L\u2019un d\u2019entre eux attire notre attention aujourd\u2019hui sur les principes \u00e0 appliquer quant au payement de la r\u00e9mun\u00e9rations des travailleurs \u00ab emp\u00each\u00e9s \u00bb&#8230;<!--more--><\/div>\n<p><em>\u00ab Les entreprises, confront\u00e9es cet hiver \u00e0 un d\u00e9lestage du r\u00e9seau \u00e9lectrique, vont rencontrer des difficult\u00e9s \u00bb<\/em> pr\u00e9cise le communiqu\u00e9. <em>\u00ab Non seulement en raison des coupures, mais aussi au niveau de l\u2019emploi : elles devront v\u00e9rifier s\u2019il est question de force majeure, s\u2019il faut payer un salaire garanti dans certains cas, s\u2019il faut convenir avec le personnel de prendre cong\u00e9 les jours d\u2019interruption de courant ou s\u2019il faut \u00e9ventuellement adapter les horaires de travail. Dans ce dernier cas, le r\u00e8glement de travail doit \u00eatre adapt\u00e9. \u00bb<\/em><\/p>\n<p>Le plan de d\u00e9lestage pr\u00e9vu par le l\u00e9gislateur impactera les r\u00e9gions de mani\u00e8re altern\u00e9e pour une dur\u00e9e qui ne devrait pas exc\u00e9der trois heures et qui devrait par ailleurs intervenir aux moments o\u00f9 la consommation d\u2019\u00e9nergie est la plus grande, \u00e0 savoir entre 17 et 21 heures. Plusieurs cas de figure sont envisageables en mati\u00e8re d\u2019emploi, comme le mentionnent les experts du secr\u00e9tariat social SDWorx.<\/p>\n<h2>Cas de force majeure?<\/h2>\n<p>On parle de force majeure lorsqu\u2019un \u00e9v\u00e9nement soudain et impr\u00e9visible a lieu et qu\u2019il est ind\u00e9pendant de la volont\u00e9 des parties concern\u00e9es. M\u00eame si les interruptions de courant sont annonc\u00e9es \u00e0 l\u2019avance, on peut encore parler de force majeure. Le d\u00e9lestage est en effet \u2018impr\u00e9visible\u2019 lorsque l\u2019employeur n\u2019est pas en \u00e9tat de prendre \u00e0 temps les mesures n\u00e9cessaires. Il doit par exemple prouver qu\u2019il n\u2019y avait pas de possibilit\u00e9 de travailler \u00e0 la maison, de donner d\u2019autres t\u00e2ches \u00e0 ses travailleurs, de changer les horaires de travail ou d\u2019activer des g\u00e9n\u00e9rateurs. L\u2019employeur doit \u00e9galement informer \u00e0 temps ses travailleurs.<br \/>\nDans ce cas, l\u2019employeur peut invoquer le ch\u00f4mage temporaire pour la perte d\u2019une journ\u00e9e compl\u00e8te de travail. Les travailleurs ont alors droit \u00e0 une allocation de ch\u00f4mage. Ce sont surtout les entreprises avec des \u00e9quipes du soir qui pourraient invoquer la force majeure car le d\u00e9lestage aurait lieu entre 17 et 21 heures.<\/p>\n<h2>Salaire garanti?<\/h2>\n<p>Si certaines heures ont \u00e9t\u00e9 prest\u00e9es lors d\u2019une journ\u00e9e o\u00f9 une interruption de courant a \u00e9t\u00e9 annonc\u00e9e, l\u2019employeur ne peut pas invoquer le ch\u00f4mage temporaire pour cette journ\u00e9e. On applique, dans ce cas, les r\u00e8gles de la \u2018journ\u00e9e de travail incompl\u00e8te\u2019. Si l\u2019employeur ne peut offrir d\u2019alternative de travail, il doit renvoyer pr\u00e9matur\u00e9ment ses travailleurs \u00e0 la maison. Un salaire journalier garanti est alors d\u00fb pour cette journ\u00e9e.<\/p>\n<h2>Prendre cong\u00e9?<\/h2>\n<p>Tant que les jours de vacances n\u2019ont pas \u00e9t\u00e9 fix\u00e9s collectivement au niveau du secteur ou de l\u2019entreprise, un employeur peut s\u2019accorder avec ses collaborateurs qu\u2019ils prennent cong\u00e9 le jour de l\u2019interruption de courant. Cela doit se faire en concertation, car l\u2019employeur ne peut pas imposer unilat\u00e9ralement \u00e0 ses travailleurs de prendre un (demi-)jour de vacances.<\/p>\n<h2>Adapter les horaires de travail?<\/h2>\n<p>Les employeurs ne peuvent pas faire travailler leurs collaborateurs en dehors des horaires de travail repris dans le r\u00e8glement de travail. Pour un jour de panne de courant, une entreprise ayant des horaires de travail flexibles peut essayer de remplir de mani\u00e8re optimale une journ\u00e9e de travail en utilisant un horaire de travail existant tombant en dehors de la p\u00e9riode d\u2019interruption \u00e9lectrique. Ceci doit \u00e0 nouveau se faire en concertation avec les travailleurs.
