Les interlocuteurs sociaux se sont r\u00e9unis&#8230;et quitt\u00e9s aujourd&rsquo;hui sans parvenir \u00e0 un accord. La concertation semble au point mort.<!--more--><\/h1>\n<p>Les syndicats ont confi\u00e9 \u00e0 la RTBF les raisons de cet \u00e9chec. Pour Marc Goblet, secr\u00e9taire g\u00e9n\u00e9ral de la FTGB, on avait bien avanc\u00e9 sur le sens des responsabilit\u00e9<em>\u00ab\u00a0nous avons d\u00fb faire face \u00e0 des \u00e9l\u00e9ments inacceptables qui emp\u00eachent toute forme d&rsquo;action syndicale\u00a0\u00bb<\/em>. Il\u00a0estime que la question de la responsabilit\u00e9 juridique des syndicats, qui fait l&rsquo;objet d&rsquo;une proposition de loi de l&rsquo;Open VLD, s&rsquo;apparente \u00e0 un \u00ab\u00a0d\u00e9lire\u00a0\u00bb. <em>\u00ab\u00a0Il faut arr\u00eater avec \u00e7a. Les syndicats sont responsables, ils n&rsquo;appellent pas \u00e0 l&rsquo;action violente. Dans une mobilisation, il est impossible de contr\u00f4ler tout un chacun. Il est \u00e9galement apparu que certains d\u00e9bordements n&rsquo;\u00e9taient pas le fait d&rsquo;affili\u00e9s.\u00a0\u00bb<\/em><\/p>\n<p>Une position partag\u00e9e par Marie-H\u00e9l\u00e8ne Ska, son homologue \u00e0 la CSC <em>\u00ab\u00a0Il n&rsquo;y a pas d&rsquo;accord sur l&rsquo;ensemble, il n&rsquo;y a donc d&rsquo;accord sur rien.\u00a0L&rsquo;objectif est d&#8217;emp\u00eacher les travailleurs de faire valoir leurs droits, leur libert\u00e9 \u00e9l\u00e9mentaire n&rsquo;\u00e9tait pas respect\u00e9e. Les syndicats sont responsables et d&rsquo;accord pour avancer, mais du c\u00f4t\u00e9 patronal, certains continuent \u00e0 croire que tout est permis.\u00a0\u00bb<\/em><\/p>\n<p>Du c\u00f4t\u00e9 des employeurs, la FEB, l&rsquo;UCM, l&rsquo;Unizo entre autres regrettent le blocage. Ainsi, la f\u00e9d\u00e9ration des entreprises belge communique: <em>\u00ab\u00a0Nous d\u00e9plorons\u00a0de n\u2019\u00eatre pas arriv\u00e9s \u00e0 ces accords avec les syndicats. Etaient sur le table, les r\u00e8gles et proc\u00e9dures \u00e0 appliquer, les droits et obligations des travailleurs et des employeurs et la mani\u00e8re de les imposer par le biais d\u2019instruments juridiques. Seule l\u2019application de r\u00e8gles pr\u00e9cises permet de garantir la n\u00e9cessaire responsabilisation lorsque les syndicats d\u00e9cident de recourir au droit de gr\u00e8ve. Pour encadrer la responsabilit\u00e9 des syndicats en cas d\u2019actions, les employeurs proposaient de d\u00e9signer, pour chaque action, un \u2018point de contact\u2019 (qui fonctionnerait par analogie avec l\u2019\u00e9diteur responsable). Cette personne issue du syndicat et son organisation assureraient le d\u00e9roulement correct de l\u2019action et pourraient \u00eatre interpell\u00e9es en cas de d\u00e9rapages et d\u2019actes ill\u00e9gaux. Il n\u2019a donc pas \u00e9t\u00e9 possible de parvenir \u00e0 un accord. Le droit de gr\u00e8ve n\u2019est pourtant pas un droit absolu\u00a0: il cesse l\u00e0 o\u00f9 commencent d\u2019autres droits et libert\u00e9s.\u00a0\u00bb<\/em><\/p>\n<p>L&rsquo;administrateur-d\u00e9l\u00e9gu\u00e9 de la FEB, M.\u00a0Timmermans se montre pessimiste sur la possibilit\u00e9 de poursuivre les discussions. <em>\u00ab\u00a0Toutes les voies ont \u00e9t\u00e9 explor\u00e9es. Il appartient d\u00e9sormais aux autorit\u00e9s publiques de voir comment elles peuvent \u00e9viter de nouvelles actions ill\u00e9gales des syndicats.\u00a0Les n\u00e9gociations des derni\u00e8res semaines avaient pour but de montrer que les partenaires sociaux n&rsquo;acceptaient plus les d\u00e9rapages ou les action ill\u00e9gales comme les prises en otage de directions, les refus par la violence de l&rsquo;acc\u00e8s \u00e0 l&rsquo;outil de travail, le blocage des autoroutes et zones industrielles, etc. Aucune convention internationale n&rsquo;indique qu&rsquo;il est permis d&rsquo;installer des barrages routiers\u00a0\u00bb,<\/em> rappellent\u00a0les employeurs.<\/p>\n<p><em><strong>Retour \u00e0 l&rsquo;exp\u00e9diteur<\/strong><\/em><\/p>\n<p>Le Vice-premier ministre et ministre de l&rsquo;Emploi Kris Peeters (CD&amp;V) avait charg\u00e9 les partenaires sociaux d&rsquo;aboutir. Devant ce constat d&rsquo;\u00e9chec, il a vivement regrett\u00e9 mardi soir que le Groupe des dix ne soit pas parvenu \u00e0 actualiser le Gentlemen&rsquo;s agreement. Il\u00a0a pr\u00e9cis\u00e9 qu&rsquo;il prendrait contact avec les partenaires sociaux pour avoir une vision claire des points de blocage de la discussion et rendre encore une actualisation possible. Le ministre de l&rsquo;Emploi reste convaincu que la concertation sociale demeure la meilleure mani\u00e8re d&rsquo;aboutir \u00e0 cette actualisation <em>\u00ab\u00a0parce qu&rsquo;elle est dans ce cas port\u00e9e \u00e0 la fois par les employeurs et les organisations repr\u00e9sentatives des travailleurs\u00a0\u00bb<\/em>. Pour lui, un Gentlemen&rsquo;s agreement est par essence un accord entre partenaires sociaux.
