Comme on peut s&rsquo;en douter, impossible d&rsquo;atteindre un compromis sur le sujet au sein du CNT. Les organisations repr\u00e9sentatives des employeurs montent la garde.<!--more--><\/h1>\n<p><em>\u00ab\u00a0L&rsquo;obligation de motivation pour chaque candidature non retenue est totalement irr\u00e9alisable pour les entreprises.\u00a0\u00bb<\/em> explique la FEB. <em>\u00ab\u00a0Inventorier les insuffisances des candidats, sans blesser inutilement et sans d\u00e9motiver, est un exercice d\u00e9licat et chronophage. Il est impossible de s\u2019y livrer pour chaque candidature non retenue. On peut aussi se demander si de telles mesures encourageront les entreprises \u00e0 recruter et \u00e0 explorer des canaux de recrutement plus larges ? Au contraire, elles favoriseront le recrutement dans les r\u00e9seaux connus, au d\u00e9triment des groupes \u00e0 risques.\u00a0\u00bb<\/em><\/p>\n<p>Oui, mais&#8230; A l&rsquo;heure o\u00f9 nos entreprises placent la marque employeur au coeur de leur strat\u00e9gie RH voire m\u00eame de leur strat\u00e9gie business, \u00e0 l&rsquo;heure o\u00f9 les outils de recrutement digitaux permettent de g\u00e9rer intelligemment les afflux de candidatures,&#8230; cette proposition de loi est-elle aussi irr\u00e9aliste que nous pourrions l&rsquo;imaginer dans un premier temps ?<\/p>\n<p>Pour rappel, la proposition\u00a0de loi\u00a0veut convertir l\u2019obligation de moyens de r\u00e9pondre aux postulants, pr\u00e9vue \u00e0 l\u2019art. 9 de la CCT n\u00b038, en une obligation de r\u00e9sultat, sanctionn\u00e9e p\u00e9nalement le cas \u00e9ch\u00e9ant. Elle\u00a0pr\u00e9voit \u00e9galement une obligation de motivation pour toutes les candidatures non retenues.<\/p>\n<p>L&rsquo;organisation patronale rappelle encore: <em>\u00ab\u00a0En 1983, les n\u00e9gociateurs de la CCT 38 n\u2019ont sciemment pas demand\u00e9 de rendre l\u2019article 9 obligatoire. Ils estimaient en effet qu\u2019une obligation de politesse imposant de r\u00e9pondre \u00e0 un postulant ne devait pas \u00eatre sanctionn\u00e9e par des sanctions p\u00e9nales. Ce raisonnement reste pertinent. Il y a 30 ans, les postulants posaient leur candidature au moyen d\u2019une lettre de candidature manuscrite, en y joignant un CV. Cela demandait beaucoup de temps et d\u2019\u00e9nergie. Depuis lors, les techniques de candidature ont fortement \u00e9volu\u00e9. Les candidatures se font \u00e0 pr\u00e9sent au moyen de lettres types, de courriels types, qui peuvent \u00eatre envoy\u00e9s \u00e0 des dizaines de destinataires d\u2019un simple clic de souris. Les postulants posent \u00e9galement de plus en plus souvent leur candidature au moyen de syst\u00e8mes en r\u00e9seau (sites web, Linkedin, Facebook, Twitter). Avec le progr\u00e8s technique, l\u2019\u00e9tat d\u2019esprit de nombre de postulants a lui aussi chang\u00e9. Ils posent leur candidature de mani\u00e8re large, afin d\u2019atteindre le plus grand nombre possible d\u2019employeurs potentiels. Tout va vite. Les candidats n\u2019attendent pas que l\u2019on r\u00e9ponde \u00e0 chacun de leurs messages. L\u2019absence de r\u00e9ponse est l\u2019\u00e9quivalent, pour eux, d\u2019une r\u00e9ponse n\u00e9gative.\u00a0\u00bb<\/em><\/p>\n<p>&nbsp;<\/p>\n<p>Et de rappeler que le flux de candidatures n&rsquo;est en aucun cas comparable avec ce que nous pouvions observer il y a plus de trente ans. Toutes les entreprises re\u00e7oivent &#8211; de mani\u00e8re proportionnelle \u00e0 leur taille &#8211; un nombre de sollicitations trop important pour \u00eatre en capacit\u00e9 d&rsquo;y r\u00e9pondre de mani\u00e8re personnalis\u00e9e. \u00ab\u00a0<em>Les employeurs fournissent d\u2019importants efforts afin de r\u00e9pondre \u00e0 toutes ces candidatures, mais il reste d\u00e9raisonnable d\u2019imposer une obligation de r\u00e9sultat \u00e0 cet \u00e9gard. Il serait disproportionn\u00e9 de sanctionner les impr\u00e9cisions ou oublis par des sanctions p\u00e9nales (ou, dans des propositions alternatives, des sanctions civiles), et, de plus, cela dissuaderait les employeurs potentiels de publier largement leurs offres d\u2019emploi.\u00a0\u00bb<\/em><\/p>\n<p>A l&rsquo;analyse, il nous appara\u00eet que la notion d&rsquo;obligation (au sens de la &lsquo;contrainte&rsquo;) constitue la pierre d&rsquo;achoppement de la proposition de loi&#8230; Car dans l&rsquo;esprit, toutes nos entreprises sont int\u00e9ress\u00e9es \u00e0 entrer en conversation avec les candidats qui la courtisent, ceux-ci incarnant vraisemblablement ses clients de demain.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Le Conseil National du Travail a \u00e9t\u00e9 amen\u00e9 \u00e0 \u00e9mettre un avis quant \u00e0 une proposition de loi introduite en juillet 2014 et visant \u00e0 instaurer l&rsquo;obligation de r\u00e9pondre aux postulants \u00e0 la recherche d&rsquo;un emploi.
