Le syst\u00e8me pr\u00e9vu dans la r\u00e9forme du march\u00e9 du travail imagin\u00e9e par le gouvernement doit permettre aux travailleurs de b\u00e9n\u00e9ficier d&rsquo;une flexibilit\u00e9 accrue et d&rsquo;une autonomie renforc\u00e9e dans la gestion de leurs vacances et heures suppl\u00e9mentaires. Manifestement, la &lsquo;lib\u00e9ration&rsquo; des travailleurs l&#8217;emporte sur les difficult\u00e9s de gestion des effectifs qui pourraient r\u00e9sulter de cette mesure.<!--more--><\/p>\n<p>Une enqu\u00eate men\u00e9e par le groupe de services RH ACERTA aupr\u00e8s de 469 CEO et membres de direction r\u00e9v\u00e8le que 75 % d\u2019entre eux sont enclins \u00e0 l\u2019id\u00e9e d\u2019\u00e9pargne-carri\u00e8re. Le gouvernement f\u00e9d\u00e9ral \u00e9tudie encore la mesure pour d\u00e9but 2018. En outre, quasiment la moiti\u00e9 des personnes interrog\u00e9es veulent \u00e9changer une partie de leur salaire contre des vacances suppl\u00e9mentaires.<\/p>\n<p><em>\u00ab\u00a0Parmi les sujets br\u00fblants de la loi sur le travail faisable et maniable, on retrouve l\u2019\u00e9pargne-carri\u00e8re, concept permettant aux travailleurs de mettre de c\u00f4t\u00e9 des vacances, des heures suppl\u00e9mentaires ou un cr\u00e9dit d\u2019heures flottantes jusqu\u2019\u00e0 un moment qu\u2019ils jugent plus opportun de les prendre. D\u00e8s le 1er f\u00e9vrier 2018, cette option deviendra une r\u00e9alit\u00e9. Employeurs et travailleurs pourront alors organiser le travail et le non-travail de mani\u00e8re plus flexible. La loi sur le travail faisable et maniable cr\u00e9e une relation plus mature entre employeurs et travailleurs. Elle donne aux employeurs et aux travailleurs plus de marge en mati\u00e8re de r\u00e9glementation du travail. La flexibilit\u00e9 est d\u2019ailleurs une pr\u00e9occupation commune \u00e0 tous les acteurs. Les travailleurs sont, eux aussi, demandeurs comme le r\u00e9v\u00e8le notre enqu\u00eate travailleurs \u00e0 laquelle 70 % d\u2019entre eux ont d\u00e9j\u00e0 indiqu\u00e9 \u00eatre partisans de l\u2019\u00e9pargne-carri\u00e8re. Le fait que les employeurs d\u00e9clarent maintenant y \u00eatre \u00e9galement favorables d\u00e9montre que notre march\u00e9 du travail est pr\u00eat et qu\u2019un cadre l\u00e9gislatif est n\u00e9cessaire d\u2019urgence.\u00a0\u00bb<\/em><\/p>\n<p><strong><em>Passer au concret&#8230;<\/em><\/strong><\/p>\n<p>Le fait que les partenaires sociaux ne parviennent pas au Conseil National du Travail \u00e0 conclure un accord sur l\u2019\u00e9pargne-carri\u00e8re montre que les parties ne s\u2019accordent pas toujours sur le mode de mise en \u0153uvre de cette flexibilit\u00e9. <em>\u00ab\u00a0Cela ne signifie pas qu\u2019employeurs et travailleurs ne trouveront pas de terrain d\u2019entente. Si nous pouvons constater que 75 % des CEO sont bel et bien enclins \u00e0 une mise en \u0153uvre concr\u00e8te et que les travailleurs y sont \u00e9galement favorables, une \u00e9tape logique consiste \u00e0 conclure des accords \u00e0 ce sujet au niveau sectoriel ou \u00e0 donner de la marge au niveau de l\u2019entreprise pour r\u00e9glementer la question. Reste \u00e0 esp\u00e9rer qu\u2019on en offre rapidement l\u2019occasion aux travailleurs et aux employeurs.\u00a0\u00bb<\/em><\/p>\n<p>Dans le cadre de l\u2019\u00e9pargne-carri\u00e8re, la question reste d\u2019\u00e9changer des heures contre des heures. Il s\u2019agit uniquement de temps, de regrouper le temps prest\u00e9 et le temps libre. Il ressort de l\u2019enqu\u00eate d\u2019ACERTA que les CEO sont d\u2019accord pour \u00e9tendre le d\u00e9bat. <em>\u00ab\u00a0Naturellement, il y a aussi le lien entre heures et salaire. L\u2019id\u00e9e de livrer une partie du salaire contre des vacances suppl\u00e9mentaires n\u2019est pas abracadabrante et les CEO y tendent \u00e9galement l\u2019oreille. 45 % ont plac\u00e9 en pole position \u201c\u00c9changer une partie du salaire en cash contre des jours de vacances suppl\u00e9mentaires\u201d comme option offerte aux travailleurs pour composer eux-m\u00eames leur package salarial. Si employeur et travailleurs peuvent convenir librement au niveau de l\u2019entreprise, nous pouvons nous attendre \u00e0 des mises en \u0153uvre int\u00e9ressantes et cr\u00e9atives dans lesquelles les deux parties se reconnaissent. Dans ce contexte, il est important de pr\u00e9voir suffisamment de flexibilit\u00e9, pouvant mener \u00e0 des r\u00e9ponses individualis\u00e9es aux besoins.\u00a0\u00bb<\/em><\/p>\n<p>&nbsp;<\/p>\n<p><em>M\u00e9thodologie : l\u2019enqu\u00eate ci-dessus a \u00e9t\u00e9 effectu\u00e9e en juin en collaboration avec un bureau d\u2019enqu\u00eate reconnu par le biais de la m\u00e9thode de panel en ligne. 469 CEO ou dirigeants d\u2019entreprise actifs dans diff\u00e9rents secteurs et r\u00e9gions ont particip\u00e9 \u00e0 l\u2019enqu\u00eate.
