Retour sur le contenu de la proposition du Ministre Willy Borsus qui a d\u00e8s aujourd&rsquo;hui r\u00e9affirm\u00e9 son souhait de revenir \u00e0 une formule permettant aux employeurs et entrepreneurs de revoir la mesure de suppression mise en oeuvre sous la pr\u00e9c\u00e9dente l\u00e9gislature.<!--more--><\/p>\n<p>En effet, le Ministre souhaite r\u00e9introduire une p\u00e9riode d\u2019essai dans le but de promouvoir l\u2019emploi et de faciliter les engagements.\u00a0<em>\u00ab\u00a0Nous constatons d\u00e9j\u00e0 des r\u00e9sultats tr\u00e8s positifs dans les engagements (plus de 105.000 emplois depuis la mise en place du Gouvernement). Les perspectives annonc\u00e9es sont favorables. Mais nous pouvons encore amplifier ce mouvement en facilitant les engagements et en stimulant l\u2019emploi\u00a0\u00bb<\/em>, pr\u00e9cise le Ministre.<\/p>\n<p>Pour rappel, avant 2014, coexistaient deux syst\u00e8mes tr\u00e8s diff\u00e9rents pour les employ\u00e9s et les ouvriers. Dans le cadre du statut unique, le Ministre Borsus propose un syst\u00e8me \u00ab entre les deux \u00bb, valable pour tous, et qui reprendrait pendant la p\u00e9riode d\u2019essai des pr\u00e9avis identiques.<\/p>\n<p><strong><em>Les modalit\u00e9s du syst\u00e8me voulu par le Ministre sont les suivantes :<\/em><\/strong><\/p>\n<p>La dur\u00e9e de la p\u00e9riode d\u2019essai (s\u2019il en est d\u00e9cid\u00e9e une) serait fix\u00e9e :<br \/>\n&#8211; au minimum \u00e0 15 jours calendriers<br \/>\n&#8211; et au maximum de 6 \u00e0 12 mois (variable selon la r\u00e9mun\u00e9ration annuelle du travailleur).<\/p>\n<p><em><strong>Pour quels contrats ?<\/strong><\/em><br \/>\nNouveaut\u00e9 par rapport au syst\u00e8me d\u2019avant 2014 : ne permettre la p\u00e9riode d\u2019essai que pour le CDI et maintenir les r\u00e8gles actuelles pour le CDD (pr\u00e9avis ordinaire pendant la premi\u00e8re moiti\u00e9 du premier CDD avec maximum de 6 mois) : cela donne pour les employeurs une plus-value au CDI avec clause d\u2019essai.<\/p>\n<p>Un seul essai par fonction : on applique l\u2019adage <em>\u2018Non bis in idem\u2019<\/em>. Par exemple, un employeur engage une comptable. Il quitte l\u2019entreprise 6 mois plus tard pour revenir dans la m\u00eame fonction par la suite =&gt; plus besoin de p\u00e9riode d\u2019essai. Par contre, s\u2019il revient mais \u00e0 un autre poste (ex : service des ressources humaines), une p\u00e9riode d\u2019essai sera justifi\u00e9e.<br \/>\nLe passage d\u2019un emploi d\u2019int\u00e9rimaire \u00e0 un CDI est aussi sujet \u00e0 une p\u00e9riode d\u2019essai.<\/p>\n<p><strong><em>Concertation<\/em><\/strong><br \/>\nPour le Ministre : <em>\u00ab\u00a0Le Gouvernement a voulu donner toute sa chance \u00e0 la concertation sociale qui a abouti \u00e0 un \u00e9chec. Je souhaite que le Gouvernement se saisisse rapidement du dossier. Il s\u2019agit d\u2019une mesure qui est positive pour tout le monde, employeur comme travailleur. Via la p\u00e9riode d\u2019essai, un plus grand nombre de travailleurs pourront acc\u00e9der non seulement \u00e0 l\u2019emploi mais aussi \u00e0 des contrats \u00e0 dur\u00e9e ind\u00e9termin\u00e9e. De plus, certains secteurs sont lourdement touch\u00e9s par la concurrence d\u00e9loyale du dumping social. Ils ont donc besoin de ce type de dispositions.
