Au d\u00e9part du cas d&rsquo;un salari\u00e9 roumain licenci\u00e9 pour avoir utilis\u00e9 sa messagerie professionnelle \u00e0 des fins personnelles, la d\u00e9cision concerne tous les salari\u00e9s des pays membres du Conseil de l&rsquo;Europe. Quelle fronti\u00e8re d\u00e9sormais entre vie priv\u00e9e et vie professionnelle dans l&rsquo;utilisation des outils mis \u00e0 disposition des travailleurs?<!--more--><\/p>\n<p>La Cour europ\u00e9enne des droits de l\u2019Homme a tranch\u00e9 le cas d\u2019un salari\u00e9 roumain. Elle a d\u00e9cid\u00e9 de sanctionner la surveillance des courriels priv\u00e9s par un employeur.\u00a0En 2007, l\u2019entreprise employant Bogdan Mihai Barbulescu, un ing\u00e9nieur roumain, le licencie apr\u00e8s avoir examin\u00e9 son activit\u00e9 sur Internet. D\u00e9non\u00e7ant cette surveillance le salari\u00e9 avait saisi les tribunaux roumains, sans succ\u00e8s. Il se tourne alors vers la Cour europ\u00e9enne des droits de l\u2019Homme (CEDH), en vain. En janvier 2016, celle-ci juge en effet que\u00a0<em>\u00ab la surveillance de ses communications par son employeur avait \u00e9t\u00e9 raisonnable dans le contexte d\u2019une proc\u00e9dure disciplinaire \u00bb<\/em>\u00a0et qu\u2019elle ne violait donc pas l\u2019article 8 la Convention europ\u00e9enne des droits de l\u2019homme sur le droit au respect de la vie priv\u00e9e et familiale, du domicile et de la correspondance. D\u00e9bout\u00e9, l\u2019ing\u00e9nieur roumain fait alors appel et la Cour a accept\u00e9 de revoir la d\u00e9cision qui revient cette fois devant la Grande Chambre, la plus haute instance de la CEDH.<\/p>\n<p>Ce mardi 5 septembre, les juges de la Grande Chambre ont consid\u00e9r\u00e9 que\u00a0<em>\u00ables autorit\u00e9s nationales (roumaines) n&rsquo;ont pas correctement prot\u00e9g\u00e9 le droit de M. Bogdan Mihai Barbulescu au respect de sa vie priv\u00e9e et de sa correspondance et n&rsquo;ont donc pas m\u00e9nag\u00e9 un juste \u00e9quilibre entre les int\u00e9r\u00eats en jeu\u00bb.\u00a0<\/em>Alors que la g\u00e9n\u00e9ralisation des outils informatiques et des moyens de communication contribue \u00e0 brouiller la fronti\u00e8re entre vie priv\u00e9e et vie professionnelle, cette d\u00e9cision pourrait avoir des implications bien au-del\u00e0 de la Roumanie, sur les salari\u00e9s des 47 pays membres du Conseil de l\u2019Europe.<\/p>\n<p><em><strong>Surveillance, big data, et vie priv\u00e9e&#8230;<\/strong><\/em><\/p>\n<p>Avec ce nouvel arr\u00eat, les 17 juges de la Grande Chambre pr\u00e9cisent les limites de la marge de man\u0153uvre de l\u2019employeur dans la surveillance des activit\u00e9s \u00e9lectroniques de leurs salari\u00e9s.<\/p>\n<p>Plusieurs gouvernements, tout comme la Conf\u00e9d\u00e9ration europ\u00e9enne des syndicats (CES) ont ainsi tenu \u00e0 intervenir dans les d\u00e9bats en envoyant leurs propres observations \u00e0 la CEDH, insistant sur la n\u00e9cessit\u00e9 de mieux prot\u00e9ger la vie priv\u00e9e des salari\u00e9s.<\/p>\n<p>Dans certains pays europ\u00e9ens, dont la France,\u00a0certains organes\u00a0imposent d\u00e9j\u00e0 des r\u00e8gles protectrices en la mati\u00e8re.\u00a0Ils insistent\u00a0notamment sur le fait que si l\u2019employeur peut limiter l\u2019usage personnel d\u2019Internet, les salari\u00e9s doivent pr\u00e9alablement\u00a0<em>\u00ab \u00eatre inform\u00e9s des dispositifs mis en place et des modalit\u00e9s de contr\u00f4le de l\u2019utilisation d\u2019Internet \u00bb.<\/em><\/p>\n<p>De m\u00eame, si l\u2019employeur peut avoir acc\u00e8s aux donn\u00e9es stock\u00e9es sur l\u2019ordinateur du salari\u00e9, sa curiosit\u00e9 ne peut s\u2019exercer \u00e0 l\u2019endroit de fichiers ou de messages clairement estampill\u00e9s &lsquo;personnels&rsquo;.
