La nouvelle r\u00e9glementation adopt\u00e9e en avril 2016 par l\u2019Union europ\u00e9enne en mati\u00e8re de protection des donn\u00e9es personnelles sera applicable \u00e0 partir de cette date. Elle prend la forme d\u2019un R\u00e8glement: le R\u00e8glement G\u00e9n\u00e9ral sur la Protection des Donn\u00e9es (plus connu sous le nom de \u2018GDPR\u2019 en anglais). Sur le plan RH, le RGPD impose ainsi deux obligations \u00e0 l\u2019employeur : assurer la parfaite information du travailleur et documenter tous les traitements de donn\u00e9es \u00e0 caract\u00e8re personnel dans un registre adhoc. On se pr\u00e9pare?<!--more--><\/p>\n<p>Le nouveau R\u00e8glement G\u00e9n\u00e9ral sur la Protection des Donn\u00e9es laisse encore quelques mois aux entreprises pour adopter de bonnes pratiques en termes de s\u00e9curit\u00e9 informatique et de protection des donn\u00e9es personnelles.<br \/>\nCe r\u00e8glement est destin\u00e9 \u00e0 remplacer une ancienne directive de 1995 qui avait \u00e9t\u00e9 adopt\u00e9e avant l\u2019apparition des r\u00e9seaux sociaux, du Big Data, du Cloud computing et de l\u2019internet des objets. Cette directive a \u00e9t\u00e9 transpos\u00e9e en droit belge dans la loi du 8 d\u00e9cembre 1992 relative \u00e0 la protection de la vie priv\u00e9e \u00e0 l\u2019\u00e9gard des traitements de donn\u00e9es \u00e0 caract\u00e8re personnel (\u2018Loi Vie Priv\u00e9e\u2019).<br \/>\nPour des organisations qui n&rsquo;ont pas l&rsquo;habitude de faire de la s\u00e9curit\u00e9 une priorit\u00e9 par d\u00e9faut, la GDPR impose un chantier qui peut \u00eatre colossal.<\/p>\n<p><strong><em>S\u00e9curit\u00e9, s\u00e9curit\u00e9, s\u00e9curit\u00e9&#8230;<\/em><\/strong><\/p>\n<p>Aujourd&rsquo;hui chaque pays a sa propre l\u00e9gislation plus ou moins stricte sur l&rsquo;utilisation des donn\u00e9es personnelles. Avec la multiplication des fuites de donn\u00e9es suite \u00e0 diff\u00e9rentes attaques (Yahoo, Sony, TalkTalk, etc.), ou des manipulations de grandes entit\u00e9s comme les GAFA, la n\u00e9cessit\u00e9 d&rsquo;agir est globale. C&rsquo;est tout l&rsquo;int\u00e9r\u00eat de la GDPR, la premi\u00e8re mesure supranationale qui r\u00e9gule l&rsquo;utilisation des donn\u00e9es personnelles pour les entreprises et les institutions priv\u00e9es ou publiques. Visant \u00e0 homog\u00e9n\u00e9iser la r\u00e9glementation d\u00e9j\u00e0 existante, la GDPR sera appliqu\u00e9e de fa\u00e7on syst\u00e9matique aux 28 membres de l&rsquo;union Europ\u00e9enne, sans mesure \u00ab\u00a0\u00e0 la carte\u00a0\u00bb.<\/p>\n<p>La r\u00e9glementation impose de nombreuses contraintes pour les entreprises. En effet, la GDPR encadre l&rsquo;utilisation des donn\u00e9es personnelles et redonne le pouvoir au consommateur en lui conf\u00e9rant le droit d&rsquo;acc\u00e9der aux informations qui le concernent, le droit \u00e0 l&rsquo;oubli, le droit \u00e0 la portabilit\u00e9 et un droit d&rsquo;opposition. \u00a0La GDPR restitue ainsi la propri\u00e9t\u00e9 des donn\u00e9es aux citoyens et non plus aux entreprises.<\/p>\n<p>N\u00e9anmoins, au-del\u00e0 de ces deux axes majeurs, la GDPR vient surtout placer la s\u00e9curit\u00e9 informatique au centre des pr\u00e9occupations des entreprises. Alors qu&rsquo;elle a toujours \u00e9t\u00e9 appr\u00e9hend\u00e9e comme une contrainte pour les comit\u00e9s directeurs, ces derniers n&rsquo;ont d\u00e9sormais plus d&rsquo;autre choix que de l&rsquo;int\u00e9grer par d\u00e9faut \u00e0 chaque projet &#8211; une r\u00e8gle de bon sens s&rsquo;il en est.<\/p>\n<p>Cette nouvelle r\u00e9glementation d&rsquo;adresse aux organismes publics et priv\u00e9s qui traitent, manipulent, g\u00e8rent ou stockent des donn\u00e9es personnelles de citoyens europ\u00e9ens. D&rsquo;une part, elle a vocation \u00e0 renforcer la l\u00e9gislation en mati\u00e8re de protection des donn\u00e9es personnelles et, d&rsquo;autre part, \u00e0 l&rsquo;harmoniser au sein de l&rsquo;Union Europ\u00e9enne. Il s&rsquo;agit \u00e9galement, \u00e0 l&rsquo;heure o\u00f9 le num\u00e9rique et la mobilit\u00e9 explosent, de prot\u00e9ger les individus contre la manipulation potentiellement malveillante de leurs donn\u00e9es.<\/p>\n<p>En cas de non-respect de la r\u00e9glementation, la GDPR pr\u00e9voit une sanction dont le montant pourrait culminer jusqu&rsquo;\u00e0 4% du chiffre d&rsquo;affaires annuel ou 20 millions d&rsquo;euros, le chiffre le plus \u00e9lev\u00e9 \u00e9tant retenu.<\/p>\n<p><em><strong>Priorit\u00e9 \u00e0 l&rsquo;audit pr\u00e9liminaire.<\/strong><\/em><\/p>\n<p>La mise en place de mesures visant \u00e0 se conformer \u00e0 la GDPR est un chantier chronophage et on\u00e9reux pour les entreprises. N\u00e9anmoins, si le co\u00fbt de la mise en oeuvre de ces changements n\u00e9cessaires sont \u00e9lev\u00e9s, ils permettent d&rsquo;am\u00e9liorer la gestion des donn\u00e9es internes et externes, d&rsquo;all\u00e9ger la bases de donn\u00e9es et de parfaire la documentation. Un investissement qui devrait pousser les entreprises r\u00e9fractaires \u00e0 gagner en efficacit\u00e9 et en productivit\u00e9.<\/p>\n<p>Pour s&rsquo;assurer d&rsquo;\u00eatre pr\u00eat le jour J, deux priorit\u00e9s doivent \u00eatre respect\u00e9es.<\/p>\n<p>D&rsquo;une part, un nouveau profil exig\u00e9 par la r\u00e9glementation doit \u00eatre cr\u00e9\u00e9. Un D\u00e9l\u00e9gu\u00e9 de la Protection des Donn\u00e9es (DPO) devra ainsi veiller \u00e0 la bonne application de la GDPR dans l&rsquo;entreprise, en reportant directement au comit\u00e9 directif.<\/p>\n<p>D&rsquo;autre part, les entreprises qui ne l&rsquo;ont pas encore fait doivent sans tarder r\u00e9aliser un audit d&rsquo;impact sur la protection des donn\u00e9es, afin de faire un \u00e9tat des lieux de leur s\u00e9curit\u00e9. O\u00f9 sont stock\u00e9es les donn\u00e9es manipul\u00e9es ? Quels process mettre en place pour les s\u00e9curiser ? Comment int\u00e9grer la s\u00e9curit\u00e9 par d\u00e9faut \u00e0 l&rsquo;ensemble des projets ?<\/p>\n<p>Les changements chronophages exig\u00e9s par la r\u00e9glementation GDPR devront d\u00e9sormais \u00eatre act\u00e9s dans moins d&rsquo;un an : il est temps pour les entreprises de d\u00e9passer la phase d&rsquo;\u00e9valuation d&rsquo;exposition aux risques et d&rsquo;activer progressivement ces nouveaux process pour \u00e9viter toute p\u00e9nalisation d\u00e8s le 25 mai 2018.<\/p>\n<p><strong><em>Toutes les entreprises concern\u00e9es ?<\/em><\/strong><\/p>\n<p>En remplacement de la d\u00e9claration de traitement \u00e0 la Commission Vie Priv\u00e9e,\u00a0l\u2019employeur a donc l\u2019obligation de tenir un registre de donn\u00e9es. Cette obligation remplace l\u2019obligation de d\u00e9claration \u00e0 la Commission Vie Priv\u00e9e. Elle s&rsquo;applique en principe aux entreprises qui occupent au moins 250 travailleurs. Toutefois, les plus petites entreprises doivent quand m\u00eame tenir un registre lorsque le traitement de donn\u00e9es \u00e0 caract\u00e8re personnel auquel elles proc\u00e8dent est susceptible d\u2019engendrer un risque pour les droits et libert\u00e9s des personnes concern\u00e9es ; ou\u00a0lorsque le traitement n\u2019est pas occasionnel.\u00a0La gestion de personnel, notamment, rel\u00e8ve du \u00ab\u00a0traitement non occasionnel\u00a0\u00bb selon la Commission Vie Priv\u00e9e.
