Sa candidature fut rejet\u00e9e au motif que l\u2019employeur recherchait \u00ab comme pr\u00e9cis\u00e9 dans l\u2019annonce [\u2026] une assistante administrative, de sexe f\u00e9minin \u00bb.<\/p>\n<p>Le candidat a sollicit\u00e9 l\u2019Institut pour l\u2019\u00e9galit\u00e9 des femmes et des hommes qui, apr\u00e8s avoir tent\u00e9 vainement de trouver une solution par le biais d\u2019une conciliation, a introduit l\u2019affaire en justice.<\/p>\n<p>Le tribunal du travail de Bruxelles a condamn\u00e9, conform\u00e9ment \u00e0 la loi du 10 mai 2007 tendant \u00e0 lutter contre la discrimination entre les femmes et les hommes, l\u2019employeur \u00e0 payer une indemnisation financi\u00e8re de 5.308,59\u20ac, l\u2019\u00e9quivalent \u00e0 trois mois de r\u00e9mun\u00e9ration brute, \u00e0 la victime et une indemnit\u00e9 de 1\u20ac symbolique \u00e0 l\u2019Institut.<\/p>\n<p><strong><em>Les discriminations dans l\u2019acc\u00e8s \u00e0 l\u2019emploi<\/em><\/strong><\/p>\n<p>Pour le directeur de l\u2019Institut, Michel Pasteel, cette affaire illustre l\u2019ampleur des st\u00e9r\u00e9otypes dans notre soci\u00e9t\u00e9 : <em>\u00ab\u00a0Trop souvent encore le sexe des candidat-e-s, qu\u2019ils soient hommes ou femmes, est encore per\u00e7u comme le reflet de leur comp\u00e9tences professionnelles. Bien que les caract\u00e9ristiques fond\u00e9es sur le sexe ne peuvent pas \u00eatre utilis\u00e9es pour exclure un candidat, on constate encore chez certains employeurs des convictions selon lesquelles un homme ou une femme est plus ou moins indiqu\u00e9-e pour exercer une certaine fonction\u00a0\u00bb.<\/em><\/p>\n<p>Les signalements introduits aupr\u00e8s de l\u2019Institut confirment l\u2019ampleur du ph\u00e9nom\u00e8ne. Le travail est le domaine o\u00f9 les discriminations sont les plus courantes. Ce sont principalement des femmes qui en sont victimes, m\u00eame si, comme cette affaire le montre, des hommes sont parfois \u00e9galement concern\u00e9s. Plus d\u2019un signalement sur 3 est li\u00e9 au recrutement et \u00e0 la s\u00e9lection (37%).
