Depuis 18 mois, l&rsquo;institution s&rsquo;est en effet vu octroyer les missions de v\u00e9rification des activit\u00e9s des chercheurs d&#8217;emploi en vue de r\u00e9int\u00e9grer le march\u00e9 du travail. Rappel utile quant aux &lsquo;proc\u00e9dures&rsquo; en vigueur et premier retour quant aux sanctions prises depuis le d\u00e9but de cette ann\u00e9e.<!--more--><\/p>\n<p>Depuis le 1er janvier 2016, le Forem a pour comp\u00e9tence le contr\u00f4le de la recherche d\u2019emploi des jeunes en stage d\u2019insertion et des b\u00e9n\u00e9ficiaires d\u2019allocations de ch\u00f4mage ou d\u2019insertion (disponibilit\u00e9 active). Il est \u00e9galement en charge du contr\u00f4le de la disponibilit\u00e9 passive.<\/p>\n<p><em><strong>Premier public concern\u00e9 : les jeunes en stage d&rsquo;insertion.<\/strong><\/em><\/p>\n<p>En quoi consiste le contr\u00f4le des jeunes en stage d\u2019insertion (Dispo J)?\u00a0Pour pouvoir b\u00e9n\u00e9ficier d\u2019allocations d&rsquo;insertion, le jeune demandeur d\u2019emploi doit faire preuve d\u2019une d\u00e9marche active de recherche d\u2019emploi pendant son stage d\u2019insertion professionnelle.\u00a0Ses d\u00e9marches sont \u00e9valu\u00e9es \u00e0 deux reprises : \u00e0 partir des 5\u00e8me et 10\u00e8me mois apr\u00e8s son inscription comme demandeur d\u2019emploi. La p\u00e9riode \u00e9valu\u00e9e d\u00e9bute \u00e0 la date de l\u2019inscription.<\/p>\n<p>Pour b\u00e9n\u00e9ficier des allocations d\u2019insertion, il faut obtenir deux \u00e9valuations positives, cons\u00e9cutives ou non, pendant le stage d\u2019insertion professionnelle.\u00a0Quelle que soit l\u2019issue de la premi\u00e8re \u00e9valuation (\u00e0 savoir positive ou n\u00e9gative), le jeune est ensuite convoqu\u00e9, une deuxi\u00e8me fois, par le service contr\u00f4le \u00e0 partir du 10\u00e8me mois. Si l\u2019entretien 1 ou 2 est n\u00e9gatif, le demandeur d\u2019emploi peut solliciter un troisi\u00e8me entretien.<\/p>\n<p><strong><em>Deuxi\u00e8me &lsquo;cible&rsquo; : les b\u00e9n\u00e9ficiaires d&rsquo;allocations de ch\u00f4mage<\/em><\/strong><\/p>\n<p>L\u2019\u00e9valuation de la recherche d\u2019emploi a lieu au moins une fois par an pour les b\u00e9n\u00e9ficiaires d\u2019allocations d\u2019insertion et d\u2019allocations de ch\u00f4mage.\u00a0A partir de son 9\u00e8me mois d\u2019inscription ou de r\u00e9inscription, le demandeur d\u2019emploi est convoqu\u00e9 pour un premier entretien qui a pour but d\u2019\u00e9valuer ses d\u00e9marches de recherche d\u2019emploi. En cas d\u2019\u00e9valuation positive, le demandeur d\u2019emploi est \u00e0 nouveau convoqu\u00e9 dans le 12\u00e8me mois apr\u00e8s la date d\u2019\u00e9valuation positive.<\/p>\n<p>En cas d\u2019\u00e9valuation n\u00e9gative, le ch\u00f4meur est \u00e0 nouveau \u00e9valu\u00e9 au cours du 5\u00e8me mois qui suit. Une premi\u00e8re \u00e9valuation n\u00e9gative entra\u00eene un avertissement. Il faut 2 \u00e9valuations positives successives pour annuler l\u2019effet d\u2019un avertissement.\u00a0Si, \u00e0 l\u2019issue du 2\u00e8me entretien, l\u2019\u00e9valuation est positive, le demandeur d\u2019emploi est \u00e0 nouveau convoqu\u00e9 dans le 12\u00e8me mois qui suit.<\/p>\n<p>En cas d\u2019\u00e9valuation n\u00e9gative au 2\u00e8me entretien, le demandeur d\u2019emploi est sanctionn\u00e9 (suspension d\u2019allocations). Ce dernier est \u00e0 nouveau \u00e9valu\u00e9 au 5\u00e8me mois qui suit.\u00a0Si, \u00e0 l\u2019issue du 3\u00e8me entretien, l\u2019\u00e9valuation est positive, le demandeur d\u2019emploi est \u00e0 nouveau convoqu\u00e9 dans le 12\u00e8me mois qui suit.\u00a0En cas d\u2019\u00e9valuation n\u00e9gative au 3\u00e8me entretien, il est exclu du b\u00e9n\u00e9fice des allocations.<\/p>\n<p><strong><em>En quoi consiste le contr\u00f4le de la disponibilit\u00e9 passive?<\/em><\/strong><\/p>\n<p>Le contr\u00f4le de la disponibilit\u00e9 passive concerne tous les ch\u00f4meurs. Lorsque le ch\u00f4meur cr\u00e9e lui-m\u00eame les conditions de sa mise au ch\u00f4mage ou de son maintien au ch\u00f4mage, il se retrouve en situation de ch\u00f4mage volontaire.<\/p>\n<p>Les situations vis\u00e9es dans le cadre de cette mesure sont, entre autres, les suivantes :<\/p>\n<p>\u2022 le d\u00e9faut de pr\u00e9sentation, sans justification suffisante, aupr\u00e8s d\u2019un employeur, lorsque le ch\u00f4meur est invit\u00e9 \u00e0 s\u2019y pr\u00e9senter, par le service r\u00e9gional de l\u2019emploi ;<br \/>\n\u2022 le d\u00e9faut de pr\u00e9sentation, sans justification suffisante, au service de l\u2019emploi, lorsque le ch\u00f4meur est invit\u00e9 \u00e0 s\u2019y pr\u00e9senter, par le service r\u00e9gional de l\u2019emploi ;<br \/>\n\u2022 le refus d\u2019emploi ;<br \/>\n\u2022 le refus de participer \u00e0 un plan d\u2019action individuel ;<br \/>\n\u2022 l\u2019arr\u00eat\/l\u2019\u00e9chec d\u2019un plan d\u2019action individuel en raison de l\u2019attitude fautive du ch\u00f4meur ;<br \/>\n\u2022 l\u2019abandon de formation, de mise en situation professionnelle, d\u2019essais m\u00e9tiers.<\/p>\n<p><strong><em>Le contr\u00f4le en chiffres pour 2017<\/em><\/strong><\/p>\n<p>Au 1er semestre 2017, 24.599 jeunes de moins de 25 ans en stage d\u2019insertion ont \u00e9t\u00e9 \u00e9valu\u00e9s. Ce public est constitu\u00e9 de 12.441 hommes (50,57 %) et 12.158 femmes (49,43 %).\u00a0Sur les 6 premiers mois de l\u2019ann\u00e9e, 28.818 d\u00e9cisions ont \u00e9t\u00e9 prises, dont 23.028 (79,91 %) pour des \u00e9valuations positives et 5.790 (20,09 %) pour des \u00e9valuations n\u00e9gatives.<\/p>\n<p>Parmi les d\u00e9cisions, on compte :<\/p>\n<p>14.395 \u00e9valuations positives et 3.628 n\u00e9gatives en entretien 1,<br \/>\n7.422 \u00e9valuations positives et 1.476 n\u00e9gatives en entretien 2,<br \/>\n1.211 \u00e9valuations positives et 686 n\u00e9gatives en entretien 3.<\/p>\n<p>En ce qui concerne\u00a0les b\u00e9n\u00e9ficiaires d\u2019allocations de ch\u00f4mage ou d\u2019insertion, au 1er semestre 2017, 32.320 b\u00e9n\u00e9ficiaires d\u2019allocations ont \u00e9t\u00e9 \u00e9valu\u00e9s. Ce public est constitu\u00e9 de 19.599 hommes (60,64 %) et 12.721 femmes (39,36 %). Parmi ces personnes, 6.605 ont moins de 30 ans (20,43 %), 7.679 (23 ,75 %) entre 30 et moins de 40 ans, 7.694 (23,80 %) entre 40 et moins de 50 ans et 10.342 (32,02 %) entre 50 et moins de 60 ans.<\/p>\n<p>Sur les 32.584 d\u00e9cisions prises, 21.203 (65,07 %) \u00e9taient positives et 11.381 (34,93 %) \u00e9taient n\u00e9gatives.<\/p>\n<p>Parmi les d\u00e9cisions, on compte :<\/p>\n<p>18.798 \u00e9valuations positives et 8.339 n\u00e9gatives en entretien 1 ;<br \/>\n1.982 \u00e9valuations positives et 2.054 n\u00e9gatives en entretien 2 ;<br \/>\n423 \u00e9valuations positives et 988 n\u00e9gatives en entretien 3.<\/p>\n<p>Enfin, quant au contr\u00f4le de la disponibilit\u00e9 passive, au 1er semestre 2017, 7.897 b\u00e9n\u00e9ficiaires d\u2019allocations ont \u00e9t\u00e9 concern\u00e9s par le contr\u00f4le de la disponibilit\u00e9 passive. Ce public est constitu\u00e9 de 4.821 hommes (61 %) et 3.076 femmes (39 %). Parmi ces personnes, 3.588 (45,43 %) ont moins de 30 ans, 2.350 (29,75 %) entre 30 et moins de 40 ans, 1.482 (18,76 %) entre 40 et moins de 50 ans, 471 (5,96 %) entre 50 et moins de 60 ans et 6 (0,1 %) 60 ans et +.<\/p>\n<p>Le Forem a pris 7.525 d\u00e9cisions, dont 2.163 (39,60 %) sans suite et 5.362 (60,40) avec infraction, dans le cadre du contr\u00f4le de la disponibilit\u00e9 passive li\u00e9es, majoritairement, aux \u00e9v\u00e9nements suivants :<\/p>\n<ul>\n<li>le d\u00e9faut de pr\u00e9sentation aupr\u00e8s du Forem : 1.871, dont 191 sans suite et 1.680 avec infraction ;<\/li>\n<li>le d\u00e9faut de pr\u00e9sentation aupr\u00e8s de l\u2019employeur : 5.444, dont 1.907 sans suite et 3.537 avec infraction ;<\/li>\n<li>le refus d\u2019emploi convenable : 83, dont 27 sans suite et 56 avec infraction.<\/li>\n<\/ul>\n<p>Apparait, au 1er semestre 2017, le traitement des premiers litiges dans le cadre de la formation, soit:<\/p>\n<ul>\n<li>l\u2019abandon de formation : 73, dont 22 sans suite et 51 avec effraction ;<\/li>\n<li>l\u2019arr\u00eat de formation suite \u00e0 l\u2019attitude fautive du ch\u00f4meur : 36, dont 13 sans suite et 23 avec effraction.<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Le Forem livre ce matin les chiffres du contr\u00f4le de disponibilit\u00e9 des ch\u00f4meurs au 1er semestre 2017.
