Le mouvement de gr\u00e8ve intervient dans le cadre de la volont\u00e9 du nouveau gouvernement de revoir des \u00e9l\u00e9ments essentiels tels que le temps de travail et l&rsquo;\u00e9volution des carri\u00e8res au sein de l&rsquo;administration. Les ministres concern\u00e9s et les organisations syndicales se sont retrouv\u00e9es afin de trouver une issue au conflit qui \u00e9merge. Le point de situation.<!--more--><\/p>\n<p>Le Ministre-Pr\u00e9sident du Gouvernement wallon Willy BORSUS et les Vice-pr\u00e9sidents Alda GREOLI et Pierre-Yves JEHOLET ont re\u00e7u \u00e0 l\u2019Elysette une d\u00e9l\u00e9gation syndicale dans le cadre du mouvement de gr\u00e8ve touchant le service public wallon. La rencontre a port\u00e9 sur plusieurs questions li\u00e9es \u00e0 la convention sectorielle 2013-2016, dont la proc\u00e9dure de nomination (de contractuels) dans le cadre de l\u2019article 119 Quater et la r\u00e9duction du temps de travail avec embauche compensatoire.<\/p>\n<p>Le Gouvernement a rappel\u00e9 que le Conseil d\u2019Etat avait point\u00e9 le caract\u00e8re inconstitutionnel de la suppression, par le pr\u00e9c\u00e9dent Gouvernement, de la notion \u00ab\u00a0d\u2019ordre utile\u00a0\u00bb dans l\u2019article 119 Quater. Cet article organise la s\u00e9lection des agents destin\u00e9s \u00e0 \u00eatre nomm\u00e9s. La suppression de l\u2019ordre utile entra\u00eenerait une discrimination entre les membres du personnel contractuel d\u00e9j\u00e0 en place au sein des services du Gouvernement et\u00a0tous les autres candidats \u00e0 des emplois statutaires.<\/p>\n<p>La piste actuellement poursuivie consiste \u00e0 modifier l\u2019article 119 Quater pour qu\u2019il rencontre les remarques de la Haute Cour\u00a0et rencontrer, in fine, l\u2019objectif de doter les membres du personnel contractuel de v\u00e9ritables perspectives de carri\u00e8re. Le Gouvernement a rappel\u00e9 \u00e0 la d\u00e9l\u00e9gation qu\u2019en l\u2019\u00e9tat, l\u2019article 119 Quater permet d\u00e9j\u00e0 de nommer du personnel contractuel\u00a0: 215 nominations sont intervenues en 2016 et 137 en 2017 (chiffre arr\u00eat\u00e9 \u00e0 la date du 30 septembre). Il est donc abusif de dire que le Gouvernement refuse les nominations de contractuels.\u00a0La d\u00e9l\u00e9gation a exprim\u00e9 un avis inverse, notamment quant \u00e0 la lecture de l\u2019avis du Conseil d\u2019Etat.<\/p>\n<p>Concernant la r\u00e9duction du temps de travail avec embauche compensatoire d\u00e9cid\u00e9e dans le cadre de la convention sectorielle conclue entre les syndicats et le pr\u00e9c\u00e9dent Gouvernement, un certain nombre d\u2019\u00e9cueils juridiques et organisationnels li\u00e9s \u00e0 cette mesure avaient \u00e9t\u00e9 identifi\u00e9s. Un groupe de travail avait tent\u00e9 pr\u00e9c\u00e9demment, mais sans succ\u00e8s \u00e0 ce jour,\u00a0de r\u00e9soudre les difficult\u00e9s fonctionnelles et organisationnelles inh\u00e9rentes \u00e0 la mise en \u0153uvre de la r\u00e9duction du temps de travail pour certaines fonctions et \u00e0 l\u2019op\u00e9rationnalisation de l\u2019embauche compensatoire.<\/p>\n<p>Le Gouvernement rappelle que la mesure est budg\u00e9t\u00e9e et que les moyens sont donc toujours disponibles. La d\u00e9l\u00e9gation a indiqu\u00e9 que des r\u00e9ponses sont possibles quant \u00e0 la rencontre de ces difficult\u00e9s.<\/p>\n<p>Afin de tenter de trouver une solution rapide, le Gouvernement et la d\u00e9l\u00e9gation syndicale ont pr\u00e9vu de se rencontrer le 12 d\u00e9cembre prochain (\u00e0 7h \u00e0 l\u2019Elysette). Il a \u00e9t\u00e9 convenu que serait aussi et notamment abord\u00e9e la question de la mise en place des missions critiques en lieu et place des services continus. Pour rappel, une exp\u00e9rience pilote est actuellement en cours. Par services continus, l\u2019on entend les services qui fonctionnent 7 jours sur 7, 24h sur 24 ; ne peuvent \u00eatre interrompus sans pr\u00e9judice grave ; r\u00e9pondent aux besoins logistiques internes indispensables au bon fonctionnement de l\u2019administration.<\/p>\n<p>Le Gouvernement a inform\u00e9 la d\u00e9l\u00e9gation de sa volont\u00e9 tr\u00e8s nette de respecter la convention sectorielle 2013-2016 d\u00e8s l\u2019instant o\u00f9 sa mise en \u0153uvre est valid\u00e9e juridiquement et fonctionnellement.<\/p>\n<p><em>Source : Cabinet du Ministre Pr\u00e9sident.<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Le blocage des services publics wallons intervenu en cette fin de semaine d\u00e9montre \u00e0 nouveau la difficult\u00e9 de &lsquo;bouger les lignes&rsquo; au sein de la fonction publique.
