Qui a droit au reclassement professionnel, qui supporte le co\u00fbt de l&rsquo;outplacement, quelle est l&rsquo;utilit\u00e9 de l&rsquo;accompagnement via outplacement&#8230; Le groupe Ascento propose de rectifier les incompr\u00e9hensions potentielles via un livre blanc.<!--more--><\/p>\n<p>Le livre blanc complet contenant entre autres de plus amples informations sur les circonstances dans lesquelles un employeur est tenu de proposer un reclassement professionnel\u00a0r\u00e9pond notamment \u00e0 huit questions r\u00e9currentes relatives \u00e0 la proc\u00e9dure d&rsquo;outplacement.<\/p>\n<p><strong><em>1. Qui finance l&rsquo;outplacement?<\/em><\/strong><br \/>\nC&rsquo;est l&#8217;employeur qui supporte les frais li\u00e9s au reclassement professionnel. Ce n\u2019est qu\u2019en cas de licenciement dans le cadre du r\u00e9gime g\u00e9n\u00e9ral avec indemnit\u00e9 de pr\u00e9avis qui compense au moins 30 semaines de d\u00e9lai de pr\u00e9avis, que le co\u00fbt de l\u2019outplacement peut \u00eatre r\u00e9cup\u00e9r\u00e9 (g\u00e9n\u00e9ralement de mani\u00e8re partielle) par la retenue de quatre semaines d\u2019indemnit\u00e9s de pr\u00e9avis.<\/p>\n<p><strong><em>2. Quand l&rsquo;outplacement commence-t-il?<\/em><\/strong><br \/>\nDans le r\u00e9gime g\u00e9n\u00e9ral, le trajet d&rsquo;outplacement doit \u00eatre propos\u00e9 dans les 4 semaines du d\u00e9but du d\u00e9lai de pr\u00e9avis. Cette disposition s&rsquo;explique par plusieurs raisons. Primo, la recherche d&rsquo;un nouvel emploi porte plus ais\u00e9ment ses fruits lorsque le travailleur n&rsquo;est pas encore ch\u00f4meur. Secundo, l\u2019accompagnement de r\u00e9orientation professionnelle permet au travailleur de se distancier de son travail et de l&rsquo;entreprise. Enfin, les travailleurs plus \u00e2g\u00e9s gagnent du temps gr\u00e2ce \u00e0 cet accompagnement pr\u00e9coce, de sorte que leur \u00e2ge joue moins en leur d\u00e9faveur. De plus, le travailleur peut b\u00e9n\u00e9ficier d&rsquo;un contre-pr\u00e9avis une fois qu\u2019il a trouv\u00e9 un nouvel emploi.\u00a0Cet accompagnement pr\u00e9coce pr\u00e9sente l&rsquo;inconv\u00e9nient de ne pas toujours encourager les travailleurs non motiv\u00e9s \u00e0 retrouver du travail. Ces derniers pr\u00e9f\u00e8rent le confort d&rsquo;un long d\u00e9lai de pr\u00e9avis \u00e0 l&rsquo;avenir incertain dans un nouvel environnement de travail. Ils craignent en outre souvent de ne pas retrouver un emploi ou de ne trouver qu&rsquo;un emploi assorti de conditions moins attrayantes.<\/p>\n<p><strong><em>3. L&#8217;employeur doit-il proposer un outplacement \u00e0 un travailleur qui quitte l\u2019entreprise dans le cadre du r\u00e9gime de ch\u00f4mage avec compl\u00e9ment d\u2019entreprise (\u2018pr\u00e9pension\u2019)?<\/em><\/strong><br \/>\nOn distingue deux situations. Dans la premi\u00e8re, le travailleur est licenci\u00e9 individuellement. Il reste en &lsquo;disponibilit\u00e9 adapt\u00e9e&rsquo; sur le march\u00e9 du travail, jusqu\u2019\u00e0 l&rsquo;\u00e2ge de la pension l\u00e9gale (65 ans). Dans ce cas, le travailleur a droit au reclassement professionnel. Une exception peut \u00eatre demand\u00e9e pour la &lsquo;disponibilit\u00e9 adapt\u00e9e&rsquo; \u00e0 partir de 60 ans, \u00e0 la condition que le travailleur ait 40 ans de carri\u00e8re professionnelle. Dans la seconde hypoth\u00e8se, le travailleur est victime d&rsquo;un licenciement collectif et il n&rsquo;a pas encore atteint l&rsquo;\u00e2ge l\u00e9gal de la pr\u00e9pension. Dans ce cas, l&#8217;employeur doit obligatoirement pr\u00e9voir un accompagnement par outplacement et le travailleur est tenu de le suivre.<\/p>\n<p><strong><em>4. Dans l&rsquo;hypoth\u00e8se o\u00f9 l&#8217;employeur met fin au contrat de travail durant le d\u00e9lai de pr\u00e9avis et propose une indemnit\u00e9 de licenciement pour la p\u00e9riode restant \u00e0 courir, peut-il encore proc\u00e9der \u00e0 la retenue de 4 semaines d&rsquo;indemnit\u00e9 de pr\u00e9avis?<\/em><\/strong><br \/>\nL&#8217;employeur a le droit de proc\u00e9der \u00e0 la retenue de 4 semaines d&rsquo;indemnit\u00e9 de pr\u00e9avis lorsque la rupture du contrat est post\u00e9rieure au 1er janvier 2016. L&rsquo;ONEM a \u00e9labor\u00e9 une formule pratique pour le calcul par l&#8217;employeur du nombre de jours qu&rsquo;il peut l\u00e9galement retenir sur l&rsquo;indemnit\u00e9.<\/p>\n<p><strong><em>5. Le travail int\u00e9rimaire compte-t-il aussi dans le calcul du droit \u00e0 l&rsquo;outplacement?<\/em><\/strong><br \/>\nDans l&rsquo;hypoth\u00e8se o\u00f9 l&#8217;employeur licencie un travailleur ayant travaill\u00e9 initialement comme int\u00e9rimaire, une disposition sp\u00e9ciale est d&rsquo;application, par laquelle la dur\u00e9e de travail comme int\u00e9rimaire entre en ligne de compte pour le calcul de l&rsquo;anciennet\u00e9 (1 an maximum) aupr\u00e8s du nouvel employeur. Trois conditions sont toutefois d&rsquo;application: l&#8217;embauche par le nouvel employeur doit \u00eatre post\u00e9rieure au travail int\u00e9rimaire, la fonction exerc\u00e9e chez le nouvel employeur doit \u00eatre identique \u00e0 celle exerc\u00e9e comme int\u00e9rimaire, et le travailleur int\u00e9rimaire ne peut \u00eatre rest\u00e9 inactif pendant plus de 7 jours.<\/p>\n<p><strong><em>6. L&#8217;employeur peut-il malgr\u00e9 tout proc\u00e9der \u00e0 la retenue de 4 semaines d&rsquo;indemnit\u00e9 de pr\u00e9avis lorsque le travailleur retrouve du travail plus rapidement?<\/em><\/strong><br \/>\nL&#8217;employeur retient l&rsquo;indemnit\u00e9 de pr\u00e9avis \u00e0 la fin du contrat de travail. En principe, le moment o\u00f9 le travailleur retrouve du travail n&rsquo;a donc pas d&rsquo;importance.<\/p>\n<p><strong><em>7. Faut-il proposer l&rsquo;outplacement en cas de force majeure m\u00e9dicale?<\/em><\/strong><br \/>\nTout d&rsquo;abord, le travailleur doit \u00eatre licenci\u00e9 pour avoir droit \u00e0 l&rsquo;outplacement. Certains cas n&rsquo;entrent donc pas en ligne de compte pour le reclassement professionnel. En cas de force majeure m\u00e9dicale, le travailleur n&rsquo;a d\u00e8s lors pas droit \u00e0 l&rsquo;outplacement. C&rsquo;est \u00e9galement le cas des travailleurs qui mettent fin de leur propre initiative au contrat de travail, dont le contrat de travail prend fin de commun accord ou qui travaillent dans le cadre d&rsquo;un contrat \u00e0 dur\u00e9e d\u00e9termin\u00e9e.<\/p>\n<p><strong><em>8. Les jeunes travailleurs se voient-ils aussi proposer un accompagnement par outplacement?<\/em><\/strong><br \/>\nTous les travailleurs licenci\u00e9s ont droit \u00e0 60 heures d&rsquo;accompagnement durant une p\u00e9riode de 12 mois.
