\u00e9es de travail p\u00e9nible, et ce, conform\u00e9ment \u00e0 la loi du 4 ao\u00fbt 1996 relative au bien-\u00eatre des travailleurs.<\/em><\/p>\n<p><em>4.
