Deux \u00e9l\u00e9ments essentiels fondent le consensus entre patronat et syndicat : la simplification via la signature \u00e9lectronique des contrat et la fin de la r\u00e8gle des 48 heures qui permettait d&rsquo;officialiser apr\u00e8s le d\u00e9but des prestations.<!--more--><\/h1>\n<p>Comme les syndicats le rel\u00e8vent : \u00ab\u00a0<em>Dans ce nouvel accord, les partenaires sociaux conviennent de la suppression de la r\u00e8gle des 48 heures. Cette r\u00e8gle permettait la signature d\u2019un contrat int\u00e9rimaire jusqu\u2019\u00e0 48 heures apr\u00e8s le d\u00e9but des prestations. Elle constituait une source d\u2019ins\u00e9curit\u00e9 pour les int\u00e9rimaires et \u00e9tait \u00e0 l\u2019origine d\u2019abus : des contrats hebdomadaires transform\u00e9s en contrats journaliers ; des probl\u00e8mes en cas d\u2019accident de travail ou de maladie lors du premier jour de travail. En rendant la signature du contrat obligatoire avant le d\u00e9but de la mission de travail int\u00e9rimaire, on peut \u00e9viter ces probl\u00e8mes. C&rsquo;est une \u00e9tape importante dans le sens de la r\u00e9gulation du travail int\u00e9rimaire.\u00a0\u00bb<\/em><\/p>\n<p>&nbsp;<\/p>\n<p>Du c\u00f4t\u00e9 de Federgon, on remarque que <em>\u00ab\u00a0la signature \u00e9lectronique des contrats de travail int\u00e9rimaire constitue une \u00e9tape importante en mati\u00e8re de num\u00e9risation ainsi qu\u2019un \u00ab win-win \u00bb pour les int\u00e9rimaires et les entreprises de travail int\u00e9rimaire. Les int\u00e9rimaires pourront en effet signer leurs contrats de travail facilement \u00e0 l\u2019aide de leur smartphone ou de leur tablette ; ils recevront d\u00e9sormais leurs contrats beaucoup plus rapidement et pourront consulter tous leurs contrats d\u2019int\u00e9rim, conclus avec toutes les agences agr\u00e9\u00e9es, sur une plateforme sectorielle claire. Les entreprises de travail int\u00e9rimaire auront donc beaucoup moins de paperasserie, compte tenu de la disparition des envois, rappels et classement des contrats de travail papier. Gr\u00e2ce au \u00ab timestamp \u00bb, qui est li\u00e9 aussi bien \u00e0 l\u2019envoi qu\u2019\u00e0 la signature, une s\u00e9curit\u00e9 juridique nettement sup\u00e9rieure est garantie pour toutes les parties. Pour rendre le syst\u00e8me enti\u00e8rement viable, une solution a \u00e9galement \u00e9t\u00e9 trouv\u00e9e pour les int\u00e9rimaires ne disposant pas de smartphone ni d\u2019adresse \u00e9lectronique ni de carte d\u2019identit\u00e9 \u00e9lectronique.\u00a0\u00bb<\/em><\/p>\n<p>La f\u00e9d\u00e9ration souligne \u00e9galement que <em>\u00ab\u00a0la suppression de la r\u00e8gle des 48 heures implique qu\u2019il ne sera de fait plus possible d\u2019utiliser les contrats de travail int\u00e9rimaire papier.\u00a0\u00bb <\/em>Et d&rsquo;insister encore\u00a0aupr\u00e8s du ministre comp\u00e9tent pour qu\u2019il proc\u00e8de rapidement \u00e0 une adaptation de la loi du 24 juillet 1987, conform\u00e9ment \u00e0 l\u2019avis unanime des partenaires sociaux.<\/p>\n<p>Du c\u00f4t\u00e9 syndical, bien que l&rsquo;on reconnaisse l&rsquo;avanc\u00e9e sur le plan administratif,\u00a0on regrette <em>\u00ab\u00a0que l\u2019on n\u2019ait pas pu se mettre d\u2019accord sur un droit de regard automatique de l\u2019inspection sociale dans la base de donn\u00e9es des contrats sign\u00e9s par voie \u00e9lectronique, sans qu\u2019il ne soit n\u00e9cessaire d\u2019obtenir syst\u00e9matiquement l\u2019autorisation de l\u2019entreprise de travail int\u00e9rimaire. C\u2019est un recul pour l\u2019inspection. Actuellement, les contrats de travail des travailleurs \u00e0 temps partiel et des \u00e9tudiants (qui repr\u00e9sentent au total au minimum un tiers des int\u00e9rimaires) doivent \u00eatre pr\u00e9sents sur le lieu de l\u2019occupation. En cas de contr\u00f4le, ils sont donc imm\u00e9diatement consultables par l\u2019inspection sociale.\u00a0\u00bb <\/em>Une situation consid\u00e9r\u00e9e comme injuste et dommageable.
