Elle impose de nouvelles r\u00e8gles aux travailleurs qui souhaitent prendre un cr\u00e9dit-temps ou un emploi de fin de carri\u00e8re. Le cr\u00e9dit-temps sans motif appartiendra d\u00e9finitivement au pass\u00e9, mais les travailleurs pourront, d\u00e8s que l&rsquo;arr\u00eat\u00e9 royal entrera en vigueur, prendre 51 mois de cr\u00e9dit-temps avec allocation pour motif de soins. La FEB exprime sa satisfaction face \u00e0 un choix de soci\u00e9t\u00e9 pos\u00e9 depuis longtemps d\u00e9j\u00e0 et qui entre enfin dans la pratique r\u00e9glement\u00e9e.<!--more--><\/p>\n<p>Monica De Jonghe, premier conseiller \u00e0 la F\u00e9d\u00e9ration des entreprises de Belgique (FEB), explique : <em>\u00ab\u00a0Il a enfin \u00e9t\u00e9 mis un terme au cr\u00e9dit-temps sans motif. Alors que l&rsquo;AR de d\u00e9cembre 2014 avait supprim\u00e9 l&rsquo;allocation pour cette forme de cr\u00e9dit-temps, il \u00e9tait toujours possible de le prendre sans allocation. Cela revient \u00e0 une sorte de cong\u00e9 sans solde que votre employeur ne peut vous refuser et qui limite la possibilit\u00e9, pour un coll\u00e8gue, de prendre un cong\u00e9 pour motif de soins par exemple. L&rsquo;AR en question avait \u00e9galement fait passer le cr\u00e9dit-temps pour motif de soins de 36 \u00e0 48 mois. A la lumi\u00e8re de la d\u00e9cision du gouvernement, qui doit encore \u00eatre transpos\u00e9e dans un AR, les partenaires sociaux ont convenu d&rsquo;\u00e9tendre \u00e0 51 mois le droit au cr\u00e9dit-temps pour motif de soins.\u00a0\u00bb<\/em><\/p>\n<p>La f\u00e9d\u00e9ration patronale rel\u00e8ve encore : <em>\u00ab\u00a0L&rsquo;extension de ce droit est toutefois assortie de quelques modalit\u00e9s suppl\u00e9mentaires. Les m\u00e9decins traitants de personnes gravement malades n\u00e9cessitant des soins sont responsabilis\u00e9s via une modification du contenu du certificat m\u00e9dical. D\u00e9sormais, le m\u00e9decin traitant devra attester qu&rsquo;il est n\u00e9cessaire que le membre de la famille prenne un cong\u00e9 pour soins \u00e0 temps plein, mi-temps ou 1\/5 pour soutenir la personne gravement malade en vue de son r\u00e9tablissement, en plus d&rsquo;un soutien professionnel \u00e9ventuel.<\/em><\/p>\n<p><em>Les partenaires sociaux ont \u00e9galement rendu cette forme de cr\u00e9dit-temps accessible non seulement aux personnes mari\u00e9es, mais aussi aux cohabitants l\u00e9gaux. Cela permet de suivre les tendances soci\u00e9tales. Alors que le nombre de mariages a baiss\u00e9 de plus d&rsquo;un tiers au cours des 25 derni\u00e8res ann\u00e9es, le nombre de couples ayant opt\u00e9 pour la cohabitation l\u00e9gale a quintupl\u00e9 (SPF Economie).\u00a0\u00bb<\/em><\/p>\n<p>Pour l&rsquo;instant, les employeurs et les syndicats ne touchent pas aux emplois de fin de carri\u00e8re. Ainsi, un travailleurs \u00e2g\u00e9 de 55 ans et ayant une carri\u00e8re d&rsquo;au moins 25 ans peut d\u00e9cider de travailler moins, mais sans allocation. Le gouvernement a relev\u00e9 \u00e0 60 ans l&rsquo;\u00e2ge pour pouvoir b\u00e9n\u00e9ficier d&rsquo;une allocation, sauf pour les r\u00e9gimes d&rsquo;exception assortis de conditions d&rsquo;\u00e2ge en fonction d&rsquo;un calendrier ou la CCT cadre, qui maintient encore \u00e0 55 ans la limite d&rsquo;\u00e2ge pour la p\u00e9riode 2017-2018. Il faut toutefois savoir que pour prouver le pass\u00e9 professionnel de 25 ans, la d\u00e9claration sur l&rsquo;honneur sera remplac\u00e9e par un calcul pr\u00e9cis et un contr\u00f4le par l&rsquo;ONEM.<\/p>\n<p>Monica De Jonghe souligne par ailleurs que l\u2019all\u00e9gement des carri\u00e8res n\u2019entra\u00eene pas automatiquement leur allongement, alors que c\u2019est pr\u00e9cis\u00e9ment essentiel pour garantir la payabilit\u00e9 de la s\u00e9curit\u00e9 sociale \u00e0 long terme. D\u00e9velopper le travail sur mesure, o\u00f9 l&rsquo;on cherche des solutions cr\u00e9atives dans l&rsquo;int\u00e9r\u00eat tant de l&#8217;employeur que du travailleur, permet de rendre le travail plus faisable et de garder par cons\u00e9quent les travailleurs actifs plus longtemps.<\/p>\n<p>Dans ce cadre, il a \u00e9galement \u00e9t\u00e9 d\u00e9cid\u00e9 d&rsquo;octroyer un cr\u00e9dit-temps \u00e0 1\/5 ou un emploi de fin de carri\u00e8re aux personnes actives \u00e0 temps partiel chez deux employeurs, mais effectuant un temps complet au total.<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A partir de ce samedi 1er avril 2017, la CCT 103 entrera en vigueur.
