









{"id":4196,"date":"2017-03-31T14:16:01","date_gmt":"2017-03-31T12:16:01","guid":{"rendered":"http:\/\/www.peoplesphere.be\/fr\/?p=4196"},"modified":"2017-03-31T14:16:01","modified_gmt":"2017-03-31T12:16:01","slug":"reintegration-travail-csc-degoutee-principe-de-sanction-infligee-aux-malades-de-longue-duree","status":"publish","type":"post","link":"https:\/\/peoplesphere.be\/fr\/reintegration-travail-csc-degoutee-principe-de-sanction-infligee-aux-malades-de-longue-duree\/","title":{"rendered":"R\u00e9int\u00e9gration au travail : la CSC d\u00e9go\u00fbt\u00e9e par le principe de sanction inflig\u00e9e aux malades de longue dur\u00e9e."},"content":{"rendered":"<p><em>\u00ab\u00a0Une d\u00e9cision abjecte et purement budg\u00e9taire qui hypoth\u00e8que l\u2019approche constructive adopt\u00e9e ces derniers mois \u00e0 propos de la r\u00e9int\u00e9gration des malades de longue dur\u00e9e&#8230;\u00a0\u00bb<\/em> Voici comment la CSC caract\u00e9rise la d\u00e9cision de gouvernement contraignant les malades de longue dur\u00e9e \u00e0 collaborer aux parcours de r\u00e9int\u00e9gration sous peine d\u2019encourir des sanctions financi\u00e8res.<!--more--><\/p>\n<p><em>\u00ab\u00a0Les sanctions inflig\u00e9es aux malades de longue dur\u00e9e sont d\u00e9s\u00e9quilibr\u00e9es et n\u00e9fastes pour leur r\u00e9int\u00e9gration au travail\u00a0\u00bb<\/em>, explique le syndicat chr\u00e9tien. <em>\u00ab\u00a0De plus, le gouvernement se montre une fois de plus extr\u00eamement disproportionn\u00e9 et injuste envers les travailleurs.\u00a0\u00bb<\/em><\/p>\n<p>La r\u00e9glementation actuelle, instaur\u00e9e il y a deux mois seulement, offre aux malades de longue dur\u00e9e des possibilit\u00e9s de r\u00e9int\u00e9grer l\u2019entreprise gr\u00e2ce \u00e0 un travail adapt\u00e9 ou \u00e0 un autre emploi. La d\u00e9marche doit toutefois s\u2019op\u00e9rer sur une base volontaire car la r\u00e9int\u00e9gration de malades de longue dur\u00e9e est un processus particuli\u00e8rement d\u00e9licat. <em>\u00ab\u00a0Elle concerne en effet les malades qui s\u2019engagent dans ce processus pendant leur maladie en vue de leur revalidation. Un processus qui permet de proposer une fonction totalement diff\u00e9rente, avec des bar\u00e8mes diff\u00e9rents, d\u2019autres conditions de travail et d\u2019autres avantages financiers. Intervenir dans ce processus en imposant des sanctions aux malades est une d\u00e9marche particuli\u00e8rement d\u00e9s\u00e9quilibr\u00e9e qui perturbe profond\u00e9ment le cadre serein dans lequel la concertation entre les parties concern\u00e9es (travailleur, employeur, m\u00e9decin du travail) peut se d\u00e9rouler afin de favoriser une r\u00e9int\u00e9gration volontaire et de qualit\u00e9.\u00a0\u00bb<\/em><\/p>\n<p>Ces r\u00e8gles \u2013 qui ne sont en vigueur que depuis quelques mois \u2013 ont \u00e9t\u00e9 d\u00e9termin\u00e9es sur la base d\u2019une succession d\u2019accords conclus entre les organisations patronales et les syndicats. <em>\u00ab\u00a0Les ministres Peeters et De Block s\u2019\u00e9taient d\u2019ailleurs alors exprim\u00e9s en termes positifs sur ces accords. L\u2019ensemble du gouvernement balaie d\u00e9sormais ces accords d\u2019un revers de la main. Alors qu\u2019il n\u2019a de cesse de pr\u00f4ner la concertation, il tarde \u00e0 joindre le geste \u00e0 la parole.\u00a0\u00bb<\/em><\/p>\n<p><em>\u00ab\u00a0Relevons, dans la d\u00e9cision du gouvernement, le d\u00e9s\u00e9quilibre \u00e9norme entre la responsabilit\u00e9 des travailleurs et celle des employeurs. Le volet sanctions des travailleurs ne laisse aucune place \u00e0 l\u2019imagination. Lorsque le travailleur ne respecte pas les obligations administratives sans motivation, il perd 5% de son indemnit\u00e9. Lorsqu\u2019il est absent \u00e0 un entretien de r\u00e9int\u00e9gration, il en perd 10%.\u00a0En revanche, les employeurs qui ne collaborent pas \u00e0 la r\u00e9int\u00e9gration des travailleurs malades de longue dur\u00e9e s\u2019en tirent plut\u00f4t bien. Rappelons que le deuxi\u00e8me mois de salaire garanti, qui figurait dans l\u2019accord de gouvernement, a \u00e9t\u00e9 jet\u00e9 au rebut apr\u00e8s les g\u00e9missements des employeurs. Il a d\u2019abord \u00e9t\u00e9 report\u00e9 avant d\u2019\u00eatre abandonn\u00e9.\u00a0\u00bb<\/em><\/p>\n<p>La CSC poursuit son analyse : \u00ab\u00a0<em>L\u2019obligation annonc\u00e9e de verser 10% de l\u2019indemnit\u00e9 de maladie pendant les six premiers mois de convalescence de leurs travailleurs a subitement disparu. Elle est remplac\u00e9e par un syst\u00e8me qui pourrait d\u00e9boucher, dans des cas tr\u00e8s exceptionnels, sur une sanction pour les employeurs manifestement r\u00e9ticents. Mais, pour aboutir \u00e9ventuellement \u00e0 une amende administrative, il faudra que l\u2019inspection Contr\u00f4le du Bien-\u00eatre au Travail r\u00e9dige un proc\u00e8s-verbal et que le tribunal du travail soit saisi. Le r\u00e9cent rapport annuel de l\u2019inspection (2012) atteste des effectifs limit\u00e9s des inspecteurs. Ils sont juste assez nombreux pour contr\u00f4ler toutes les entreprises tous les 21,5 ans.<\/em><\/p>\n<p><em>Dans ce cadre, 42% des visites d\u00e9bouchent sur un constat d\u2019infraction. Le dernier rapport annuel fait \u00e9tat d\u2019\u00e0 peine 705 proc\u00e8s-verbaux \u00e9tablis pour l\u2019ensemble des infractions \u00e0 la Loi sur le Bien-\u00eatre au Travail et de seulement 130 amendes ou r\u00e8glements \u00e0 l\u2019amiable effectivement impos\u00e9s par des tribunaux. Cette d\u00e9cision gouvernementale semble avoir \u00e9t\u00e9 con\u00e7ue pour ne jamais \u00eatre op\u00e9rationnelle vis-\u00e0-vis des employeurs. En outre, cette r\u00e9glementation ne s\u2019applique pas aux PME. Pour les travailleurs, toutefois, elle implique une diminution lin\u00e9aire drastique de leurs allocations !<\/em><\/p>\n<p><em>Ce gouvernement lib\u00e9ral de droite est impitoyable envers les travailleurs malades et tr\u00e8s compatissant envers les employeurs.<\/em><\/p>\n<p><em>L\u2019autre d\u00e9cision du gouvernement visant \u00e0 r\u00e9aliser de nouvelles \u00e9conomies sur le cr\u00e9dit-temps est tout aussi regrettable. C\u2019est une nouvelle insulte \u00e0 l\u2019objectif de \u00ab travail faisable \u00bb. Dans l\u2019intervalle, le gouvernement tergiverse depuis des mois autour de la mise en \u0153uvre d\u2019une nouvelle CCT que les partenaires sociaux ont conclue en d\u00e9cembre 2016.
