Elle a en effet d\u00e9bout\u00e9 un travailleur Roumain licenci\u00e9 pour avoir \u00ab\u00a0chatt\u00e9\u00a0\u00bb au travail.<!--more--><\/h1>\n<p>Le requ\u00e9rant, un jeune ing\u00e9nieur roumain, s\u2019estimait victime d\u2019une atteinte \u00e0 sa vie priv\u00e9e: il avait \u00e9t\u00e9 licenci\u00e9 en ao\u00fbt 2007, apr\u00e8s que son employeur eut rep\u00e9r\u00e9 qu\u2019il utilisait un service de messagerie instantan\u00e9 pour dialoguer non pas seulement avec ses contacts professionnels, mais aussi avec son fr\u00e8re et sa fianc\u00e9e. Le r\u00e8glement int\u00e9rieur de l\u2019entreprise <em>\u00ab\u00a0interdisait l\u2019usage des ressources de celle-ci \u00e0 des fins personnelles\u00a0\u00bb<\/em>, pr\u00e9cise la Cour.<\/p>\n<p>L\u2019internaute avait contest\u00e9 en vain son licenciement devant la justice de son pays, en arguant notamment que son ancien patron, pour le confondre, avait viol\u00e9 le secret de sa correspondance. A l\u2019instar des juridictions roumaines, les juges europ\u00e9ens ont rejet\u00e9 cet argument. Il n\u2019est <em>\u00ab\u00a0pas abusif qu\u2019un employeur souhaite v\u00e9rifier que ses employ\u00e9s accomplissent leurs t\u00e2ches professionnelles pendant les heures de travail\u00a0\u00bb<\/em>, a estim\u00e9 la CEDH. D\u2019ailleurs, <em>\u00ab\u00a0l\u2019employeur a acc\u00e9d\u00e9 au compte (du requ\u00e9rant) en pensant qu\u2019il contenait des communications de celui-ci avec ses clients\u00a0\u00bb<\/em>, observe la Cour.<\/p>\n<p>En outre, les tribunaux roumains <em>\u00ab\u00a0ont utilis\u00e9 les relev\u00e9s de ces communications uniquement dans la mesure o\u00f9 ils prouvaient que l\u2019int\u00e9ress\u00e9 avait utilis\u00e9 l\u2019ordinateur de sa soci\u00e9t\u00e9 \u00e0 des fins priv\u00e9es pendant les heures de travail, et l\u2019identit\u00e9 des personnes avec lesquelles il a communiqu\u00e9 n\u2019a pas \u00e9t\u00e9 divulgu\u00e9e\u00a0\u00bb<\/em>, ont relev\u00e9 les magistrats europ\u00e9ens.
