Si le d\u00e9lestage entra\u00eene des perturbations dans les transports publics emp\u00eachant le travailleur de se rendre \u00e0 temps \u00e0 son travail, celui-ci n&rsquo;aura droit \u00e0 sa r\u00e9mun\u00e9ration normale pour les heures non prest\u00e9es que si le d\u00e9lestage pr\u00e9sentait pour lui un caract\u00e8re impr\u00e9visble, c&rsquo;est-\u00e0-dire s&rsquo;il n&rsquo;avait pas \u00e9t\u00e9 annonc\u00e9. En pratique, cela ne concernera que les travailleurs en \u00e9quipe, les d\u00e9lestages n&rsquo;\u00e9tant mis en place qu&rsquo;en soir\u00e9e.<\/p>\n<p>2. Si le d\u00e9lestage ne peut pas \u00eatre consid\u00e9r\u00e9 comme un cas de force majeure (c&rsquo;est-\u00e0-dire s&rsquo;il \u00e9tait pr\u00e9visible et que des mesures raisonnables pouvaient \u00eatre prises), l&#8217;employeur qui ne fournit de travail \u00e0 ses travailleurs sera redevable des r\u00e9mun\u00e9rations normales pour les heures non prest\u00e9es. L&#8217;employeur qui se trouve dans la quatri\u00e8me zone de d\u00e9lestage pourra toutefois encore se r\u00e9fugier derri\u00e8re le cas de force majeure lors du quatri\u00e8me jour de d\u00e9lestage si les autorit\u00e9s ne communiquent pas sur la dur\u00e9e attendue du d\u00e9lestage. Si en revanche cette question est claire d\u00e8s le d\u00e9part, il sera plus difficile d&rsquo;invoquer la force majeure.<\/p>\n<p>4.
