D&rsquo;apr\u00e8s le quotidien De Tijd, ce dernier envisage de r\u00e9introduire la p\u00e9riode d&rsquo;essai pour les employeurs embauchant un travailleur avec un contrat fixe.<!--more--><\/h1>\n<p>La d\u00e9cision aurait \u00e9t\u00e9 prise par les partenaires de la majorit\u00e9 lors de leurs discussions budg\u00e9taires la semaine pass\u00e9e. Les syndicats et les organisations patronales auraient jusqu&rsquo;au 30 septembre pour donner leur avis ou formuler une solution alternative, rapporte encore De Tijd. Les partenaires sociaux ne manqueront pas d&rsquo;exprimer leurs r\u00e9actions d\u00e8s les prochains jours.<\/p>\n<p>La p\u00e9riode d&rsquo;essai, au cours de laquelle un licenciement n&rsquo;\u00e9tait pas assorti d&rsquo;indemnit\u00e9s, a \u00e9t\u00e9 supprim\u00e9e en 2014, dans le cadre de l&rsquo;introduction du statut unique. Depuis lors, comme nous l&rsquo;avons relev\u00e9 \u00e0 l&rsquo;occasion de nos groupes de travail &lsquo;Workforce Agility&rsquo;, c&rsquo;est le statut int\u00e9rimaire qui a pris le relais de la traditionnelle p\u00e9riode d&rsquo;essai.<\/p>\n<p>Les r\u00e9actions du c\u00f4t\u00e9 syndical n&rsquo;est bien entendu pas tra\u00een\u00e9. La CSC pr\u00e9vient quant \u00e0 la rupture possible de l\u2019\u00e9quilibre d\u00e9licat du statut unique. \u00ab\u00a0<em>Le gouvernement aurait d\u00e9cid\u00e9, lors du contr\u00f4le budg\u00e9taire, que les partenaires sociaux devraient rendre un avis sur la r\u00e9introduction de la p\u00e9riode d\u2019essai avant le 30 septembre. Les journaux ajoutent qu\u2019il se dirait dans les milieux gouvernementaux que le gouvernement prendrait les choses en main si les interlocuteurs sociaux n\u2019arrivent pas \u00e0 rendre un avis. Les employeurs, quant \u00e0 eux, se comportent d\u00e9j\u00e0 comme si la r\u00e9introduction de la p\u00e9riode d\u2019essai \u00e9tait acquise.\u00a0Avec ce gouvernement lib\u00e9ral, de droite, nous savons ce que cela signifie. Dans ces conditions, on ne peut pas parler de concertation\u00a0\u00bb<\/em> r\u00e9agit Mathieu Verjans, secr\u00e9taire national de la CSC.<em> \u00ab\u00a0Ce sont les employeurs qui dictent sa conduite au gouvernement\u00a0\u00bb<\/em>.<\/p>\n<p><em>\u00ab\u00a0Une \u00e9valuation ne nous pose aucun probl\u00e8me\u00a0\u00bb<\/em>, d\u00e9clare Mathieu Verjans, <em>\u00ab\u00a0mais elle doit \u00eatre effectu\u00e9e en toute honn\u00eatet\u00e9 intellectuelle. Depuis plus d\u2019un an, les employeurs avancent l\u2019argument fallacieux selon lequel les entreprises pr\u00e9f\u00e8rent engager des travailleurs int\u00e9rimaires depuis la suppression de la p\u00e9riode d\u2019essai. Or, les employeurs recouraient d\u00e9j\u00e0 massivement au travail int\u00e9rimaire avant le statut unique. De plus, on ne constate aucune augmentation significative du travail int\u00e9rimaire suite \u00e0 la suppression de la p\u00e9riode d\u2019essai. M\u00eame l\u2019employeur le plus important du secteur int\u00e9rimaire r\u00e9fute cet argument. Malgr\u00e9 cela, des absurdit\u00e9s telles que celles-l\u00e0 sont prof\u00e9r\u00e9es pour \u00e0 nouveau faire peser sur les personnes qui recherchent un emploi l\u2019ins\u00e9curit\u00e9 qu\u2019engendre une p\u00e9riode d\u2019essai. La CSC continuera \u00e0 s\u2019opposer \u00e0 l\u2019id\u00e9e que les travailleurs sont des produits jetables\u00a0\u00bb.<\/em><\/p>\n<p>La CSC tient aussi \u00e0 mettre en garde concernant le p\u00e9ril qui plane sur l\u2019\u00e9quilibre d\u00e9licat du statut unique entre ouvriers et employ\u00e9s. <em>\u00ab\u00a0L\u2019exercice d\u2019\u00e9quilibre qu\u2019est le statut unique a pr\u00e9vu de larges compensations financi\u00e8res pour les employeurs. La suppression de la p\u00e9riode d\u2019essai est mise dans la balance avec les d\u00e9lais de pr\u00e9avis particuli\u00e8rement courts pendant la premi\u00e8re ann\u00e9e apr\u00e8s l\u2019embauche (2 semaines au cours des trois premiers mois, 4 semaines au cours des trois mois suivants, \u2026). Les employeurs se servent \u00e0 pr\u00e9sent du gouvernement pour rompre unilat\u00e9ralement cet \u00e9quilibre et obtenir gain de cause.
