Les modalit\u00e9s de mise en oeuvre de l&rsquo;annualisation du temps de travail sont connues d\u00e9sormais. Mais les syndicats veillent au grain et commencent d\u00e8s \u00e0 pr\u00e9sent \u00e0 mobiliser autour des dangers qu&rsquo;ils d\u00e9tectent dans ce projet de loi. Passons les arguments syndicaux en revue.<!--more--><\/p>\n<p>Pour la CSC, des probl\u00e8mes importants subsistent :\u00a0<em>\u00ab\u00a0les employeurs peuvent, unilat\u00e9ralement, annualiser la dur\u00e9e du travail et\/ou relever le nombre d\u2019heures suppl\u00e9mentaires que l\u2019on peut accumuler avant de pouvoir b\u00e9n\u00e9ficier de repos compensatoire \u00e0 143 heures.\u00a0Ils\u00a0peuvent devoir prester 100 heures suppl\u00e9mentaires sans repos compensatoire, ce qui met fin au maximum de 38h\/semaine en moyenne. Les secteurs peuvent m\u00eame accepter de porter ce maximum \u00e0 plus de 45h\/semaine. Enfin, les sanctions pour efforts sectoriels insuffisants en mati\u00e8re de formation sont supprim\u00e9es. Un droit (virtuel ?) \u00e0 deux jours de formation est pr\u00e9vu mais pour les seules entreprises de plus de 10 travailleurs.\u00a0\u00bb<\/em><\/p>\n<p>La CSC rel\u00e8ve \u00e9galement le caract\u00e8re probl\u00e9matique de la situation : <em>\u00ab\u00a0le gouvernement avait pr\u00e9sent\u00e9 le travail faisable comme une mesure permettant de travailler plus longtemps dans des meilleures conditions. Or, comment un allongement de la dur\u00e9e de travail hebdomadaire ou une flexibilisation plus importante impos\u00e9e par l\u2019employeur peut-il contribuer \u00e0 favoriser la qualit\u00e9 de l\u2019emploi? Et comment ces mesures permettront-elles d\u2019offrir plus de chances aux laiss\u00e9s-pour-compte de d\u00e9crocher un emploi ?\u00a0\u00bb<\/em><\/p>\n<p>La CGSLB, quant \u00e0 elle, rel\u00e8ve que les textes provisoires transmis au Groupe des Dix par le gouvernement contiennent plus de dispositions relatives au travail maniable qu\u2019au travail faisable et d\u00e9plore que le gouvernement mette trop l\u2019accent sur la flexibilit\u00e9 unilat\u00e9rale.. <em>\u00ab\u00a0Le contraste avec une meilleure combinaison vie priv\u00e9e\/vie professionnelle ainsi qu\u2019une fin de carri\u00e8re tenable est assez frappant. La concertation sociale doit pouvoir jouer pleinement son r\u00f4le au niveau interprofessionnel, mais aussi aux niveaux des secteurs et des entreprises. Une annualisation impos\u00e9e de la dur\u00e9e de travail, ainsi que le nouveau cr\u00e9dit de 100 heures suppl\u00e9mentaires, sont des mesures qui ne vont certainement pas dans la bonne direction. La formation reste fondamentale dans un march\u00e9 du travail en \u00e9volution permanente. Dans l\u2019avant-projet, il est question d\u2019un r\u00f4le important pour les secteurs. Nous d\u00e9plorons cependant l\u2019absence de m\u00e9canisme de sanction, de m\u00eame que le fait que les entreprises comptant moins de 10 travailleurs sont exclues de ce droit.\u00a0\u00bb<\/em><\/p>\n<p>Les deux organisations syndicales insistent enfin sur le timing choisi par le gouvernement&#8230; Manque de clairvoyance ou tentative de passage en force ?\u00a0Les partenaires sociaux rappelle <em>\u00ab\u00a0qu&rsquo;ils ont besoin de temps pour examiner les textes et n\u00e9gocier, ce qui est plus difficile en cette p\u00e9riode estivale.\u00a0\u00bb \u00a0<\/em>Fort probable donc que &#8230; rien ne se passe dans l&rsquo;imm\u00e9diat mais pr\u00e9parons nous pour une rentr\u00e9e qui promet sur le plan social&#8230;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>La sortie r\u00e9cente du projet de loi relative au &lsquo;travail faisable&rsquo; devait profiter de l&rsquo;accalmie relative que repr\u00e9sentent les vacances.
