L\u2019objectif est de contr\u00f4ler, \u00e0 leur insu, les r\u00e9ponses et r\u00e9actions des employeurs.<br \/>\nD\u00e9sormais, le \u00ab\u00a0contr\u00f4le myst\u00e8re\u00a0\u00bb des employeurs est possible. L\u2019UCM explique pourquoi elle d\u00e9sapprouve cette approche.<!--more--><\/p>\n<p>L\u2019UCM avait condamn\u00e9 l\u2019id\u00e9ologie entourant le projet, tout en s\u2019inqui\u00e9tant des cons\u00e9quences des telles pratiques. Selon l&rsquo;organisation de d\u00e9fense des employeurs, celle-ci t\u00e9moigne de l&rsquo;absence d&rsquo;\u00e9coute des autorit\u00e9s.<\/p>\n<p>Quelles sont les vraies pr\u00e9occupations des entrepreneurs face \u00e0 la complexe probl\u00e9matique qu\u2019est la discrimination :<br \/>\n&#8211; l\u2019enjeu d\u2019une approche globale et d\u2019un accompagnement positif des entreprises;<br \/>\n&#8211; l\u2019ins\u00e9curit\u00e9 juridique entourant la notion \u2013 souvent floue \u2013 de discrimination;<br \/>\n&#8211; la priorit\u00e9 donn\u00e9e aux comp\u00e9tences et \u00e0 la motivation lors d\u2019un recrutement;<br \/>\n&#8211; l\u2019impact d\u2019autres r\u00e9glementations, par exemple les bar\u00e8mes li\u00e9s \u00e0 l\u2019\u00e2ge\/anciennet\u00e9 en cas d\u2019embauche d\u2019un travailleur plus \u00e2g\u00e9;<br \/>\n&#8211; le m\u00e9canisme de responsabilit\u00e9 partag\u00e9e entre le travailleur et l\u2019employeur lors d\u2019un contr\u00f4le,<br \/>\n&#8211; la perte de temps qu\u2019entra\u00eene ce type de test;<br \/>\n&#8211; l\u2019introduction dangereuse du principe d\u2019usage de faux dans le contr\u00f4le des mati\u00e8res sociales;<br \/>\n&#8211; le risque de chevauchement avec le pouvoir f\u00e9d\u00e9ral, o\u00f9 un projet similaire suit malheureusement son cours;etc.<\/p>\n<p>L&rsquo;UCM d\u00e9plore donc que le <em>\u00ab\u00a0Gouvernement bruxellois ait tout de m\u00eame maintenu son cap, suivi par la plupart des parlementaires (majorit\u00e9 comme opposition). Les entreprises bruxelloises ne peuvent maintenant plus que prendre acte de cette d\u00e9cision. Les entreprises bruxelloises seront les seules entreprises d\u2019Europe devant faire face \u00e0 la r\u00e9ception de faux CV et d\u2019appels des inspecteurs sous une fausse identit\u00e9.\u00a0\u00bb<\/em><\/p>\n<p><em><strong>Besoin de balises pr\u00e9cises.<\/strong><\/em><\/p>\n<p>Quelques garanties ont \u00e9t\u00e9 mises sur la table :<\/p>\n<p>&#8211; le testing devrait \u00eatre utilis\u00e9 en dernier recours par l\u2019inspection r\u00e9gionale;<br \/>\n&#8211; le testing devrait \u00eatre ax\u00e9 sur des entreprises pr\u00e9sentant des indices de discrimination, tout en \u00e9vitant la provocation;<br \/>\n&#8211; certains secteurs seront particuli\u00e8rement vis\u00e9s, comme l\u2019int\u00e9rim et les titres-services;<br \/>\n&#8211; enfin, un contr\u00f4le \u00ab positif \u00bb pourra \u00eatre temp\u00e9r\u00e9 par l\u2019inspecteur, allant d\u2019un simple rappel de la loi jusqu\u2019\u00e0 un proc\u00e8s-verbal si la discrimination est volontaire et organis\u00e9e.<\/p>\n<p>Les pratiques et la m\u00e9thodologie de l\u2019inspection vont \u00eatre d\u00e9finies. Mesure &lsquo;in\u00e9dite&rsquo; oblige, la mise en \u0153uvre des tests en situation n\u2019a pas encore de balises pr\u00e9cises. Un monitoring sera pr\u00e9sent\u00e9 chaque ann\u00e9e aux partenaires sociaux, en juin.
